Update: ORU faces lawsuit

Three professors said they lost their jobs because of a report about the Richard Roberts family.

Three former Oral Roberts University professors sued the school and four administrators in Tulsa County District Court on Tuesday, alleging wrongful termination and wrongful causing of one professor's resignation.

The professors said they lost their jobs because they turned over to administrators a report that alleged the Richard Roberts family extensively spent university money for personal uses. Roberts is ORU's president.

The lawsuit includes a summary of the report, minus the "more salacious" information, as former professor and plaintiff Tim Brooker said.

The report "poses a real grave threat to the university," Brooker said. ". . . I fear for ORU's survival, and if they don't make some very significant changes administratively, there won't be an ORU."

Brooker said leadership of ORU has shifted from God to the Roberts family, and "if God once again can regain control, I think many of the problems will take care of themselves."

The university issued a written statement on Tuesday that said: "It is important for ORU students and their families, faculty and staff, alumni, partners, as well as the general public to understand that this lawsuit is largely premised upon a compilation of incomplete statements, unsubstantiated rumors and innuendos. ORU will address these allegations through the legal process."

The university did not respond to specific questions about the lawsuit.

ORU senior Cornell Cross II said Roberts called a campuswide emergency meeting to pray "against the enemies" on Monday night in anticipation of the lawsuit being filed.

The plaintiffs in the lawsuit are Brooker, who coordinated ORU's government program; his wife, Paulita Brooker, an adjunct professor who was first hired for the ORU School of Lifelong Education; and John Swails, professor and chairman of the history, humanities and government department. They sued ORU, Roberts, Provost Mark Lewandowski, Dean Wendy Shirk and Vice Provost Jeff Ogle.

Swails and Paulita Brooker were fired, and Swails said Tim Brooker was forced out of his job.

Tim Brooker said ORU's 501(c)(3) tax-exempt, nonprofit status could be at risk because, he said, Roberts required him to make his students work for 2006 Tulsa mayoral candidate Randi Miller's campaign, in violation of laws that prohibit nonprofit groups from getting involved in partisan political campaigns.

A complaint was lodged with the Internal Revenue Service, and Tim Brooker claims he was told to take the blame for the university helping a campaign.

While working on the Miller campaign, a student was asked to repair an ORU computer, Tim Brooker said. The student backed up the computer's files and discovered the report on the alleged misuse of ORU money. The student turned the report over to the professors, who read it and "said several times, 'We hope it's not true,' " Swails said.

The lawsuit claims the report was developed by Roberts' sister-in-law, Stephanie Cantese, who works for Oral Roberts Ministries.

The summary of the report in the lawsuit alleges:

  • One of Richard and Lindsay Roberts' children vandalized and removed athletic department equipment from ORU property.
  • University and ministries employees regularly do the homework of the Roberts' children.
  • ORU paid $29,411 for one Roberts daughter to vacation with friends in Florida and the Bahamas and use the ORU jet for transportation.
  • Lindsay Roberts routinely uses ministries security personnel during personal vacations.
  • Lindsay Roberts awarded 13 non-need-based scholarships to friends of her children, two of whom had test scores below ORU's admission requirement; and more.

Tim Brooker said that days after the professors gave the report to administrators, Cantese called him and threatened that his wife would lose her job and his son would not graduate from ORU. Indeed, Paulita Brooker was fired, along with Swails.

The lawsuit claims Paulita Brooker was fired partly because Swails had reported that Vice Provost Ogle sexually harassed another professor. The professor, who worked in Swails' and the Brookers' department, resigned. Swails said ORU took no action regarding the report of sexual harassment.

With that professor and the three plaintiffs gone from the history, humanities and government department, student Cross, a senior majoring in government, said he is looking for a new university.

"The government program really is not credible anymore," he said.

The lawsuit requests for each former professor $10,000 in actual damages, $10,000 in punitive damages, attorneys fees, court costs and any other money the court may provide.

Dr.Roberts i have gotten 4 calls we are all signing papers to send to you. We saw Mrs. Broker write the e mail - she was mad after son left Lafortune's campaign brooker got Toby Brandon's job as campaign manager. Brandon is a skilled as a campaign manager amd thats why his blogs above Brandon I notice he is leaving off Brooker said he got a nice letter of reccommendation to take with him to Coburn when he left the campaign to get a full time job for Coburn. Toby had no experience running a campaign. We all knew Toby lived in an off campus apartment with your son Brandon.We went there to hear him play his guitar. The students are right you live in Silom Springs and drive every day, Toby's mom lives in Germany. Toby told 3 of us he agreed to take the hit about writting the email when it looked like Dr. Mrs. Brooker was going to get in trouble for sending it. Your husband came to him and reminded him about doctoring up his admission papers for him so he could live off campus with Brandon, Toby told us he felt obligated. We got scared that he might be kicked out of school, the computers are password protected and have all our grades and information and under firpa thats big- Brooker promised he could get Swales to go along with a slap on the wrist.

Brooker being forced to do Miller's campaign absolute bogus. Brooker's roommate toby was fired by Mayor Lafortune's campaign and Brooker let everyone know how furious he was. Brooker and Dr. Mrs. Brooker his wife sent out a firey e mail "we have been challenged and we must defend our honor" and made a plea for us to join with her in Randi campaign as our honor has been challenged by Lafortune. Dr. Roberts was out of the country because my roommate went with him on medical missions. So how did Dr. Roberts force him? Before President Roberts ever came out for Randi Miller brooker was organizing the young republicans and getting the on board to seek revenge on LaFortune who he bleived treated his sons roommate bad. This is pure crap. Til now i went with the story Dr. Brooker but no more.

First you make Toby take the hit for your wife then you lie and say Toby sent it we had wittnesses who are you kidding. you talked bad about chris medlock because michale bates when we accompied you to the republican mens club forum michale challenged you all the way back you went after chris medlock and told us you are taking him on personally. This had nothing to do with President Roberts and I can give names of those who heard you say this. I worked for Kathy Taylor got credit and my roommate did MAyor Lafortune you said at the beginning of class we could work on any campaign for credit. Come on students if you were in his class that semester come out you know what he is saying. Dr. Brooker you resigned no one forced you out.. you did the same in 2006 when i was a first year student you told us you resigned. Many the got tired of it.

Giving attention to comment #1 and #2

It seems as you do not approve of Dr Brooker.

Yes, all that you've mentioned does not look good on him.

Nevertheless, this lawsuit puts to question the integrity and character of a christian college president, the first lady, their children and the vice provost.

Dr Brooker is no longer a faculty member, to what would you hold him to? Should those matters as mentioned in #1 & 2 be mentioned while they were still employees of the school, that would most certainly demand critical attention from the management.

I question the rationale for coming forth at this point. Why didn't you present this to the Deans? Perhaps they have done you and your friends wrong. And perhaps it is unacceptable. Could we be more constructive and think of means to provide sanctuary for both parties? after all, they are all hurt and afflicted in a way or another. Please?

Dr. Brooker,

the honor code and other docments require us to live on campus if we are under 25 and unmarried, unless family live in town. I am reading students tell you live in Arkansas and your kid live off campus in an apartment with this other kid you made take the hit for your wife, I have not had you for a teacher nor do I want you. Integrity means integrity for everyone. You show you don't respect the rules, what kind of a person would let a kid risk not graduating. I am thanking God you left. I hope other students ask themselves is this the kind of integrity we want from our teachers?

I have prayer all night for wisdom. As a former IT employee at ORU, I can assure you every ORU computer is password protected. There are times when students needed to access very specifc parts of the computer to perform work for instuctors or others especially work study, at no time can a student passwork use any computer to get to the files and hard drive to download every computer has a very complicated program in them that forbids someone on a student password to go outside thier specifc boundries of thier password parameter. This student could not have navigated on his password to download files.

I am starting to question you Dr. Brooker, I recall the mess you created when you sent out an e mail - it was all over the tulsa world and embarassing. Then you told you did not send it a student wrote the document and signed your name to give the impression you wrote it. Again, Dr. Brooker your computer as a faculty member was even more secure due to Firpa. are you telling you gave this student your passwork, if so that is a very serious violation and i suspect perhaps why you are no longer working for the university. We clearly have documents that giving out the password to anyone is illegal and grounds for termination you put every student in the university at risk. Then you tell your wife sent it again your computer was password protected your wife is not authoritzed in your computer. You are wanting us to belive this woman trusted this young man who has a history of breaking into computers, writing documents and sending them out with others signatures trying to pass them off and this woman gives him her password protected computer allows him in her computer and he inadvetedly downloads documents and claims they are from her. Fool us once shame on you fool us twice Dr. Brooker shame on you.

I am going to call It tommorow to remind them

to check when this woman gave out student ppasswords as they will all be retained. With oonly a student password he could not have oobtained this document. I thought I remembered all the empolyees by name with computers this one slips my memory

I hope the lady in the artice will call office immeidately. I would love to handle a case for you. This kid stole materials from your computer and admits when he discovered it he ran to others you have a hell of a tort case for unauthorizedpublication of private facts, if you didn't write this letter as i highly suspect, i'll represent you for false implications, what kind of an attorey would take a case with the key evidence being submitted by a kid with a track record of hacking into computers and writing materials and sending the off under other's name. Lady call me. I would like to know why this professor wasn't livid the kid hacked into his computer and wrote an e mail and signed the prof's name this is starting to smell- the the prof instead of recognizing the kid stole information and not being an ORU follower I am not certain but keep reading honor code- why didn't the professor demand the kid return the stolen materials. Come on nobody accidently downloads files where did the kid get a disc -had to bring it with him planned protecting this kid unless this kid has stuff on the prof you don't bring in a disc to back up files specially with what the IT person said. I am calling the newspaper and leaving my office phone, and name please lady call the paper get my name. This kid is a criminal and you need to take action.

Brandon D. Brooker along with me and others graudated mid term. We completed all requirements and were bestowed all the rights and privliges of as an ORU graduate. There was no mid term ceremony. We had the option of walking with the rest of our class in May. Brandon amd I walked with the class but we were already grads as of the end of the 05' semester. Brandon could not have had his graduation stopped. He already graduated. Check closer Dr. Brooker all you son did in May was put on a robe and prance. He already has his confirmation. This story gets weaker and weaker . The more the 3 pied pippers talk the less credible their stories become.

Don't confuse the one man and one woman operation with a biblical church as described in The Holy Word.Richard's second wife Lindsay is a glaring example and reason for the Clear Commandment in the Holy Word that Clearly states"Let women be silent and be in subjection to their husband".If you want to finance the extravagant lifestyle of Richard and Lindsay,then SEND MONEY.It is all tax-exempt!!!

perfect example of the corruption in these so called "religions" around here and the world. Funny how "God" only seems to "abundantly" bless the leaders of these business's with all the lavish things that TAX EXEMPT money can buy! It's time to be realistic and make these crooks and yes when you bilk money from old men and women with "God's gonna take me home if we don't raise the money" garbage then yes YOU are a crook and fake.

Having a spouse that works at ORU I know the allegations against the Roberts to be the tip of the iceberg- I concurr and praise that the suit will cleanse the University of this wayward child- Lindsay needs to go to rehab. Richard Roberts needs to get backbone to harness this wife of his. What has she got on you, Richard, to be able to do as she pleases without regard to University or Life Policy? Greed has a powerful grip on these heads of ORU- Repent!

All religious groups need to stay out of politics...or be TAXED! Randi Miller is a Collection Plate Politician! Remember she is the one pushing this vote yes tax! She should be in trouble to for taking the tax exempt money. I wish I could use my tax money for political gain. I would use it against the religious phonies that run for office.

What I find even more unsettling than the allegations against ORU is that the comments above are being posted by ORU staff and students. You obviously are not getting your a quality education at ORU. Your spelling and punctuation is not what I would expect of college level students and staff.

It is unfortunate that a article like this has be be broken " HOWEVER" if we are so quick to choose up sides and claim "FOUL" by the other side, we need to remember one major issue. God created the evil one, he was tossed out and the LORD says' he shall come like a thief, to kill, steal and destroy. We if aa true Christian must believe that " WE MUST UNDERSTAND" the evil will attack heavily those who are hurting him. The roberts certainly have hurt the evil one. Now maybe they were bit and followed some wrong actions, big spending. We must PRAY that these facts will be a help to HIS KINGDOM, Lets step back and remember that JESUS CHRIST was killed because the people were not accepting HiM , HE is still our answer so lets quit deciding which is right and rely on GOD to direct those who might have wronged either man or GOD to change. Oh, God will prevail alright. It's already happening. The Roberts family has ripped millions off since day one. And sure; good students and minsitries have spawned from it. They had to. That family wouldn't have been able to continue ripping people off all this time if no good results were produced. If they can't parade that around how else will they get you to send more money? This isn't some mistake they've made or some sin they've fallen into along the way. This is and always has been the plan since day one.

God will prevail alright. It's happening.

Cornell (who I am cool with) is quoted as an ORU Gov Senior! He should be quoted as a super senior! I know your going to read this comment! How come You were a senior when I was a freshman at ORU, now one undergrad graduation and two graduate schools later, You are still being quoted as a senior!

As a parent of a current student, I remember bringing my daughter to school 4 years ago. As we were bringing her things into the dorm, there was an area being remodeled (combining to rooms together). When I asked the coach what was going on, he said (in a low tone) that it was being changed for one of the incoming Roberts girls. At first, I was stunned by the nepotism, but later became numb to seeing this and the reserved parking spot for her BMW X5 black SUV. I thought, "hey, it's their money". If I find it was tax-exempt college money, I'm going to be pissed. Shall we, as parents, file a class-action law suit for being over-charged for tuition, room and board? My daughter has had an overall good experience as both a student and athlete. If this becomes national news, will she hand over her resume with pride or sheepishly slide it over the desk to her potential employer? The big picture is this; How will this affect the students and the university? Also, wouldn't a lot of this be cleaner in the future (no matter what the outcome) with a neutral president with no ties to this seperate ministry? We don't follow Oral or Richard Roberts, we just thought it was a good place for education, athletics and growth, which it has been. Let the legal process take place of these current allegations, but the whole control issues and nepotism need to be addressed no matter what the outcome.
