U.S. citizen arrested under state's new anti-illegal immigrant law, Hispanic advocate says

A U.S. citizen was arrested under the state's controversial new anti-illegal immigrant law overnight in Tulsa County, an opponent of the law said Thursday.
The woman was arrested for transporting her boyfriend, who was an illegal alien, said the Rev. Miguel Rivera, president of the National Coalition of Latino Clergy and Christian Leaders.
Under the law, which went into effect at midnight, it is a felony to knowingly transport an illegal alien.
A spokesman for the Tulsa County Sheriff's Office couldn't confirm the story.
''We are going to continue transporting our fellow Latinos no matter their status,'' Rivera said.
If taken to jail, Rivera said he will sing and preach there and continue fighting against the law.
Rivera and the Rev. Victor Orta said Thursday that they have faith that U.S. District Judge James Payne will eventually declare the law unconstitutional.
A challenge to the law is pending before Payne, who refused to issue a preliminary injunction to block the law Wednesday.
If Payne does not rule their way, they said they are ready to take the case to the 10th U.S. Circuit Court of Appeals or the U.S. Supreme Court.
Rivera said that Hispanics have lost faith in the Tulsa County Sheriff's Office and the Tulsa Police Department, despite assurances from those agencies that they don't intend to enforce the law against people who aren't found committing other crimes.
Rivera said he is telling all Hispanics to call the FBI anytime they need police because Tulsa and Tulsa County officers will check the residency status of crime victims and witnesses.
He also said a list of 30 to 33 incidents of illegal racial profiling by Tulsa-area police has been referred to the U.S. Department of Justice for investigation.
Tulsa County Undersheriff Brian Edwards said the sheriff's office is only checking the residency status of people who are arrested, not victims or witnesses.
''You shouldn't be afraid to call the police,'' Edwards said. ''The last thing people need it to live in a state of fear.'' Edwards said he is frustrated by Rivera's comments.
''I don't know why they're not working to help as many of their people as possible to become legal,'' Edwards said. ''It seems like an all-out assault on us for enforcing the law.''
Edwards said he wasn't aware of anyone being arrested in Tulsa County for breaking HB 1804 as described by Rivera.

You break the law, you go to jail. Not like the person(s) didn't know the law was going into effect...

Illegals aliens and there co conspirators are not above the law. I expect the police officers to continue to do there job. GOOD WORK officers. You cannot transport criminals in this country. Period. I hope they get the harshest punishments. They really dont want to start a war between them and the police.

That's actually not true, Dover. This law goes WAY beyond typical aiding and abetting laws. If you rob a bank, I can still give you a ride to the grocery store or let you sleep in my guest room. What I cannot do is actively help you avoid capture. Under this law you cannot give shelter or transport an illegal under any circumstances. So, this law treats illegal immigrants worse than murderers.

Nice choice of headline there TW. When I clicked on this I expected to see a story of a legal who was arrested because they were a suspected illegal. Come to find out (if this story is actually real and Rivera's not just trying to pull a cause out of his A: "Edwards said he wasn't aware of anyone being arrested in Tulsa County for breaking HB 1804 as described by Rivera.") the person was actually arrested for transporting an illegal. Which by the way, IS NOW ILLEGAL HERE.

Well good. It sounds like the law is already working. I would be willing to let this girlfriend off the hook if she can prove she was transporting her illegal boyfriend out of the state FOR GOOD.

Actually, Oxford, you're wrong. If you rob a bank and I know it, it *is* illegal for me to drive you to the grocery store or let you sleep in my house. That is, in fact, the definition of aiding and abetting - it's not about abetting the *crime*, it's about abetting the *criminal*. These people are knowlingly and flagrantly helping criminals circumvent the law. I'm not going to cry any tears over that.
My favorite part of the story, though, was the preacher claiming that if he got arrested, he would continue to "fight the law" in jail. Yeah, that's exactly the kind of minister we need working, and that's exactly the kind of attitude that says "I want to be a vital part of this community." Nothing says good relations like rebelling against the law to protect avowed criminals at the expense of the (real) citizenry.

it's always been illegal to knowingly transport illegals. this law has not made anything illegal that wasn't illegal before.

It is about time that we stood up for your country. Soliders are fighting for our freedom and we are letting others take over while they are gone. This is America we speak english and we fly the AMERICAN FLAG! The schools will save alot of money when we go back to printing everything in english. This is a good law. Illegal aliens are not under our constitution until they become Americans.

It is a shame that people with no knowledge of the law make comments like "get legal" just for your information "you can't" it is not a matter of following the law or not, this ilegal inmigrants where lured to come for the american dream, they are not lazys, thats way our profitable companies bring them, is to work for cheap salaries and do work that most of you don't want to do, so educate yourselves before showing the hate in your heart toward people that you don't even know. I will love to have all this people with such hurry to judge others become an "Ilegal inmigrant" for a year and then we acn listen to their comments on the matter, have a blessed day !

If the "reverends" are violating the law then they should be arrested and charged. They should also lose their tax-exempt status. How long are we as taxpayers going to allow so called "reverends" to beg for donations and still remain tax exempt.

This law is unconstitutional. I hope the judge finds it so. What about those Americans in Tulsa who are legally married to an illegal immigrant? The law doesn't account for these families now! Do they go to jail now for being caught in the same car with their spouse? ridiculous. These Tulsa laws are breaking up families. Illegal and immoral... Tulsa World - I'd love for you to do a story on that. I have examples for you!

To all the illegal aliens who are now worried about their status in this country: instead of fighting our laws tooth and nail and lobbying in our courts (who apparently don't have any patience with your whining, anyway, if Judge Payne is any indication), here's a novel idea. IF YOU WANT TO BE CONSIDERED AN AMERICAN, THEN YOU NEED TO START FOLLOWING THE AMERICAN LAWS LIKE EVERY OTHER AMERICAN HAS TO. I'm sorry, people, but there is no such thing as "cafeteria Patriotism" in this country. ALL AMERICANS ARE HELD ACCOUNTABLE FOR FOLLOWING AMERICAN LAW. IF YOU DON'T WANT TO DO THAT, THEN BE QUIET AND GO HOME.

While the Headline is true, it sounds like the police did something wrong. When you read the details in the article, the law WORKS.
Why do ILLEGALS IGNORE our laws about Immigration, and INSIST we must obey the law as they see it.

I am so PROUD of you OKLAHOMA LEGAL AMERICANS.
Our voices need to ring LOUDER with OUR support.
Yes - these so called leaders need to help their people or any person that is not here legally to the DOOR of the office to GET LEGAL.
I would think that they would be falling over each other to get LEGAL. So they could stay here and continue their lives. And HOW long have they been here and had plenty of time to make it happen.

"Don't trust the police, advocates tell Hispanic community." With that philosophy then we shouldn’t trust ANYONE for just doing their JOB. What is it that the Hispanic community doesn't understand about the LAW? Now I understand, it affects them.
Become a law abiding citizen within the system. WELCOME TO AMERICA…

if law of the land starts to invade upon God's law, the reverend has a moral responsibility to do what is morally right! I'm glad he is. This law is unconstitutional. Politicians are turning a blind eye on what this is doing to Oklahoma families. Thank you William for your comment too!

To Angela, Post #14: Let me explain something to you, hon. This law is NOT unconstitutional. The U.S. Constitution applies ONLY to AMERICAN CITIZENS. Illegal aliens are NOT American citizens, therefore they HAVE no constitutional rights to BE violated in the first place. This law is NOT breaking up Hispanic families. The truth is that the Hispanics who refuse to follow our laws and live in this country LEGALLY LIKE EVERY OTHER IMMIGRANT IN UNITED STATES HISTORY HAS ALWAYS HAD TO are doing THAT to THEIR OWN FAMILIES. If that's a problem for you, then maybe you should consider going back to Mexico with everybody ELSE who has a problem with it.
