Immigration Reform: The Fallout: Change has volunteers edgy

Lonnie Vaughan drove a long church van down empty city streets early Sunday morning to take a family to church.

He considers it a service to God but fears a new state law will consider it a crime.

Sometimes the people he takes to church are illegal immigrants.

A bill the governor signed into law last week says it's a felony to knowingly transport illegal immigrants in many cases.

It also makes it illegal, in many cases, to knowingly conceal, harbor or shelter an illegal immigrant.

The law takes effect in November but already has injected fear into the Hispanic community and the many non-Hispanics who serve them.

Vaughn estimates that at least a third of the Hispanics he drives to and from Southern Hills Baptist Church are in the country illegally.

"Oklahoma has gone and made a felon out of me," Vaughan said as he climbed into the van.

Many don't understand the law and all that it means. Trying to change that is the man who essentially wrote it, Rep. Randy Terrill, R-Moore.

The law has exceptions that people don't see, he said, because they are based on case law and not written into the law itself.

Case law is based on judicial decisions and legal precedent rather than on statutes.

"The law is concerned with reason," Terrill said. "It is not concerned with irrational fear from people who won't bother to read the statute and figure out what it means."

The bill is called the Oklahoma Taxpayer and Citizen Protection Act of 2007

and was signed by Gov. Brad Henry on Tuesday evening, a few hours before his deadline to act on the measure.

Ever since, people have been asking questions.

Will Vaughan be arrested for driving illegal immigrants to church?

Probably not, Terrill said.

Will a person be arrested for taking an illegal immigrant to work? Could be, he said.

That's because there are exceptions for transporting an illegal immigrant for religious, educational or humanitarian needs, he said.

The law doesn't say that, but Terrill, who is an attorney, said it's insinuated in a portion of the law that states you have to transport "in furtherance of the illegal presence of the alien in the United States."

It is based on federal law already in place.

So is the portion that makes it illegal to shelter, harbor or conceal someone "knowing or in reckless disregard of the fact that the alien has come to, entered or remained in the United States in violation of law."

The law also allows exceptions for transporting and harboring illegal immigrants for certain reasons, such as immunizations, emergency disaster relief and services necessary to protect one's life or safety.

Anyone who violates the law can be imprisoned for a year, be fined $1,000 or both.

Would a landlord who rents to an illegal immigrant be arrested for harboring? Could be, Terrill said.

A local priest asked whether he will be arrested for allowing people he knows are illegal immigrants to attend his church. Is that harboring an illegal immigrant?

Probably not, Terrill said.

Such things haven't occurred under the federal law, and they shouldn't occur under the new state law that mirrors it, he said.

"The fear is irrational. The statute relies on case law, and if people are concerned about that, they would have irrational fear about every law out there," he said.

"It is absolutely unrealistic to think the Legislature is going to craft a statute and take every possible situation into consideration, no matter how bizarre it is."

Terrill said these concerns are being raised by people who don't agree with the law, also known as House Bill 1804.

Anxiety among the community remains.

"It feels scary," Vaughan said. "I'm going to go about my business, but I'm not going to be relaxed about it."

Vaughan said he wouldn't stop driving Hispanic people to church, even if that means getting arrested. He'll just do it with more trepidation.

The Rev. David Medina is the director of Catholic Hispanic Ministries in the Diocese of Tulsa, which provides services to the Hispanic community such as taking people to church and to doctor appointments.

"The law is bringing a lot of fear, and people are very confused right now," Medina said. "They don't value anything in this proposal. (It's) trying to keep us from doing God's work and showing God's love to everybody."

Medina said the law wouldn't change anything he does.

"I'm not concerned," he said. "I am called by God to do his will. I need to be ready to help anybody, regardless of the consequences, because what I care about is the soul."

Terrill said the motivation behind these two parts of the law -- it also tries to prevent illegal immigrants from employment and public assistance -- wasn't to hinder good will but to address problems that he believes are hurting the state and nation.

The law against transporting illegal immigrants was meant to prevent anyone from taking them to job sites, he said. The portion about harboring and sheltering intends to target anyone who keeps an illegal immigrant from detection.

Vaughan supports immigration reform, he said, driving with a Hispanic family in the back seats. He wasn't sure whether all of them were in this country legally. He doesn't care.

"There are some 12 million people here illegally," he said. "If you think we're going to ship them out, that's impossible."

ABOUT HOUSE BILL 1804

Here are portions of House Bill 1804, which Gov. Brad Henry signed into law last week. Most of it will take effect in November.

  • It shall be unlawful for any person to transport, move, or attempt to transport in the State of Oklahoma any alien knowing or in reckless disregard of the fact that the alien has come to, entered, or remained in the United States in violation of law, in furtherance of the illegal presence of the alien in the United States.

  • It shall be unlawful for any person to conceal, harbor, or shelter from detection any alien in any place within the State of Oklahoma, including any building or means of transportation, knowing or in reckless disregard of the fact that the alien has come to, entered, or remained in the United States in violation of law.

  • Nothing in this section shall be construed so as to prohibit or restrict the provision of any state or local public benefit described in 8 U.S.C., Section 1621(b) (outlined below), or regulated public health services provided by a private charity using private funds.

Those exceptions summarized:

  • Assistance for health-care items and services that are necessary for the treatment of an emergency medical condition.

  • Short-term, noncash, in-kind emergency disaster relief.

  • Public health assistance for (most) immunizations.

  • Programs, services, or assistance such as soup kitchens, crisis counseling and intervention, and short-term shelter specified by the United States attorney general.

  • In-kind services at the community level, including through public or private nonprofit agencies.

  • Services necessary for the protection of life or safety.

If they are illegals it doesa not matter why they are here, they should be treated like anyone else who breaks the law, PERIOD. I am sick and tied of them always being treated special. Some of the worst employers are the ones who want them here.

The problem ultimiately is that too many are treating these people as citizens.

Citzen..

Its that simple...non-citizens (excluding emergency help) should not be given the same benefits as citizens.

Yet, in many cases illegals and even legal hispanics are getting free services (or heavily discounted) at YWCA and other locations all over the Tulsa area.

Fact is we citizens are paying way to much in taxes and it includes taxes that help subsidize illegal aliens.

I just love that the illegals are soooo needy and given assistance when they should be rounded up like canines and caged till they can be dumped back on their own side of the border. What is so special about an illegal that they receive any of our taxes? Not one penny should be given in assistance (not even emergency help) to ANY illegal and yes if you help them, hopefully the law will show you the error of your ways.

The law is the law. Black and white, no gray areas. Deny them work. Deny them housing. Show them the direction of Southwest, and say Vaya con Dios, mi amigo. Come back when you are legally able to return and not before.

I don't understand what OUR citizens don't comprehend about the laws. If one breaks the law, prepare to suffer the consequences. Plain and simple.

We must be careful with the hate that drives our thoughts and words. "Illegals" seem to be the new race, and apparently it is all right to speak with hate about them because they are not actually a race. The undocumented are human beings, with families, dreams, and a desire to be happy just like everybody else.

The amount of hate coming out in the discussion of this topic is sad. We spend billions to aid giant corporations, or to build new weapons systems designed only to kill, but if $1 of our tax money actually goes to provide someone with food or other necessities we get so angry - at people who only want to work hard and provide for their families. I only hope that I would be so brave as to take the rists that these folks have to provide a better life for my family. I hope we can get back to the words etched onto the Statue of Liberty, ""Give me your tired, your poor, Your huddled masses yearning to breathe free, The wretched refuse of your teeming shore. Send these, the homeless, tempest-tossed to me.

I lift my lamp beside the golden door."

I just want to say that when we "round them up" and "drop them off on their side", just be patient when your new houses arent built and your trash is not picked up and the ditches on the side of the road for your plumbing and sewage are not dug. Just be patient and dont be mad at the contractors. They are following the law when they dont hire those people to do the jobs that not alot of "legal citizens" would ever dirty their hands to do.

My paternal grandparents were Portuguese and my Maternal grandparents were German Dutch and the ALL had the stones to come into this nation through the FRONT DOOR with NO EXCUSES for breaking ANY LAW. When their feet touched the soil of this nation, they didn't start to ask for handouts, they asked "Where do you go to get a hand UP", then they put their brains and their backs to the task of making their own way. What really makes me proud of the way my ancestors immigrated to this nation? They did it in the daylight and standing straight up, proud to forgive their home countries and SWEAR AN OATH to become an AMERICAN, and to DEFEND THE UNITED STATES CONSTITUTION AND ALL WITHIN.... and they SAID IT IN ENGLISH! Now then, can ANY ILLEGAL stand straight and tall, in the daylight, at THE FRONT DOOR OF THIS NATION and DO THAT? If so, then I will fight to defend them being here. If not? May hell rest on their backside because I will keep returning to the border to prevent ANY invasion of MY COUNTRY! I took an oath too and there was NOTHING in that oath that said, "Well, maybe, if I feel like it, What If? or anything else half-a***. It was straight and precise.

So they've passed an immigration bill making it expressly illegal to be here illegally. Let's see if they will put their money on it by providing for enforcement, which is gonna take more money, of course. Or maybe it's just political sh__, to appease those attending said cake & punch meeting. Either way, enforce the laws, or don't make'em. I have to agree that the guy driving the church van is raising a tempest over nothing. Let's wait til HIS job is taken by one of his van riders, and see if he still wants to raise a stink about the law.

Corruption, poverty, attrociously low productivity. The water is even contaminated in most places by human waste such that E. coli waterborne illness will infect Americans who consume it.

We now have 12 million illegals and another 20 million "legal" immigrants from this region, with millions more coming. If you don't like what you see in Mexico, you better put a stop to wholesale unfettered imporation of Mexico into the US, or our culture will continue its rapid change in the direction of our neighbor to the south.

All you hate mongers need to look deep inside your DNA and find out where you are from. For decades the REAL AMERICANS have prayed for equality in our own country. The Articles of the United States Constitution were based on in fact, on the already established governments of the the native Americans in this hemisphere. I'm so tired of the belly achin. Maybe it’s a genetic thing. The Native Americans assisted and harbored the pilgrims, without assistance from the local Indians, they would have surely died. If they had, then the belly achers would not be able to have a voice.

Lets not step back into the depths of racism. Stealing ones humanity in the name of citizenship seems to be a very low blow.

I agree that there are immigration problems, but problems in themselves cannot be settled by hate and fear. Demoralizing and targeting the Hispanic race is not the answer, there are many other races involved in this issue, in Tulsa, and in the United States. None of which deserve to be hated for their skin color or beliefs or because they come from a poor country and want to make a better life for themselves and their AMERICAN and MEXICAN born children.

If the "haters" want to send them all back to Mexico, then who thinks or cares about the AMERICAN born children being forced into a life of poverty in Mexico. Maybe the illegal "haters" would like to send the poor AMERICAN children in impoverished Mexico some kind of charity. Most likely not, most likely not because they can't see past their own fear and prejudice.

Wake up illegal "haters" and focus on solutions without harm to the innocent.

This issue is not about "haters" at all. It's about if people who want to immigrate to this country and be a part in it, then become citizens!! If they want to share in the rights afforded by our country to it's citizen, they also need to share in the duty as a citizen. That is not too much to ask at all. Especially if they are concerned their children and where they are raised!!

As a Southern Baptist Christian we certainly need to be compassionate to all people, but we should assist anyone that wants to become a citizen in gaining their citizenship. Our efforts should be assisting with becoming legal not helping them break the law as illegal immigrants. God has established the law in America for us to abide by not ignore it.

Demanding that our laws be enforced is not racist. For us to have a civil society, we must know who is here and we must all abide by the same laws. Many problems related to illegal immigrants have nothing to do with race: drugs, gangs, car insurance, economical cost (hospital closings, etc...)

I agree wholeheartedly that anyone who offers to help spread the word of God should be able to do so. These great people are wanting to be assured that they will not be considered as "breaking the law" should they do so. So far all I have read in this article is a "probably not". That is not good enough. I agree there is a problem. We do need to close the borders, but America needs to accept that we are not going to "ship" any illegals back. America does not have the money, nor do any politicians have the clout. Anyone suggesting this really needs to pay attention, it is NOT going to happen. Move on and suggest a solution that is plausible.

NATIVE AMERICANS...been here 2.5 years and have yet to see an Native American. What i see alot of is guys named Jim Johnson driving white Cadillacs and calling themselves Indian so they can get there $12 car tag. How does running a tax payor entitlements bring restitution to Native Americans, I live in 2007 not 1880's. I have Cherokee blood in me but REFUSE to be part of a entitlement system. Further, the metal shed casinos really make me appreciate the Native American heritage, synonomous with Indian history. Further, now there are discoveries that suggest Indians were not the first to inhabit North America, do Native Americans owe them an entitlement?

illegals and church...i would help them but warn them to get legal. I can't imagine Christ encourage his followers to break the law. We are to give them cup of water, but tell them not to violate the law. My message to Christian Illegals: "Christ would want you to obey the laws of the land" which would be consistant with his character. The Church would do well to find ways that help encourage legal citizenship. Sorry , should be no exceptions just because they are Christions...in fact, "Christian Illegal" doesn't really go together.....

well mike i feel sorry for you! should you really be living in a state that you know nothing about it's history? and don't be hateful because our people get what they deserve after every thing that has been done to them. anyways point and case made this is not a racial thing u say! i think you have just made your point.....but after all that is the beauty of america every one has the right to make their own opinion.....just don't try make it every one else's

They are just hardworking people who want a better life. Sure they are - they want yours and would move into your house if they could. No money for taking care of the poor muchachos but the casinos are full of them. The neighborhoods become slums - oops - barrios and the only place you will find a larger group than the DHS office is the local jail. I don't hate them - I just want them to go home to Mexico, willingly or not.
