Council approves immigration-status checks

The City Council voted 6-3 Thursday night for a resolution to have police conduct immigration-status checks during arrests.
Council discussions lasted late into the night after 32 speakers for and against the immigration checks.
The resolution originally applied only to felony arrests, but after lobbying from U.S. Rep. John Sullivan's office, it was amended to include misdemeanor arrests.
In other action, the council moved the effective date for annexation of the fairgrounds to Jan. 1, 2009.
Councilors John Eagleton, Dennis Troyer, Cason Carter, Rick Westcott, Bill Martinson and Bill Christiansen voted in favor of the resolution, and Councilors Roscoe Turner, Jack Henderson and Maria Barnes opposed it.
Eagleton said he doesn't understand how anyone could be against a resolution that is about enforcing laws that are already on the books.
"We're not even targeting all illegal immigrants -- just the ones who are breaking other laws," he said.
Mayor Kathy Taylor had supported a resolution with a felony stipulation but not the misdemeanor aspect. She called the original resolution a transition point for the city to begin complying with House Bill 1804. The state immigration reform bill was signed by Gov. Brad Henry two weeks ago and goes into effect Nov. 1.
The council's resolution also says police must notify the proper federal agency within 24 hours if an arrestee is found to be
an illegal immigrant.
Taylor added a provision that people who think they have been wrongly jailed because of an immigration- status check can file a complaint with the city's Human Rights Department.
Former Police Chief Drew Diamond called the resolution "redundant and unnecessary." He said the Sheriff's Office already checks the immigration status of people booked into the Tulsa Jail.
"From a policing standpoint, the last thing you want to do is to create fear and division," he said. "This will do nothing for public safety in the city."
Diamond also called HB 1804 "a flawed piece of legislation" that he believes will be found to be unconstitutional. He urged councilors to hold off on the resolution to see whether the state law withstands legal challenges.
The Rev. Victor Orta of the American Dream Coalition said he supports enforcing the country's borders but that the council shouldn't punish illegal immigrants who are already here.
"There is a fear in Tulsa right now that I have never felt before," he said. "There are more hate crimes. We need to stop and think about the consequences of this."
Area resident Roger Scott expressed his support for HB 1804 and a council resolution.
"We're doing in the state of Oklahoma and the city of Tulsa what the federal government doesn't have the guts to do," he said.
Wendell Neal of the Tulsa Minutemen organization said the resolution doesn't go far enough.
"I don't think we should have to wait for someone to be arrested before we check their immigration status," he said. "I support this resolution, but it's just a start."
Christiansen said a strong city policy is needed to show the federal government that a local Immigration and Customs Enforcement office is needed.
"I never want Tulsa to be known as a sanctuary city," he said.
Tulsan Larry Wilson remarked that "this country is under siege by illegal aliens."
Turning to Hispanics in the audience, he asked how many of them are in the country illegally. All raised their hands in a show of solidarity.
Annexation delay:
The council unanimously agreed to amend the effective date of the annexation of the county fairgrounds from this July to January 2009.
Councilors in April narrowly approved annexing the fairgrounds to enable the city to collect a 3 percent sales tax there. County leaders opposed the annexation, saying it would drive away business. The city and county later reached a compromise to delay the annexation.

what a suprise that turner and henderson would be against it. it might help cut some crime in their districts. looks like they don't want to cut crime in their area since they seem to have plenty of it and don't do anything about it.

Candy, I agree and sympathize with you. My good friend was hit by an Illegal alien Mexican in the same manner. He had no drivers liecense, no insurance, and green card, and spoke no english. The officer at the scene determined the accident was the illegals fault, but nine the less put him back into his vehicle and told him to drive away. No ticket, no vehicle impound, no deportation, and financial accountability.
The illegal committed three breeches of our law, and he was instructed to leave the scene without penalty. The officer told my friend there was nothing he could, or would do, and that if my friend wanted justice, he should club the Mexican in the head while the officer wasn't looking. AMAZING......This is becoming a common occurance. We, the citizens pay for the illegals........period. Someone (police) are not doing the job they are paid to do....!!!

Three factual points of interest with regard to Illegal Mexican Alien problem: 1) Once, and as long as, an alien marries as a US Citizen they are here, period (that's fair enough). 2) Once an Illegal Alien, husband,or wife, has a child in this country they cannot be deported, 3) Our laws prevent our Hospitals from refusing service to an illegal alien, whether he can pay his bills, or not. That is the reason a trip to the emergency room now averages eight hours waiting before service (unless you are having a heart attack). It stink, and our own laws (intended for good) are choking the life out of this country. We need change, and soon.

First they are not aliens, but undocumented, aliens come from mars not from foreign countries. Not all people working in construction are undocumented. The emergency rooms are full because doctors refuse to see you in case of emergency even during regular hours. I took my husband to his doctor during regular hours and he said he did not have time, so instead of me paying regular office visit, had to pay $600 for emergency room, because he refused to make room for him. If you call a doctors office they always send you to the emergency room. If you do not know the steps required for someone to come to this country legally don't say, they just have to come here the legal way, it is a matter of survival. It takes too long.

Undocumented people contribute to the community more than they take. They are willing to be here and pay for the social security you and I will collect. I am for the law to be upheld, but this people are already here and if they are working and living right they should be given the oportunity to become citizens. The reason they do not have insurance is because they can't get it, if a temporary license was given, then they could get insurance. There is a lot of asumptions and very little facts given about undocumented individuals in Oklahoma and Tulsa. We want to deny the benefits they bring and only emphasize the negative. Councilmen Troyer keeps saying he goes to the community and their events but gets no help. Maybe is because instead of offering help and friendship he comes for information and request ministers and other leaders to turn people in. There is a reason he is not trusted. The black councilmen voted no, because they have lived discrimination by TPD and the Race Riot, that was hidden for so many years and erased from history. Tulsa and Oklahoma only see black or white, they are just now learning to see other colors.

What a wonderful piece of much needed legislation.Illegal aliens will get the message LOUD and CLEAR--they are NOT wanted in Tulsa.These invaders who bring drugs, diseases, and crime to our community now know they are detested aliens who must be expelled from our midst.Most illegals are illiterate,backward peasants from a failed third world country{Mexico.}If these people have any pride they will get out of Tulsa.

Not all Mexicans are the same. I know some Mexicans that work very hard. Yes it is true that some Mexicans do bad stuff. Those Mexicans that work very hard should be able to become citizens. Though the police are just asking for their immigration-status checks when they arrest people. So they are just taking the Mexicans that aren't following the rules. I still think that the Mexicans that pay their taxes and work very hard should be able to become legal people.?Lots of love?

All illegal aliens have done bad stuff. They sneak into our country obviously knowing it is breaking our laws. This is Disrespectful to this country and its laws. Why do we want lawbreakers in our country. We dont. If you want to live here have some respect and do it legally. I dont care if illegal people work hard and pay taxes or not. Prisoners work hard. And that is where we need to send them if they want to work hard. People in Mexico need to realize there are RULES and ORDER in the world and this COUNTRY. If they cant abide by the rules why do we want them. We have enough american people who cant do that we dont need or want you. Its like an infestation of unwanted pests that cant speak.
They dont even have enough respect to speak our language, maybe its too hard for them. But tough. It is a requirement too.

There are some mexicans that are goo some bad why punish the ones that are good you need to give them a chance they are really trying my husband works really hard to send money home to his mother and son in mexico. I go to mexico to visit with my family there and it is really bad over there kids ont the street selling stuff instead of being in school. everyone deserves a chance do not punish the good ones. If it was not fdor my husband i would not have what i do. Yes it is all about racism for most not about illegals taking jobs away from the white people my children are white their father is the sorriest man in the world my husband takes care of my kids and none of them belong to him. so i care deeply about immigration status and rights. If you want to take those out who rob murder or sell drugs to people fine but why punish those who get a ticket for speeding or something stupid.
