Immigration law changing

The county Sheriff's Office plans to start checking the immigration status of those who are arrested and jailed.

Tulsa police, in the recent past, have said enforcing immigration laws isn't their business.

The Tulsa County Sheriff's Office has made it its business.

House Bill 1804 -- signed into Oklahoma law Tuesday -- tries to end the argument, but there's still a great deal of uncertainty on the issue.

The law, which goes into effect in November, says when someone is charged with a felony or drunken driving and put in jail, a "reasonable effort" must be made to determine if the person jailed is legally in the United States or not.

The Tulsa Police Department is awaiting a "memorandum of understanding" between state and federal authorities, said Officer Jason Willingham with Tulsa Police.

"I don't think our policy will ever be 'We're going out to look for illegal immigrants,' " he said. "They commit a crime, and that's when we'll start asking questions. We're not going into an apartment complex and start looking for (resident) papers."

Until the memorandum is worked out, he said the issue is undecided.

"We just don't really know until we get that. It's a legality issue."

The Sheriff's Office, on the other hand, is already in the process of contracting with U.S. Immigration and Customs Enforcement to police illegal immigration, said Tulsa County Undersheriff Brian Edwards.

He said the office will soon begin

training to make "mini ICE agents" out of 30 deputies -- 10 from the field and 20 from the jail. That should be done by the end of the year, he said.

"It will make the process of dealing with a person whose status is in question a lot more efficient," Edwards said.

"Some of this stuff we probably should have been doing all along."

The Sheriff's Office said its decision to enforce immigration laws was made independent of the state immigration bill.

"The goal is to try to get rid of the criminal element," Edwards said. "That's our goal, to make our community safer and get rid of the criminal element."

Tulsa Police have said in the past that tackling illegal immigration would compromise its community policing efforts.

Illegal immigrants might hesitate to report crimes for fear of deportation, some have said.

However, Edwards said, the burden of the new law will fall most heavily on sheriff's offices that run county jails, where those arrested for felonies and drunken driving are taken and most likely verified as legally present or not.

Edwards said equipment to verify someone's status will be kept at the jail but could be used on the field, as well.

Members of the Hispanic community have worried over how the law will be enforced.

The law says that, if the prisoner can't show documents of legal status in the United States, then verification must be sought within 48 hours through the U.S. Department of Homeland Security or a system the department designates.

If that doesn't turn up proof the prisoner is here legally, then Homeland Security must be contacted, the law says.

Another concern has been crowding the county jails.

Edwards said that should not be a problem. Tulsa Jail on Tuesday held 1,430 people and can operate with about 1,650, he said.

the tulsa world has a way of misleading people with false headlines. their title Immigration law changing is not true. the illegal immigration law is changing, that is what it should have said. we still have the same immigration laws should the illegals choose to use them the right way. don't say the immigration laws are changing when they aren't.

Why don't the democrats just declare war on Mexico? Then we can use our tax dollars to rebuild Mexico for them since they would rather come over here and tell us how to run America while using our tax $'s.

Which is cheaper ?

I have no problem with the hard working people here trying to make a better life. What I do have an issue with is all the apartment complexes that have illegals that do nothing more then sit outside day in and day out drinking beer and throwing tier beer bottles in the grass and then pissing wherever they have the urge.

As with all people there are very respectable and good working people, but then these others cast a bad light. Make it easier for the good people to get legal and boost the economy. Send back the drunks and thieves!

ILLEGAL IMMIGRANT LAW, ILLEGAL ALIEN is the correct term. ILLEGAL knows no skin color, is not racist. ILLEGAL is a description of citizenship status. Tulsa World call it like it is..."undocumented worker" "immigrant" and the new one in HR 1645 (US LEVEL) "conditional immigrant" are incorrect terms.

The Key word is 'ILLEGAL'. My understanding of the word is: "Breaking the rule of Law". Anyone whom is ILLEGAL or commiting an illegal act is breaking the law...there is no grey area or inbetween.

My family came to the U.S. from Italy in 1920 LEGALLY. My Grandfather learned English and then made sure that everyone else in the family did. I'm proud to be Italian, but even prouder to be an American. My family did everything by the book, but why do some of today's immigrants think that it no longer applies to them and that they can do whatever they want? I know of many LEGAL immigrants that have come to this country, and to them, I say thank you...And if they can do it, why not others? No one should be able to jump ahead of the line...

Don't punish just the illigal immegrant, start at the top with government, and the people that hire this workers and pay them below minimum wages and no benefits. They are breaking the law just as much if not more.

my husband is hispanic and he is not here to cause any kind of trouble he is here to work and have a better life,i believe a lot of people are just down right predjudeced and that isnt right i have one of the worlds best man and ,if it wasnt for hispanics there would be no new houses or bussiness,because the americans are plain down right lazy, i know i am one!!!!!

How long has your husband been here? Is he legal citizen? Has he even attempted to apply for legal citizenship? How many taxes has he paid if not legal? Your welcome in advance for the benefits legal citizens have worked and paid for you to enjoy (at least your husband) for free. By the way, why are hispanics so reluctant to apply for citizenship? Is it racist when i asked my Canadian friends when they became citizens of the USA? Funny, they don't get affended, they obeyed the law. If your husband is a hard worker he should also work hard to apply for citizenship, carry the USA flag, and strive to speak english...people make choices then want to blame everyone else and chalk it up to "racism"...what a cop out!

AMERICANS LAZY? Corporate America gets corporate welfare benefits from the tax payers, everyone look in the mirror. Is easy pay people cheaper if business doesn't have to pay benefits(healthcare, insurance, income tax, retirement, etc.). American citizens won't do the jobs because of the pay scale that continues to go down as result of alledged cheap labor. Cheap labor is a farce: the $8.50 per hour paid is really more like $23.50 per hour buy the time you add in benefits. The problem: tax payers pick up the difference between the $23.50-8.50 = $15.00 hour tax payer pay, employers don't. Like saying go play the best you can in sports, but the team who is allowed to use steroids is guaranteed to win but will not be penalized.

I THINK THAT IF EVEY ONE IS SO CERTAIN THAT IMMIGRANTS ARE THE CAUSE OF LOW WAGES IN OKLAHOMA THEN WHAT DO YOU EXPECT WILL HAPPEN ONCE THEY ARE DEPORTED AND LETS SAY WAGES POSSIBLY DO GO UP? SO WILL THE COST OF LIVIVNG WHICH WILL BRING YOU BACK TO SQUARE ONE .....THE LOWER WAGES ALSO GO WITH THE LOWER COST OF LIVING IN OKLAHOMA THATS JUST HOW IT IS ALL OVER THE UNITED STATES AND ALSO ONCE THEY ARE DEPORTED AND THEY HAVE TO ACTUALLY PAY GOOD WAGES WITH BENEFITS YOU WILL SEE A RISE IN COST FOR CLOTHING, GAS, FOOD ECT.....

I am a proud American Citizen of Mexican Heritage...I think alot of them don't apply to get in legally because they will no be accepted..they have no $$$...sooo if you can't feed your family and have to risk your life coming to the US..then I think we should help..it's ironic how alot of Christians will donate money and help other countries..but hey there are people close by you can help. We are all immigrants and I have no problem with people trying to better themselves.

ive been around hispanics for along time and i have children who are partially hispanic also my fiance and is from mexico and i dont see a thing wrong with him or any other person who is of the latino race to be here if they are trying to do right and stay straight but i dont think its fair that us the U s citizens judge all hispanics for the wrong of a few not everyone is the same my fiance works hard to take care of our family and he is in church but its just to hard to get the papers he needs to be here legally almost 9000.00 and plus all the years waiting for a reply i think we should try and make it easier for them to get their papers and when they apply for their papers put them on a probation for the first year they have to show they are working and staying out of trouble then we should give them a temp. card and work up from there with their citizenship but us just spending money sending them back just for them to turnaround and come back in 3 weeks thats wrong we should try harder to help them arent we the land of the free???

Law breakers are not Tulsa Police business, then what is there business? Maybe that is why are crime rate is out of control. Tulsa Police needs a new chief to make it police business or fire them.

People, People. I have reed some comments and all of them mean hate to our immigrant brothers. As an American citizen I know that we are very religious. We came from the same creator. Why we are so hateful?. We all will ended up in the same place either heaven or hell. Make the right choice and lets be what we are, the kind American. At least in our own country. Because, not only the world hate us. Lets start here in our country . And think what if you were in the place of those immigrants.
