Dog on board: Pooch's lap ride results in ticket

Shannon Medlock received her very first traffic citation a few weeks ago, and it wasn't for speeding, running a red light or making an illegal turn.

She received a $120 ticket for driving with her 2-year-old Chihuahua, Mickey, on her lap.

"I didn't know why I was getting stopped," said Medlock, 22, who, at the time, was on her way to a south Tulsa coffee shop where her dog was welcome.

"I was shocked when I learned why he stopped me. I see dogs hanging out windows of cars all the time," she said.

"I figured he was going to give me a warning, but he didn't," she said about the officer.

Medlock said her dog wasn't in her lap while the pickup was moving; only when she would come to a stop. She said she was driving her father's pickup, which has a bench seat.

Medlock takes issue with the officer's account that her dog was bouncing around the cab.

"It's a Ford F-150. It's a big truck. It would be difficult (for him) to see my little dog," she said.

Medlock said she was behind the officer at a stop sign when her dog climbed into her lap to look out the closed window.

She said that when she began moving, she pushed the dog to her side.

The next thing she knew, she was being pulled over, she said.

During a City Council committee meeting this week, Councilor Bill Christiansen mentioned the incident and inquired about the city laws pertaining to dogs riding in vehicles.

"How many people in Tulsa know that there is a law that prohibits dogs from being on the lap of the driver? I have a dog, and I didn't know that," he said after the meeting.

Christiansen said what really concerned him was learning that the officer who cited Medlock has written more than half of the tickets that have been written for such offenses in the last year.

The officer is assigned to patrol the southwest area of the city, which includes the councilor's district.

"What is the officer doing? Going around looking for people that have their little dogs on their laps?" Christiansen asked.

He said it seems unusual for an officer to have written such high a percentage of tickets for that specific offense.

"Is that acceptable?" he asked.

A city ordinance prohibits motorists from driving with a "person, child or animal" on their laps, City Prosecutor Bob Garner said.

Garner said 16 tickets have been written since September 2006 for motorists driving with animals in their laps and that the officer who cited Medlock has issued nine of those tickets.

Tulsa police issued a total of 100,814 traffic citations for all of 2006, he said.

The ordinance also prohibits animals from being loose in an "open vehicle," which means the back of a pickup, in a convertible or in conventional vehicles with the windows rolled down, he said.

The best solution to prevent a citation is to either crate the animal or secure it to the seat with a leash or dog seat belt, Garner said.

Although the ticket for driving with the dog in the motorist's lap costs $120, having a dog riding loose in the back of a pickup results in only a $45 fine, said Garner, who could not explain the discrepancy.

Christiansen said he hopes police officers would use reasonable judgment and help educate the public on the law.

"Riding around with your dog on your lap isn't an intentional act to break the law, like running a red light," he said. "I think most people just don't know it's against the law."

ignorance of a law is not a good excuss, it is not the police departments job to educate you. as a pet owner in a city you should take the steps to find out if there are any pet laws that will effect you and your pet. and use a little common sense.

I GUESS THIS WAS THE ONLY CRIME GOING ON IN TULSA. MOST COPS ARE WORTHLESS. THEY ARE MORE WORRIED ABOUT PEOPLE NOT WEARING THIER SEATBELTS THAN THE TRUE VIOLENT CRIMES. HONESTLY.

You people don't get it. This officer is assigned to TRAFFIC detail, not robbery/homicide. It's his or her duty to enforce TRAFFIC laws. If the law is being broken, enforce it...it's as simple as that.

Well, well, Don't go find the guy's kicking in doors and pistol whipping people, don't jail the guy's robbing people every ten minutes. But Please keep an eye out for small dogs loose in cars. We can have that kind od activity in Tulsa.

I think this is the dumbest thing I ever heard. Police officers drink way to much coffee or are just to anal. I guess they get board and constantly eye every driver hoping they do just one little thing so they can give them a ticket. Well there is only one answer. Put them in a doggie seat including a seat belt. HAHAHA. I wonder if they can see my ferret when she is in my lap!!!! Well since I never got a ticket I guess not. Dont be mean to animals let them look out the windows. DANG!!!! VOTE NO TO RIVER TAX

Kudos to the officer for enforcing the law. This can be a distraction just like talking on the cell phone w/o a hands free device and driving.

I've been pulled over for a unrestrained dog. Didn't get a ticket, just a warning. We went out and bought a "doggy seat" and the restraining harness, etc. No big deal, we use it 90% of the time he rides with us now. What I'm trying to figure out is how this would ever even end up being discussed in a city council meeting. It's not the cop I'm wondering about, it's Bill Christiansen.

I did not know that driving with a dog in your lap is against the law. However, I have seen this several times and always thought "what an unsafe practice".

I agree that if a law is broken then a ticket is fine.I also know that ignorance of the law is not a excuse. However COME ON, I agree with Bill, the police should have at least done DO DILIGENCE, by informing the public it planned to inforce it. How many times do you see news stories about Seat Belt inforcement or DUI road blocks around the holidays. Meaning they are giving fair warning that these laws will be inforced. This Officer should have to spend some time at the POUND. That needs to be his new, dog hating beat.

I'm with you guys, #9 & 10. Why is this a concern to the city councilor? A traffic law was broken - and it's not an unreasonable law. If the dog is loose in the front seat, how is that not a distraction for the driver? If the dog needs to be in the car, keep the animal, yourself, and others on the road safe & get a restraining harness.

I admit it, my dog sits on my lap and looks out the window while I am driving. I never knew it was against the law but I know it can be dangerous. Frankly, I am blaming my dog on this...he is so persistent about it and he is soooo cute..how could I resist? But, now that I know the law, I will be out buying a doggie seat...and one high enough for him to see out. Thank you Medlock ....see bad things always brings out good things, I won't get a ticket and probably a whole lot of people.

You know better and wouldn't drive around with a small child in your lap or without a car seat, why would you let your dog or cat (yes, I've seen cats) in your car loose.

I'm just curious, but I wonder if talking on your cell phone while driving is illegal and if so, how many tickets are given out yearly for that? I think that's far more prevalent and annoying than my Lab hanging his head out of my back seat windows! I understand the point of the law, but if we're trying to protect public safety, I'd be willing to bet that more accidents are caused by talking on cell phones than they are by animals in cars. The point is, THIS IS A STUPID LAW!

The officer was completely justified in giving these tickets. If these people love their pets so much, then why haven't they thought about what would happen if their dog or cat were not restrained and they got into a car accident? It's in the best interest of the pet and the owner to keep the animal restrained.

Wow! I am shocked (although I shouldn't be) at how many people out there are willing to express thier ignorance. Having a dog loose in your car is dangerous. Having a kid on your lap is dangerous. Eating, talking on your phone, putting on make up and reading are dangerous! I am glad we have officers to protect us no matter what the dangers are. If you are violating the traffic laws you are a danger. Put yourself in the shoes of the other drivers for a moment. We are having to watch your driving because you don't. We have to swerve to miss you becuase you are petting your dog, fiddling with mascara or reading your newspaper! Pay your fine, learn from your mistake and become a more courteous driver for the safety of everyone. I reiterate what #5 said as well. Police officers wear alot of hats. I appreciate the fact that they are brave enough to do the job they do. If you think they are all lazy doughnut eating ticket givers lets see you get off your behind and do the job they do! Salute to the officers that bravely wear that badge and dedicate themselves to keeping us safe. It's a tough job and I am glad you are here!

I have two dogs, one hangs out passenger window, the other hangs out while sitting on my lap. LOL...I've trained them to sit down when they spot a cop. Sometimes they drive and I hang out the window....LOL

I have tried to get the police to come and check out speeders in my residential neighborhood. I guess i need to tell them they are driving with dogs loose in the vehicle maybe that would get them here
