Retired security guard charged in alleged River Parks road rage case

Tulsa County District Attorney Tim Harris filed a first-degree manslaughter charge Wednesday against Kenneth Ray Gumm, 67, in the shooting death of Dale Turney, 47.
Gumm, a retired security guard, is accused of killing Turney in a River Parks parking lot on June 10.
The shooting occurred about 4 p.m. on a Sunday afternoon near 19th Street and Riverside Drive. Witnesses said there were many people in that area of the park at that time.
''An alleged road rage confrontation ended in a tragic result,'' said Harris said in a prepared statement. ''Every situation has specific facts and circumstances unique to itself. These individualized facts are applied and analyzed under the law.''
Oklahoma law allows a person to use deadly force in self defense if that person has a reasonable belief such force is necessary to protect himself from imminent danger of death or great bodily harm, Harris said.
''We have reviewed evidence and investigation presented by the Tulsa Police Department,'' Harris said. ''Further investigation was conducted by the DA's Office, which led to the decision to file the charge. The defendant is presumed to be innocent under the law, but we will be prepared to present evidence in court at the appropriate time,'' he said.
First-degree manslaughter carries a minimum sentence of four years to a maximum sentence of life in prison.

Looks like DA Harris has knuckled under to political pressure. I also wonder why the Tulsa World sees the need to emphasize the fact that the man is a retired security guard? Would it be an issue if he was a retired news reporter or teacher? More liberal media bias against the right of self defense.

Absolutely about time! Angry old man with gun getting into road rage incidents by shooting unarmed man in River Parks instead of getting back into his car, where he belonged in the first place, & driving to the police station. Then using excuse he's too old to protect himself without killing the other guy with a gun. Yeah, more liberal media bias? NOT!

Hey - the guy pursued Mr. Gumm into the parking lot and escalated this thing into a shooting. Had he gone on about his life he would still have one. If any thing Mr. Gumm MAY be guilty of road rage of some sort -- if the previously reports to the public are correct.

I'd bet the DA is bowing to pressure from some sources, not sure about which ones, other than the family. Are there facts other than the ones publicized earlier? If not, a jury of his peers will clear Mr Gumm finally and completely, and Mr. Harris will have another failed prosecution to his credit.

Very mysterious doubletalk, Mr Harris. Police reports at the time cited eyewitnesses who stated the victim was the agressor. It will be difficult for your office to cast doubt on these witnesses or to nullify the effect of truthful citizens with no axe to grind.

It must be your goal to pacify the family, who insist that no one has a right to defend himself with deadly force against just being beaten up. The stand your ground Oklahoma law will justify Mr Gumm's doing that, i the end. You, Mr prosecutor, will not hold your office for long, persecuting a man for self defense, even if he is being vilified by the victim's family.

I think the old man wanted to kill the other guy - not end the road rage dispute. He could have shot him in the leg perhaps to subdue him. By killing him, Turney can't tell his side of what happened. The charges sound appropriate to me.

Mr. Harris is a smart man. If he doesn't press charges he is accused of being soft on crime and the liberals will be all over him. While it will cost money to prosecute the case, if Mr. Gumm is found innocent by a jury of his peers then Mr. Harris is off the hook because the people have decided. Smart man.

If Turney had witnesses to say it was the other guy's fault, it's unlikely police would have failed to arrest Gumm. This is a political prosecution, a waste of tax money.

Mr. Harris is not looking out for public safety. He is encouraging people with criminal behavior (drinking and driving, then attempted assault) that they can get by with their actions.

If the story above is correct with all the facts, Mr. Gumm was justifed in protecting himself. Mr. Harris, if you had someone like Mr. Turney, a drunk driver, follow you for seven blocks, park behind you in a parking lot, come at you drunk or druged out, yelling, "Your history", wouldn't you feel justifed in protecting your-self? Would you
want to be charged with First-degree manslaughter?

a shot in the leg won't stop a cranked out drunk. a shot in the kneecap might slow them down.....but how many people can pinpoint a kneecap in the heat of battle? That's only in the movies. If you think your life is in danger it is shoot to kill or be killed.

What a bunch of morons. Mr. Gumm will be judged here or later when he dies. I hope I run into him and he gets out of his car with a gun, I can assist him in meeting his maker and Dale Turney earlier to explain what he did.

Lets see, here is a 67 year old man, Cleet Trained, trained and licensed to carry a concealed weapon, a retired Security Guard. (The man is not physically elderly I saw him on the news). Oh, yea he had a cell phone, and there are dozens of people around him. This helpless man exits his vehicle with a gun, before he even knows what the threat is. He is pushed, points the gun at Dale Turneys heart and pulls the trigger. The man then had no idea whether the gun went off accidently or he was in fear for his life. Wow! This guy needs to be the spokesman for the NRA. We need more people like this on the streets.

lets see, a man pursued him because of something that happened on the street.. he did not pursue the deceased.. my vote goes to the guy with the gun who shot the dumbass who followed him into the parking lot.. was the deceased driving or does he have a friend to thank for pulling into the parking lot.. which would you rather be?
