Charge filed in road-rage homicide

A former security guard who said he feared for his life was not justified in shooting another man, the D.A. says.
Tulsa County District Attorney Tim Harris charged a retired security guard Monday with first-degree manslaughter, saying the suspect had no justifiable reason to shoot a man to death during a road-rage dispute.
Kenneth Ray Gumm, 67, who is CLEET-certified and has a concealed-carry license, told police that he felt threatened by Dale Turney, 47, when he shot Turney in a River Parks parking lot June 10.
An autopsy report shows that Turney's blood-alcohol level was 0.8 -- meaning he was legally too drunk to drive -- and that he had methamphetamine in his system when he died.
Harris said he decided to file the manslaughter charge after an investigation in which he personally interviewed witnesses, looked at photographs and researched toxicology reports.
Oklahoma's "Stand Your Ground" law, which went into effect Nov.1, allows people to use deadly force in certain conditions in which they have "a reasonable fear of imminent peril of death or great bodily harm," according to state statute.
But Harris said that "deadly force wasn't justified in this situation."
For the Stand Your Ground law to apply, the prosecutor said, the person against whom deadly force is used must be entering a residence or vehicle or trying to remove someone forcibly from the dwelling or vehicle.
Harris said Gumm had no reason to believe that he was in imminent danger and that he wasn't being pulled from his vehicle by Turney.
Another section of the Stand Your Ground law indicates, however, that the attack can take place "in any other place where he or she (the shooter) has a right to be."
Harris said he expects that Gumm will surrender to authorities.
Gumm was not in the Tulsa Jail late Wednesday, and telephone calls to his home were not returned.
The events that led to the shooting began when Turney received a call from a friend, Charles Geltz, who asked for a ride home from a Brookside bar because he was too drunk to drive, according to a police affidavit.
Turney picked him up, and as Turney was driving north on Riverside Drive, Gumm pulled out in front of him at 26th Street, according to the affidavit.
Gumm drove north on Riverside before slowing seven blocks later to turn left into a parking lot near 19th Street.
Turney yelled at Gumm, made an obscene gesture and followed him to the parking lot, the affidavit says.
Gumm parked his 1992 Honda, and Turney parked his 1991 Ford Escort behind him, blocking Gumm's car, according to the affidavit.
Turney then walked toward Gumm, who got out of his car holding his .38-caliber Smith and Wesson revolver, the affidavit says.
Gumm described Turney as being in a rage and told police that Turney said, "You're history," according to the document.
Gumm told investigators that he took that statement as a threat against his life, the affidavit says.
Police had said after the shooting that Gumm said he warned Turney that he had a gun and that because of health problems, he couldn't run away or fight him.
Gumm also told investigators that he "backed away from Turney approximately two times around his (Gumm's) car" before Turney pushed his shoulder, according to the affidavit.
Turney was shot once in the chest during the confrontation. He was taken to St. John Medical Center, where he was pronounced dead.
Gumm said he didn't remember whether his gun went off when he was pushed or if he consciously pulled the trigger, the affidavit says.
Gumm has a license to carry a concealed weapon and is certified as an armed security guard by the Council on Law Enforcement Education and Training.
If convicted of the manslaughter charge, he could face four years to life in prison, according to the District Attorney's Office.

The law applies if:
“The person against whom the defensive force was used was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against the will of that person from the dwelling, residence, or occupied vehicle; . . .
“(But) a person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force, if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.”

Please, oh please, please pick me for that jury. Doesn't that come under elder abuse laws that makes it an even bigger crime to pick on a 67 year old?

Stand your ground says, anywhere you have a right to be. The deceased was too drunk to drive which might account for why he was behaving the way he was. The accused couldn't run, but the law doesn't require that he run. Earlier story told us that the deceased was pushed. Something is being left out of this story, or the DA would not be filing charges.

These charges are a travesty against justice. Who does Harris think he is, wasting the court's time and taxpayers' funds to pursue a case of self defense? The facts as stated seem just as they were given last June. With the added information that the attacker was drunk and possibly on drugs.

Maybe the old guy isn't expected to defend himself in court, since he's retired and could be financially strapped. So the DA expects a plea, then a light sentence or probation. Just because someone may not have the money to fight it. Despicable.

If it was wrong for him to shoot the guy, what were his other options. He can't run, he can't fight. Should he have let the guy beat him up? Anybody that sees a gun and keeps walking forward is obviously crazy. I wouldn't take a chance on getting into a physical confrontation under those circumstances.

People who do not drive well, for whatever reason, should be reeducated in driving before having their license restored. Older drivers usually haven't been tested for driving competency in years. Someone used to making bad driving decisions and getting away with them will just continue to drive badly. If the accused did in fact "pull out in front" of another driver, he was misusing a vehicle, which is a deadly weapon. Someone with judgement that bad shouldn't be carrying a gun.

Good point Boo boo, about the blood alcohol, I meant to mention that. I think I can promise that something is being left out. Maybe there are some witnesses after the fact who can quote the defendant as saying something he shouldn't. You can be sure this isn't the whole story.

Well, at least some lawyer will make a bunch of money. Tim Harris is helping someone out by filing a case so an attorney has to be hired and paid well. The case, as reported, was SELF DEFENSE.

Lets see, here is a 67 year old man, Cleet Trained, trained and licensed to carry a concealed weapon, a retired Security Guard. (The man is not physically elderly I saw him on the news). Oh, yea he had a cell phone, and there are dozens of people around him. This helpless man exits his vehicle with a gun, before he even knows what the threat is. He is pushed, points the gun at Dale Turneys heart and pulls the trigger. The man then had no idea whether the gun went off accidently or he was in fear for his life. Wow! This guy needs to be the spokesman for the NRA. We need more people like this on the streets.

If someone like Mr. Turney pulled out in front of me, followed me seven blocks, pulled up behind my car, got out of his car, walking toward me in a rage, yelling, "Your history", as he approached me or my husband, my mom or dad, my sons, my daughter-in-law, my grandsons, my brother, my friends, my co-workers, my neighbors, my husband's church congregation or any stranger on the street anywhere in the world, we, like Mr. Gumm have the right to defend ourselves. Mr. Gumm should be receiving some support from the police department and District Attorney's Office, but now he's facing a trial and jail time. If an officer had someone like Mr. Turney coming at them under the same circumstances, they would have been justifed in defending themselves. Don't we as citizens of the great State of Oklahoma have the same right? Mr. Harris, if this story is correct as written, Mr. Gumm has enough going on dealing with what happened that night. Please reconsider Your action. None of us make the right decision all of the time. We just back up and say, "I blew that", make the right decision and go on.

Diane, perhaps you you should read the story again. It was Gumm who apparently pulled out in front of Turney. Had this mistake not been made, the incident probably would never had occured. Gumm was surrounded by onlookers and could have called 911 if he wanted the police. He could have stayed in his car. Instead he shot the man he had aggravated with his apparently poor driving. A car is a very dangerous tool to use incorrectly, and if Gumm endangered someone else's life with a car, he shouldn't be driving. Harris knows more about the case than you, so desist from telling him what to do.

Turney is DEAD, Diane. Turney was unarmed and he didn't kill anyone. There is no mention that his driving at the time was poor. He shouldn't have accosted a person on the street, but he was more than likely venting and nothing more. A guy who was trying to help out a friend got shot by someone with very poor judgement. And your weird opinion that "I blew that, back up and go on" when a man's life is lost is too fatuous for comment.

This is just wrong. So now Kathy Taylor is using what she learned at the "Mayors against guns confenence" against our citizens. Well Tulsa, this is the crap we get when we elect this type of person as Mayor. I am sure she pushed this issue with the DA considering the NRA National gun show will be held here at the fare grounds in Oct. So the citizens that are protectind themselves from DRUNK DRUG USERS that are driving the city streets are now crimnials.

The story says Turney picked up a friend from the bar because he was too drunk to drive. Where was the friend during all of this? Wouldn't he be considered a witness?

mike, Turney could have called the police himself to report the bad driving..did he? No, he confronted the old man, who couldn't even leave, Turney made sure of that. The report doesn't say any of the onlookers came to Gumm's aid. Did Gumm have a cell phone, or should he have turned his back on the outraged man to look for a payphone, If, he had the change? No. You just sound like you're sad someone died, and that a person is justified to be enraged over another persons bad driving.

Actually, Fancy, I am saying that carrying concealed handguns around will be a problem until we have a way to make people's judgement foolproof. The people I know that have licenses to carry (some of whom are good friends) don't exhibit the type of judgement that fills me with confidence. The mentality that you should shoot when you could instead just lock your car doors is absurd. We don't know exactly what happened, but apparently the facts indicate Gumm's actions were criminal. He has been charged. This isn't Tombstone, Arizona in 1880. We live in a society of laws where taking a life has ramifications.

I knew this was going to happen. Some bully with a gun shoots an unarmed man. He was supposed to be trained on when it was right to use a gun and he didn't use good judgement. PLEASE OH PLEASE let me be on the jury: the shooter will do time in prison. He is just a bully with a gun and you don't need to have any pity for him. Basically, he's stupid.

I don't believe a locked car door will save you from harm. They have glass windows which can be broken. Personally, I wouldn't feel safe.
And the conceal-carry law was passed after a nut killed a bunch of kids at the Wendy's in East Tulsa. Would you rather only the bad guys had guns?
The point that the DA should realize is Gumm didn't chase Turney down.
He warned him he was armed and would protect himself. He didn't just blow him away. Turney had the chance to leave him alone, and didn't. It's Turney's own fault he is dead.

Turney did not break any car windows or pull Gumm from the car which would have justified the use of force against him. Gumm got out of his car and shot Turney. Those are the facts.
It's Turney's fault he is dead? Does he deserve to be dead? Why? because of the horrible injuries suffered by Gumm? I don't think Gumm had a bruise on him. If he had stayed in his car, Turney would probably have screamed at him and left. And that would have been a non story, and everyone involved would be living a normal life, snorting meth or endangering people's lives by driving irresponsibly while carrying a loaded gun.

Gumm did not get out of his car and shoot Turney. He got out of his car and warned him he was armed. Those are the facts.
We do not know what Turney would have done if he had stayed in his car. We know he couldn't leave, that is a fact. Turney left him no choice but to face him.
"Turney would probably have screamed at him and left". You don't know what he would have done.
And your last sentence makes no sense.

Waste of tax payers money. Let the guy go.
Getting blocked in your parking space is a threat to begin with. The guy was drunk and on drugs and a hothead, another threat.
Shooting was justifiable!
