Affordable Care Act

Overview: In 2010, Congress passed President Barack Obama’s historic health care overhaul, a sweeping package of laws that aims to provide insurance for most Americans. In June of 2012, the Supreme Court upheld virtually all of the law in a 5-4 decision.

The law requires people to have health insurance, either through their employer, an approved government program such as Medicare or Medicaid or by purchasing it through an insurance “exchange.” The exchanges are web sites where consumers can compare prices and features of insurance plans. The law includes subsidies to help people making up to 400 percent of the federal poverty level purchase insurance through the exchange. Some states created their own exchanges while others, including Oklahoma, refused to do so and will have a federally created exchange.

Some parts of the law have already taken effect, such as a provision that people can stay on their parents’ health insurance until they turn 26. Another part of the law bans insurance companies from refusing to cover people due to a pre-existing condition. A requirement that all large employers offer health insurance to their employees was to take effect in 2014 but has been delayed one year.

Meanwhile, controversy over the law continues, with Republicans in Congress voting to repeal the law. In Oklahoma, a federal lawsuit filed by Attorney General Scott Pruitt is challenging the law. About 18 percent of the state’s population is uninsured.
