Tulsan acquitted in brother's shooting death

A Tulsa man was acquitted Friday night in the shooting death of his younger brother.

Defense attorney Allen Smallwood successfully argued that Benjamin Smith, 27, acted in self-defense when he shot Samsun Smith, 22, in the chest during an altercation in March 2006.

Smallwood called the outcome a "major victory" for the Smith family, who endured seven hours of deliberation before learning the verdict.

In his closing arguments, Smallwood pleaded with jurors to think about the effect the case would have on society. ''You are going to tell Tulsa County whether a person has the right to defend themselves like Benjamin Smith did,'' Smallwood said.

The altercation, which took place at a family residence in west Tulsa, escalated when Benjamin Smith aimed a rifle at Samsun Smith, testimony indicated.

Immediately before he was shot, Samsun Smith threw a pillow at his brother and took a step backward.

Assistant District Attorney Mike Abel, representing the state, said this showed Benjamin Smith was not acting in "reasonable" fear but rather wanted to control his brother.

"Is it reasonable that I take a step back and you kill me?" Abel said. "Samsun's last act on earth was to throw pillows in the face of Benjamin's authority."

After shooting his brother, Benjamin Smith called 911 and waited for police to arrive, which he wouldn't have done if he were guilty of murder, Smallwood said.

Throughout the week, jurors repeatedly heard testimony from Samsun Smith's family members and friends, who told of his problems with drug and alcohol addiction.

Smallwood told the jury that Benjamin Smith wanted to help his brother during this time, despite Samsun Smith's "irrational, almost psychotic behavior."

Benjamin Smith was originally charged with first-degree murder, but jurors were also given the option of convicting him of first-degree manslaughter.

there has got to be more to this story than reported.

The man points a gun at his brother. His brother steps back and throws a PILLOW and gets shot in the chest. And a TULSA JURY finds that to be self defense.WTF WTF WTF WTF WTF WTF WTF

There is much more to this story which is exactly why he was found innocent. Blogging about things you know nothing about is so ignorant.

There are jurors who believe that he was guilty but the system dictated a verdict of not guilty. I was a juror on this case and I do know first hand!

I've known Ben Smith personally for years. He is not only a friend... he worked for me for years. He would never have intentionally killed his brother. I would trust him with my life. Indeed, I did trust him with my children and my business for many years, and would again. He is brilliant, smart and kind. I can't imagine what this tragedy has done to his life, but I thank God that this part of it is over for him and his family now. Ben's little brother had a history of severe drug problems. Obviously I wasn't there that night and #4(ALD) is right... I probably shouldn't blog about things I don't know about,.... but I do know Ben... and #5(Robert),... trust me.. if the system dictated the verdict of not guilty, then the system actually worked this time.

This is Bull Crap. Samsun throws a pillow and his own brother shots him for it??? WTF! Why not fight him or just simply LEAVE. Ben should have been charged, at the least manslughter. He sure did help his brother with his drug problem. He ended his life and will most likely rot in HELL for it. enough said.
