Suit targets state immigration law

The National Coalition of Latino Clergy filed a federal lawsuit Monday against Gov. Brad Henry and Oklahoma Attorney General Drew Edmondson, seeking to overturn House Bill 1804, a strict new state law against illegal immigration.

The suit alleges that the law is unconstitutional and violates rights to due process for undocumented immigrants, who are listed as "John Doe" or "Jane Doe" in the list of plaintiffs.

"The leaders and people behind House Bill 1804 are guilty of ethnic cleansing," said the coalition's president, the Rev. Miguel Rivera, at a press conference outside the federal court building.

The Rev. Victor Orta II, the president of the American Dream Coalition, said the suit was no reason for celebration.

"It is a sad day for our state," said Orta, a Tulsan. "Upon celebrating our centennial, we have to present a lawsuit on an issue like this.

"It is a bad law when children born in America

are at home this morning from school because they're afraid."

The suit comes as no surprise to HB 1804's co-authors, Rep. Randy Terrill, R-Moore, and Sen. Jim Williamson, R-Tulsa.

The bill is constitutional and will stand, both said.

Terrill said the lawsuit's allegations were "so absurd, outlandish and preposterous and almost laughable if they weren't so despicable."

"I am not worried in the least."

Paul Sund, a spokesman for Henry, declined to comment until state lawyers can review the suit.

Rivera said the suit named Edmondson as a defendant because he hasn't acted on requests to consider the law's constitutionality through an attorney general's opinion.

Charlie Price, a spokesman for Edmondson's office, said several requests had been made for opinions on the law.

He said initial responses were sent to five representatives mentioned in the lawsuit. The responses said that the Attorney General's Office needed more time to review their requests.

Rivera said time is of the essence for illegal immigrants concerned about the law, which is to go into effect Nov. 1.

The local attorney for Rivera's coalition, Rohit Sharma, said a request for an injunction to stop the law from taking effect on that date would be filed Tuesday.

Instead of delaying the date of enforcement of the law, we should accelerate the process. These people suing should be ashamed of themselves for trying to encourage lawlessness in this country of laws. They must be afraid that their congregations will be emptied out and they will be out of a job.

The people of this state have spoken and their is great support for this law. I dont think they stand a chance in court. Illegal "ALIENS" This rev. should have charges pressed against him. I wonder where he got the money? Isnt his money from a nonprofit organization? Is he harboring and aiding Illegal Aliens. Sounds like a serious crimes to me. I hope they laugh him out of court. Wasting our tax money on this and our legal system. This is so stupid. TW call them what they are. ILLEGAL ALIENS!

Just another example of how we the poeple have allowed political correctness take over. We connot sit with are heads in the sand anymore. None of you poeple in this city have enough guts to do anything like our forfathers would do. So a fruad like this Miguel has a much louder voice all of you combined. This town has more churches then any other town in the USA. But it does no good, how do they help the community? The social problems in this town are out of control. Time to rise up and be the type of person that owns up to there patriotic duties.

Isn't it sad that Victor Orta and Miguel Rivera would oppose a bill and future law that protects the rights and wellfair of legal citizens of a country, while they themelves support illegal activity?

Rev. Miguel Rivera should be embarassed by his statement that the leaders and people behind House Bill 1804 are guilty of ethnic cleansing. This statement alone weakens all creditability he may have had. He clearly shows his agenda is to scare all hispanic people, both legal and illegal.

So under Miguel Rivera's definition, I guess Mexico and other countries of Central and South America have been practicing ethnic cleansing as well. If he is so caring about this concept, why is he not demonstrating and trying to change this concept in the country of his family origin?

these fools do not know the meaning of ethnic cleansing. ethnic cleansing is when you get rid of your own people that belong here. these people are here illegally and should not be here. these are not men of God as they are required to uphold man's and Gods law. these men are of the devil supporting criminals and their activities.

Actually, Mel in Broken Arrow, undocumented immigrants DO have rights in this country. It was a Supreme Court mandate many years ago. Also, many of you posting here are suggesting that because an immigrant crossed the border illegally then they therefore behave like criminals in every other aspect of their lives. That is part of the problem with this law, it suggests that the "lawlessness" in our state is due to illegal immigrants. Just how do we prove that? Are you law-abiding citizens really ready to give up the low prices on your food and services thanks to the low wage labor that many undocumented immigrants provide? Get real. A law like this was passed in Riverside New Jersey a while back. Their town emptied out, businesses closed, working people left. Guess what happened? They RESCINDED the law!!! Besides that, they were never able to enforce it anyway.

AC... you're just listening to a bunch of political BS... Where is Rev Miguel when my neighbor was in a wreck caused by an illegal that didn't have car insurance? They had to get a 2nd mortgage on their house just to pay the hospital bills and get out from under the totalled car... I agree that they need to revamp the laws and make it easier for individuals to become citizens so there aren't as many illegals here... but yes... if they here as undocumented citizens... they are here illegally... they don't pay taxes... they're a drain on the government... and they are a risk to ALL legal citizens. I'm sure my neighbor would pay a few cents more for her vegatables as opposed to having to pay that second mortgage...

What part of ILLEGAL do these people not understand? The immigration laws of their home country should be instituted here in the US and then they'd really have something to yell about. Do the bleeding hearts defending these ILLEGAL IMMIGRANTS have any idea what happens to people from other countries who cross into Mexico illegally? Read up on it you foolish people. I don't care if the ILLEGAL immigrants live lives as pure as the driven snow while here, that doesn't negate the fact that they BROKE OUR LAWS CROSSING THE BORDER ILLEGALLY. Wow, I thought HB1804 said NOTHING about race. Someone please correct me if I am wrong, but my understanding of the bill is essentially that if you get accused of a FELONY, the police have to check your immigration status. What is so heinous about that?

Is the problem that illegal aliens are seeing this as an attempt to actually ENFORCE existing laws, so they are soooo afraid they are leaving the state? If that us the case, what is the problem?

Funny someone mentions the river tax vote. If we had voted for the tax, the hispanics - CONLAMIC - would now be claiming we want this law because we want to avoid giving hispanics the $25 yearly rebate!!! It's true, it was going to be one of their talking points, check it out at their website. Laughable, huh? As it is, the government should be willing to pay each and every illegal $25 just to go back to the country of their citizenship instead of causing us all this trouble to outlaw their grazing off public benefits here.

Illegals will be legal with voting rights,in 20 years or with amnesty. With a large Mexican culture in Texas, whats to stop them from voting to secede Texas from the United States of America? Quebec tried it in Canada.

I'm all for free speech, but #9 & 13...go to another message board as you are so off the subject.

I agree with #1 & #2, but I wouldn't put it past some moron judge to rule in favor of Oro, Riveria & company. One of the comments here about polictical correctness is right on target. We need to uphold our laws of the U.S. The outsiders who are here or here illegally, it you don't like it, please leave, you were not invited.

It might be difficult to become a legal citizen since it take a while to become a citizen, but tough. Anything worthwhile is worth waiting for. In this day and age, the U.S. needs to be vigiliant about who we let into this country. That's just the way it is.

Not just the invaders are upset. Just because I am brown, am I going to have to prove my citizenship if I get pulled over for speeding? Because I wont. Not unless they prove theirs first. It has nothing to do with if I can prove it or not. Its disgraceful that I should have to prove it at all. How would any of you like to be stopped for speeding and then be asked to prove yourself? That is my only concern with this law. I would rather they overhaul the immigration system BEFORE laws like this are enforced. But thats JMO.

Illegal immigration is kind of like dog crap. An argument can be made that a little is good for the yard, but then you step in it and you've got a problem. And you certainly wouldn't want every dog in the neighborhood to crap in your yard.

Illegal aliens should go back where they came from and fix their own countries instead of using up our resources when we don't have enough for ourselves. 12 million illegal immigrants aren't just from south of the border, they're from all over the world. All of them should go home.

Illegals have the right to leave, each and every one of them committed a felony in either getting here or staying past the time on their card. Employers of illegal aliens should be fined substantially for every illegal alien on their payroll and made to pay for returning each said illegal alien to their point of origin. Make it more expensive to hire illegals than it is to hire real Americans. Enforce the laws already on the books.

I don't care what the idiots on the Supreme Court said, illegal aliens have no Constitutional rights. I'm willing to pay for their ticket home, but they don't even have that as a right.
