Controversy hurts tribe, chief says

Cherokee Chief Chad Smith says an ongoing citizenship feud has damaged the tribe's image.

WASHINGTON -- Cherokee Nation Principal Chief Chad Smith concedes the ongoing battle over whether descendants of former slaves should be citizens of the tribe has damaged its public image, regardless of how the controversy ends.

"I think, historically, nationally we had sort of a Pocahontas kind of image in the public," Smith said.

"Everybody had a great-grandmother who was a Cherokee princess."

Today the tribe is responding to critics' charges that it is not only violating a 140-year- old treaty but doing so based on race, always an emotional issue in this country.

Smith agrees the issue is an emotional one for blacks but adds it is emotional for Cherokees as well.

"There are lots of things we lost," he said, citing his tribe's history of losing its lands, minerals and even art.

"We actually lost children to adoption. . . . So, the last thing that we have is the right, the unmolested right, to determine who our citizens, our members, are."

Still, Smith admits the tribe is facing a stiff challenge in having its side of the debate not only heard but understood in both historical and political terms.

He points to four decades of education that gave the general public an understanding of civil rights and a desire not to be driven by racism.

"Everyone agrees," Smith said, citing one of the factors that makes the tribe's task more difficult.

"The last 40 years, I haven't had that same education about what a tribe is, what sovereignty is."

The leader of one of the largest tribes in the nation made his comments sitting inside its Washington, D.C., office just blocks from the nation's Capitol where he had spent the last few days talking to key members of Congress and their staffs.

Smith's visit came just weeks after the U.S. House of Representatives took a stand on the issue with a voice vote on an amendment by Rep. Mel Watt, D-N.C., to deny housing benefits to Cherokees until the tribe recognizes the descendants of the so-called freedmen as citizens.

Rep. Dan Boren, D-Okla., succeeded in altering that language to delay such action until courts can resolve cases pending in both tribal and federal courts.

That bill awaits action in the Senate.

Smith believes the best argument he can make to stall additional congressional action is the one made by Boren.

"I think people appreciated the due process we have built into our system," he said of the tribal court system that has kept the issue alive more than once for the freedmen descendants and ordered that their citizenship, at least for now, be restored.

Smith cites the congressional custom of deferring to the courts during litigation and says the federal case is being heard in Washington, D.C., which also gives lawmakers more confidence.

He warns of the human suffering that could result from what he called a "scorched earth policy" to cut off funding for Cherokee programs.

In his visits to the Capitol, however, the chief said he stresses that the issue to Cherokees is not about race but about ancestry.

Smith hands out a compilation of photographs showing the different backgrounds represented by Cherokee citizens, a showcase of how inclusive the tribe historically has been.

Smiling back in those photographs are faces of a Cherokee-Mexican, a Cherokee-black, a Cherokee-German, a Cherokee-Vietnamese, a Cherokee-Ecuadorian and a Cherokee-Irish.

"You know the mainstream, the majority population looks at the world as being either white or black. It is a race spectrum," Smith said.

"But Indian communities don't look at it in that term. They look at it in terms of ancestry . . . It is the commonality of having a Cherokee ancestor."

And, that is what the descendants of the slaves once owned by, Smith believes, about 2 percent of the Cherokees before emancipation, cannot show.

They cannot prove they are Cherokee by blood, which earlier this year the tribe voted was necessary to be a member.

As for the 1866 treaty that the tribe's critics say guarantees citizenship not only to the former slaves but to all of their descendants, Smith says they are wrong.

"The treaty did not grant citizenship," he insists.

If the interpretation of the treaty that it did for the former slaves and all of their descendants holds up, it is estimated that between 25,000 and 40,000 could qualify for citizenship.

Smith was guarded when asked how his visit went.

"Everyone was an astute politician and did not commit to anything," he said.

In addition to Smith's visit, the Cherokee Nation has stepped up its formal lobbying effort to deal with the congressional fallout over the freedmen issue by hiring the Podesta Group, one of Washington's leading firms.

Chad two wife Smith & Brad Carson need to leave the Cherokee Nation.

It is time they go home and out of Tahlequah.

We see now Chad has put his man in as Judge , Troy has never even tried A case in front of the Cherokee Court.

Time to let those who really help the Proud Cherokee do the job. The real Cherokees the UKB.

Chief George G. Wickliffe From observing the materials handed out in mass quantities at the recent Cherokee National Holiday, Cherokee Nation of Oklahoma has really boosted the quality of its public relations materials. Not only are they very high quality and obviously expensive, the cover of their recent propaganda, titled, "If Cherokee funding is cut, who will feel the pain?" features a Keetoowah Cherokee child on the front cover - an exclusive member of the United Keetoowah Band of Cherokee Indians in Oklahoma.

Once again, Cherokee Nation of Oklahoma spin doctors do a very good job of telling only half-truths in this highly polished booklet. The opening page states, "Cherokee Nation believes that its citizenship should include only those with Indian ancestors." It further states that some freedmen descendants are suing the Cherokee Nation in federal court over their lack of citizenship. What it DOESN'T state, is that it doesn't matter what Cherokee Nation believes, but what is the law? Treaty agreements and past lawsuits clearly state that descendants of Cherokee Freedmen ARE citizens of the Cherokee Nation, and that this provision can only be changed by Congress, NOT Cherokee Nation. These people are not suing over a LACK of citizenship, but for having their rights as EXISTING citizens infringed upon, and then disenfranchised of this citizenship.

This biased publication makes the Cherokee people of northeastern Oklahoma look, as the booklet comes right out and states, "the poorest of the poor." This should immediately make Congress and the American people wonder just what CNO is doing with the 300 million a year they have been receiving from the Federal government, if the people are this bad off.

I personally take this visual display of deceit as an insult. Statements such as, "We're raising a five-year old next to raw sewage," and "Keeping food from the needy" clearly paint a picture of an impoverished people who depend solely on the Federal government for survival. While there are people of every race who need assistance once in awhile, the Cherokee people are clearly not a race of people dependent on the tax-payers for their livelihood. For the most part, they are a hard-working, honest and intelligent group of people who proudly serve their communities and families.

The booklet also asks, "How can Congress leave 126,000 people without health services?" This number is the population of CNO tribal members in the 14-county area, many of you who are reading this letter right now, and who know that this simply is not true. Many Cherokees hold jobs which provide insurance, and a salary adequate enough to pay their co-pays. The booklet states, "We feed 700 seniors every week. How could Congress think of taking away their only means of survival," which should make Congress wonder, are these people not receiving pensions, dividends, or at the least, Social Security? The United Keetoowah Band and other agencies in the area offer meals for seniors under the same Federal funding Cherokee Nation does, and these Elders are welcome to come dine with us anytime. Many do.

One must remember that all the services which are funded by federal dollars will still be available should H.R. 2824 become a Public Law. The BIA will continue to administer many of these programs, and other agencies which provide all the same services will be funded to service a larger population. All Cherokees of 1/4 Cherokee blood or more are eligible for membership in the United Keetoowah Band of Cherokee Indians, a federally-recognized, OIWA organized tribe. Should they choose to remain associated with a tribe, they will be able to do so. All others who may need occasional assistance will be able to find it in other area service agencies. In addition, the legislation does not propose to permanently sever this fiducial relationship, only until Congress is assured that CNO is in com

Great to see that the UKB chief would rather have services cut off to his own people, as long as it means the Cherokee Nation gets hurt somehow. What an idiot. No wonder he lost so many election in Cherokee Nation before running off to another tribe.

Anyway, it's good to see the Chief fighting so hard in Washington to defend the vote of the Cherokees and our Constitution. If you are Cherokee, you have to like that the Chief if defending the Constitution, even if you don't like what it says. Remember, about 10 years ago we had a chief who decided what parts of the Constitution he liked and what parts he didn't and acted accordingly, firing judges, etc. At least he is gone.

Did you read the part of the Constitution where it says A Chief can only serve two terms?

If Chad knew which bed to sleep in he would not have two set's of children the same age would he?

He will go down in History as the Raciest Chief of the CNO Inc.

The UKB will not get anything cut off, but Chad did screw the Delaware Nation not long ago didn't he? Looks like the Thief of the CNO Inc. need to read the Constitution below maybe this is why he put A Stooge on his Court?

Section 1. The executive power shall be vested in a Principal

Chief, who shall be styled “The Principal Chief of the Cherokee

Nation”. The Principal Chief shall hold office for a term of four (4)

years. No person having been elected to the office of Principal Chief

in two (2) consecutive elections shall be eligible to file for the office of

Principal Chief in the election next following his or her second term of

office. )

Non Cherokee Blood Blacks are wrong about the Cherokee Nation and it's true history!! The Cherokee Nation government never did own Black slaves, this is a fact!! The Cherokee Nation did not and never did have human slave laws as did the Federal government and state governments!!

No Black person was on the Trail of Tears as a slave to Indian people, fact!! Slavery was still U.S. law during the Trail Of Tears, the federal government would not allow Indians to take run away Black slaves West with them, Fact!! Run away Black slave living on Indian land were returned to their White owners during the forced removal of Indians from their home lands, those that had Indian blood heritage were allowed to leave with Indians.

AP News needs to stop stating the Cherokee Nation government had Black slaves. Indians allowed run away Black slaves to live on their land, they were offered rewards to return the run away Black slaves, this did not happen, fact!! Mixed White's with Indian blood heritage did take slaves, this amounted to less than 2% of all Indians living at that time in history in Southern states!

The non Cherokee Blood so called Freedmen are causing their own problem going around calling Cherokees raciest!!! It's not true and they know it!! Anyone wanting to be a citizen of the Cherokee Nation know's they have to have documents to prove their Cherokee heritage to a family member listed on the nations roll books!!! Now mater what race you clame!!

Cherokee Nation Citizenship Not For Sale

Chief George G. Wickliffe of the United Keetoowah Band of Cherokee Indians is on record as stating "Cherokee Nation tells half-truths"

It seems Chief George G. Wickliffe is drooling at the mouth awaiting the fall of the Oklahoma Cherokee Nation over it's citizenship vote issue with open arms welcoming Cherokees to join his tribal Band of Cherokees'.

Chief George G. Wickliffe report did not cover information as to Freedmen descendants membership to the United Keetoowah Band of Cherokee. It did cover the fact that all Cherokees of 1/4th Cherokee blood quantum or more are eligible for membership in the United Keetoowah Band of Cherokee Indians. The Cherokee Nation's requirement is that a person must prove their Cherokee heritage to one family member listed on their roll books.

United Keetoowah membership laws and rules would block the vast majority of freedmen descendants with Cherokee heritage of less than 1/4th blood quantum from joining their tribal band. The United Keetoowah Band of Cherokee Indians further state,

"Once a member of the United Keetoowah Band of Cherokee Indians in Oklahoma relinquishes his or her membership with the Band, as an adult, he/she shall not be eligible for reinstatement as a member of the UKB." Section 18 Reinstatement of Membership:

Chief George G. Wickliffe report basically said, if the Cherokee Nation lost it's federal recognition and funding, his tribal group stands ready to save the Cherokees' with 1/4th blood quantum or higher. Chief Wickliffe futher states "One must remember that all the services which are funded by federal dollars will still be available should H.R. 2824 become a Public Law. The BIA will continue to administer many of these programs, and other agencies which provide all the same services will be funded to service a larger population."

President Bush is on record wanting to cut all federal funding of around 36 Indian health clinics around the country, one would have to be living in the land of OZ to believe the federal government would rush federal funds to the aid of Indians.

Congresswoman Watson's bill H.R. 2824 covers all Indian nations that require Indian blood quantum. To the point, Watson's bill gives all rights to tribal nation citizenship control to the federal government, say good by to "More" Indian Nation government sovereignty.

It has to be noted that Chief Wickliffe is not willing to drop his tribal bands blood quantum of 1/4th and stating all so called Freedmen descendants are welcome to his United Keetoowah Band of Cherokee Indians with full citizenship. It's the pot calling the kettal black, old saying.

A March 2007 Cherokee Nation citizenship vote brought about around 2,700 Freedmen descendants being dropped from it's rank of citizens. The Freedmen descendants failed to produce documented proof of their Cherokee Heritage to a family member listed on the nations roll books.

I am wondering what constitution Chief Smith is defending because he is serving his 3rd term as Chief when the constitution has a two term limit. Talk about picking and chosing what he wants to follow on the Constitution.

What constitution are we following exactly?

He is giving the Cherokee Nation a bad name and it makes me mad.

Of course the tribe's image has been damaged. Chief Chad Smith has a mistress who also had children by him, he's in his third illegal term, he's racist and keeps trying to kick the freedmen out of the tribe, he wants to control the Delaware Tribe's federal funds under the guise of giving them their federal recognition back, WHICH HE TOOK AWAY THROUGH A LAWSUIT, BY THE WAY!

I hope the feds step in, audit Theif Two wife Smith, and dismantle his BOGUS Cherokee Nation of Oklahoma tribal government that's only existed since 1975/76. It's not the real Cherokee Nation!

Back on subject - Mike Graham FYI - Full blood Cherokees did own slaves. Your information is in accurate.

Chad says the Freedmen issue should be solved in Tribal Courts instead of Congress I have to wonder wasn't this already decided in our courts last year? The Cherokee Nation Supreme court at that time said the Freedmen were entitled to citizenship. He did not listen then, but now he has his own Troy Poteet on the Supreme Court so maybe he is right the ruling would change.

Mike Graham you make statements without consulting fact, and that's propagandism !Find a freedmen that was 80 or so years old in 1896 when the rolls were taken, and look under the column that says Slave Owner Name. There is also an application that typically states that these slaves had been owned by the same families from annexation to amancipation! The fact is that at least 2000 slaves on the trail of tears accounted for by their Cherokee masters. The fact stands today as it did then, there were more mixed blood white cherokees than full blood cherokees in indian territory. And you can't make the statement that Cherokee aren't racist b/c I know a few that are! If the case was that Cherokee had no slaves then the eldest freedmen settlers wouldn't have written their owners names on the application to be transferred to the rolls. How about some fact checking before you go making huge statements like the one that you made. The reason that freedmen have no blood quantum to go back to is b/c the dawes commission never included it as part of the roll. If blood quantum was asked of the freedmen it would be there in writing, but it was not as the dawes commission did not deem this appropriate for those who were visibly of African descent!

We in Adair County, the most densely populated Cherokee County per capita in the Cherokee Nation, don't care for your disrespectful language and attitudes. They are NOT Cherokee! Now, if you have a point to make, make it respectfully as our Cherokee elders and ancestors would expect of us. Please don't represent your people in such an immature and dishonorable manner.

Keep spinning tales. You can fool some of the people some of the time...but not all of them!!!

While Chad Smith and his supporters continue to spread lies and misleading statements about the black Cherokees, the world is watching this drama unfold. Stop wasting your breath; Congress doesn't care who sired whom, or how much INDIAN blood you may or may not have. This case is going to be decided on the LAW. The tribal courts ruled in FAVOR of the freedmen so how did they get to Congress? Why did the Cherokees choose not to side with their OWN COURTS but yet today, they are asking congress to let the tribal courts decide first before stripping federal money? Are they going to keep this issue tied up in court until they get a favorable ruling? Is it true that only 9,000 Cherokees voted to remove the freedmen? That's hardly a majority. Is Chad Smith really in office illegally? What constitution are they operating under? You are probably thinking why I am asking so many questions. As an outsider looking in, things look a little fishy.

Had Chad Smith chose to exclude all adopted citizens and not just pick on the freedmen, then things would probably be different. But he chose to only exclude the Freedmen. If it isn't about race as some my have us to believe, then what is it about? Couldn't be about culture. There are literally thousands of citizens who don't practice their own culture. I work with several blonde hair blue eyed citizens. And don't tell me that Cherokees aren't racist. Especially when I've read statements from Smith's supporters to "Protect your Daughter's" If that isn't racist, then what is?

Let me say that not ALL Cherokees are racist. But there are a few bad apples that are trying to spoil the whole bunch. Fortunately, there are a lot of good Cherokee people. Stay strong, change is coming. Just wanted to add that.

If the ancestors were good enough to be worth owning as slaves, then the descendants are good enough to be citizens.

By the way, anyone interested in the facts can read the 1866 treaty on line, including Article 9, where the CN agreed that freed slaves formerly owned by Cherokees "shall have all the rights of native Cherokees." Just Google "Cherokee Treaty 1866" and look on the OSU website.
