State law restricting birth certificates for gay adopting parents is unconstitutional, appeals court says

DENVER -- The 10th U.S. Circuit Court of Appeals has ruled that a state law preventing gay couples from getting birth certificates for children adopted in other states is unconstitutional.

The appeals court upheld a previous ruling by U.S. District Judge Robin Cauthorn.

''We hold that final adoption orders by a state court of competent jurisdiction are judgments that must be given full faith and credit under the Constitution by every other state in the nation,'' the court says in its Friday ruling.

''Because the Oklahoma statute at issue categorically rejects a class of out-of-state adoption decrees, it violates the Full Faith and Credit Clause'' of the U.S.Constitution.

As a result, the court upheld an order from Cauthorn that a child, who born in Oklahoma and adopted in another state by a same-sex couple, receive an Oklahoma birth certificate listing the adoptive parents. The child's name is not included in the court's papers.

Figures that the inbred of Oklahoma would try a stupid stunt like this. Has anyone in that state an IQ of 3 or over?

Tyler - What is ignorant is to assume that the entire population of any state is completely alike in any way whatsoever, including religious beliefs, political affiliation, education or IQ. Now that's the epitome of ignorance.

Have you even been to the state of Oklahoma? I live here, and I am a die-hard liberal with a Masters degree.

Stop advertising your own ignorance. It's embarassing to whatever state you live in, which you've conveniently omitted.
