Update: Judge rejects injunction to block HB 1804

U.S. District Judge James Payne has rejected an effot to prevent the state's controversial anti-illegal immigration law from going into effect Thursday.

House Bill 1804 becomes law at midnight.

Payne filed his ruling electronically at 6:04 p.m. Wednesday after the courthouse had closed for the day.

He rejected preliminary injunction requested by the National Coalition of Latino Clergy Inc., another Hispanic advocacy group, two churches, a construction company, a restaurant and several anonymous people.

While Payne didn't blocked the law from taking effect, he did not rule on its constitutionality.

At a Wednesday hearing before Payne, the plaintiffs in the caseargued that the law was unconstitutional.

Attorneys for Oklahoma Attorney General Drew Edmondson argued that the law was constitutional and the suit was inappropriate because the plaintiffs couldn't show that they were hurt by the law before it goes into effect.

Payne has scheduled further filings from the plaintiffs and the state. He could later find the law to

be unconstitutional.

The law would make it a felony to knowingly transport illegal aliens, created state barriers to hiring illegal aliens, require state contractors to check the immigration status of workers and require proof of citizenship to receive certain government benefits.

It's amazing how these people sticking up for illegals, don't seem to see that there is harm going on for the people here legally for a long time. It's not right for someone here illegally, to be taking jobs that are supposed to be for legal workers. And no business can compete without doing this, which means legal workers are essentially blacklisted. This is wrong. It's our country. Mexico discriminates against illegal workers. Why is it alright for them, but not for us?

Wow! I do not support this new law, (and I am A White Female), I have to honestly say I don't like being considered a lazy white person unable to even flip burgers. Sabes Que, I work full time, take take care of my kids, help others and don't draw any type of welfare. Now for the other racists, My husband is an illegal and a d*** good man! He works hard and takes care of our family, he also donates to charities, etc. He doesn't expect or want any kind of hand out. I have a college education (attack my spelling if you must.) and worked hard to get it. We are on the path to filing for his Visa but our government makes it difficult to obtain. which I can understand to a certain degree. we will eventually get it, I just don't want him deported, me in jail and our wonderful state raising my kids!

Pesonally Ive actually run into restarant servers (hispanic and othewise) who could not speak english or even barely.

If you cant speak good enough english in what is a primarily ENGLISH speaking country, you will lose out.

In my own case, I wont even bother buying or selling from somebody who cant talk right.

Btw, I speak English,SPanish,French so I am capable to communicate, but if the person I deal with cant do English here in Tulsa, they will not get my $$

Woah pjc you are showing your true ignorance. How do you know that the Hispanic people are not experiencing racism and prejudice on the level of African Americans? Are you Hispanic? And how do you even know what African Americans experience...I highly doubt that you are black. Most illegal immigrants WANT to become citizens you moron. But your stupid immigration system is too hard, too complicated, and too expensive. Do you eve know what it cost to become a citizen? Probably not. And as for WORKER, I know PLENTY of Americans who can't speak English either, you want examples...go watch the Jerry Springer show.

Personally I could care less about the low wages they work for. That's why I went to school. I worked at a hospital and know how much they cost taxpayers. You want to hire them to roof for dirt cheap wages then you pay for their healthcare/medicare/social security. And don't bring that tired statistic about them all paying into social security and don't draw a dime because it isn't true. And no I'm not going to provide links because there are too many .org groups that you can come back with that make up their own numbers. Educate yourself!!! If they don't want to go through the same steps as my ancestors and come here legally, then I say take taxes out of their paychecks everytime. Instead of complaining about Americans not wanting to support illegals, why don't some of you mental midgets ever show any ire at these countries whose poeple leave by the droves? It's not my fault your country sucks. If you love it so much and don't want to embrace what it is to be an American and not live on entitlements then FIX YOUR OWN COUNTRY!

Mary comment 313, did you realize the kids weren't going to make a career out of harveting corn? LMOF This was temporary, Mary. That's quite a tarnished view of all Americans doing agriculture work just from being told a few students did some harvesting. How naive!! Don't you realize that most young people (especially males) aren't going into the construction field as before? Did you know that students are opting for internships in the summertime rather than work at tourist areas and other menial labor jobs? That's why you see more immigrants doing these jobs. Our young people are living in a different era than years ago and they aren't wanting the back-breaking, dirty, hot jobs that immigrants fulfill. Don't you know that when an Agjob owner gets a crew, he can't ever get enough USCs to fill a crew? Did you know some of the slaughterhouses that have been raided have had to recuit from one hour travel time away from the job and bus people in. One female said it was way too time consuming to have to get up and ride that far and get home late. She said it paid more than her previous job but the work at the slaughterhouse was harder and she's thinking of returning to her previous job closer to home. Mary, you must do a google search and find more articles on illegal immigration so you'll be more enlightened. As others, you must realize that the U.S. permitted this illegal immigration to continue for many years having turned a blind eye to it. In the 1990s the U.S. needed so many laborers and it turned a blind eye. And don't tell me that we're living like it was in the 1950's when you could leave your door unlocked and nobody would come in. Even Albert Schweitzer (doctor and philanthropist) leaned in Africa when doing voluteer work that he must put a lock on his medical cabinet door. The U.S. didn't enforce any policies until now. Don't you realize ICE is being selective as to what company or field they raid? Some of our representatives have a stake in some of the fields. Think those are going to get raided? There's immigrate2us that members help each other with the process of legalization which is difficult. There are othes such as VisaJourney These sights will enlighten people as to how people are trying to doing things the legal way but the process is a nightmare. Please realize that not all the illegals from Mexico were able to file for a visa that could take years to get if able to obtain at that. They've come to do work and they have high praises by many companies. Even the military said Hispanics rate highest in obdedience, less compliants and less dropping out. Some of the Mexicans are used to working hard and they labor much better than us Americans. They make us look quite 'soft.' But we'll learn to 'Reach and Bend Over' and harvest our own AgJob fields in the future, right? See you in the fields, Mary!

Comment No. 12, Why is it that Norman isn't going to enforce this law - only to those that are picked up for criminal charges. It's a university area and they don't want the disruption. Oklahoma has shamed itself by being a racis, KKK state. And to think I was born there! I'll never return now!!

why are hispanics (mainly illegals) so racist?

This is not a race issue to insist that those who come here to share in the american dream and make $$ have either a visa or related documentation or make a effort to become citizen.

My own mother took 3 years to become citizen and another 4 years to learn English.

Never during that time was she 'by any defination' a illegal.

Wanting to be here is great.. but u need to become citizen to stay or have proper visa.

Period.

There are even 'legit' americans who are being forced to 'pretend' to be illegals to even get jobs (not locally).

I myself personally know of a few, but will never ever reveal there names.

Illegals are in fact taking jobs away from citizens and not even just the socalled lowend jobs..too..

Whats going on with illegals has no comparison to blacks or any other race or peoples.

While blacks were brought over here (many were sold by their own familys and by black traders btw). Many became citizens as soon as we got away from the slavery b.s.

Nearly none avoided citizenship like most hispanics do.

Is it me, this isn't just about Mexico, it applies to Chinese,Japanese,Canadian,British,Saudi,German,etc. If you want to live here, do it legally, honestly like my Grandpa who had to got thru Ellis Island and sit for two weeks while some so called doctors checked his rash and said, umm "OK". As far as making things better in Mexico, I'm all for it, drop China a the favored nation and start making all those toys down there, at least it would be on the continent, and probabley safer. We already send our hot college girls down there for Spring Break. Lets get it going "Hecho in Mexico" boycott China guys. Ok, off on a tangent here. Horrah for the Constitution and the Judge. P.S., I agree Columbus started the invasion not a discovery, but hey that was then, and my kids are Cherokee/Scottish.

Happy, there are some things that we can agree upon. I think what is very important that people, all people that is, not forget is that when faced with watching your family starve or doing what is necessary to keep them alive, most people will gladly accept the struggle to keep their families from starving. Don't get me wrong! I am not condoning breaking the law. And like I said, I myself wish I had entered this country legally. But honestly, you have to see both sides of the coin. Lets say just for fun that America's economy takes a turn for the worse, something on the scale of the Great Depression, and now you have no job or the you have is paying you peanuts. You can't find better work anywhere and your family is getting skinnier and skinnier. But hey there is Canada to the North. You know it is illegal to go there and work without permission, but your family is starving and you can't pay your bills anymore. If you could only get across you could find a good job that would pay you 5 times what make now and allow you to feed your family. Wouldn't you go? Trust me this is not an exaggerated situation. My father died of cancer when he was 39 and my mother is disabled. I was the oldest, so I left school and went to work... but the jobs in Mexico stink cause the employers there are also taking advantage of their workers. All we had money for was beans and rice, and even that was not able to feed my brothers and sisters. So I came here and found plenty of work for good money. I know that there are alot of illegal immigrants who are on state funded programs, but remember that in order to qualify for those you have to be poor. I don't think that they are looking for a free ride, I think that most are just looking to survive. Sending them back to Mexico is like sending them into a death trap. That is why I can't support this law. I am from Mexico I know what it is like, change there will take a long time, and in the mean time people are starving. But I understand your concerns as well, I am just saying that many don't even ask themselves why we are here.

HEY RICARDO, I'm getting about nauseous reading you typing over and over again about how are we going to get Big Macs cooked, houses built, etc. Lemme tell ya something..I live in an area where we haven't been very badly invaded (thank you God!!) and guess what? I don't pay any more for a Big Mac here in Ohio than you do there! And AMERICANS make them! High school kids, kids working their way through college, senior citzens...you know, Ricardo, all the people who did those jobs BEFORE the illegals got here! AMERICAN guys/girls build the roads/houses, etc here...just like they did there before OK was so invaded. So why don't you quit trying to scare people? We're not scared! We're looking FORWARD to our laws finally being enforced, even if it IS only a little bit.

Your scare tactics have NO basis in fact! Just an aside...I stopped at a roadside stand here this summer for corn on the cob. I asked the young girl (American) selling the corn who harvested it. She said she and her high school friends...AMERICAN KIDS...did all the harvesting! Imagine that, Ricardo! Americans WILL do those jobs! So much for "omg!! who will make the hamburgers?"
