U.S. citizen arrested under state's new anti-illegal immigrant law, Hispanic advocate says

A U.S. citizen was arrested under the state's controversial new anti-illegal immigrant law overnight in Tulsa County, an opponent of the law said Thursday.

The woman was arrested for transporting her boyfriend, who was an illegal alien, said the Rev. Miguel Rivera, president of the National Coalition of Latino Clergy and Christian Leaders.

Under the law, which went into effect at midnight, it is a felony to knowingly transport an illegal alien.

A spokesman for the Tulsa County Sheriff's Office couldn't confirm the story.

''We are going to continue transporting our fellow Latinos no matter their status,'' Rivera said.

If taken to jail, Rivera said he will sing and preach there and continue fighting against the law.

Rivera and the Rev. Victor Orta said Thursday that they have faith that U.S. District Judge James Payne will eventually declare the law unconstitutional.

A challenge to the law is pending before Payne, who refused to issue a preliminary injunction to block the law Wednesday.

If Payne does not rule their way, they said they are ready to take the case to the 10th U.S. Circuit Court of Appeals or the U.S. Supreme Court.

Rivera said that Hispanics have lost faith in the Tulsa County Sheriff's Office and the Tulsa Police Department, despite assurances from those agencies that they don't intend to enforce the law against people who aren't found committing other crimes.

Rivera said he is telling all Hispanics to
call the FBI anytime they need police because Tulsa and Tulsa County officers will check the residency status of crime victims and witnesses.

He also said a list of 30 to 33 incidents of illegal racial profiling by Tulsa-area police has been referred to the U.S. Department of Justice for investigation.

Tulsa County Undersheriff Brian Edwards said the sheriff's office is only checking the residency status of people who are arrested, not victims or witnesses.

''You shouldn't be afraid to call the police,'' Edwards said. ''The last thing people need it to live in a state of fear.'' Edwards said he is frustrated by Rivera's comments.

''I don't know why they're not working to help as many of their people as possible to become legal,'' Edwards said. ''It seems like an all-out assault on us for enforcing the law.''

Edwards said he wasn't aware of anyone being arrested in Tulsa County for breaking HB 1804 as described by Rivera.

All the Police have to do is Stop any school buss, and arrest the driver for transporting illegals.

The term should be "illegal alien" because "immigrant" implies the person immigrated here legally. It is an oxymoron to put illegal and immigrant together.

ma...this may surprise you, but the jews killed in germany, or the slaves in the underground railroad, were NOT illegal aliens. they weren't breaking any laws.

Go back home, get in line and do the paperwork then you are very welcome here until then you are a criminal and broke the law, what has happened to common sence in this country and whats up are they wanting to drive it to full confrontation, getting tired of being told how we should act and think by the minoritys in this country...

#3 Oxford - You will not be arrested for merely transporting an illegal. You have to be in a situation where you definitely would know his status, not just be suspicious. If the illegal person was a relative of yours, and you took him to work or allowed him to live with you, that would be a crime.

.

Rivera is from New Jersey. His telling people to call the FBI instead of police is foolish and irresponsible and could cause someone to die. Does he care? No, he'll be in some other state, operating politically as usual.

I don't understand how the law is unconstitutional? Dosn't the constitution start out with "We the people of the UNITED STATES". Not, "We the people of Mexico and the United States."

If im not wrong a while back the tulsa sheriff made a statement that he was deporting "puerto ricans"... arent they U.S. citizens..so i guess hes deporting them to their native island. So i do believe that they are racial profiling...they cant even come up with real facts, nor get educated that not only white skinned "folks" are only american.

Im not in favor of the law...but im glad it passed...this way Tulsa will see the effect the law has. I have respect for hispanics...they do jobs i would never do. While we get our "school titles" and get good jobs, they do the cheap labor we dont do...whats wrong with that? we are still getting the same pay check.

I guess this law was expected anyway...i mean our senators do not even believe in global warming...so how can we not expect them to make such a bogus law that is completely racist but covered with the words "taxes and american"...that sure grabs everyones attention.

And the ignorance of "get legal" im sure everyone would be legal if the government made it so difficult for them to do so. How can they become legal when everyone is closing the doors for them...

Now the big questions for all of you "christians" outs there...what would jesus do? im sure he'd make a law and treat hispanics worse than criminals.

GET REAL.

And by the way, Oxford, if you insist on supporting these folks, then why don't you go back to Mexico with them when they leave? Because you know what? Sooner or later -- and it's already started -- more and more REAL Americans are going to start seeing less and less reason to support these foreigners who, like Gary said, take and take and TAKE from our economy and CONTINUALLY ABUSE THE LEGENDARY GENEROSITY OF AMERICA AND AMERICANS, and they're going to deport EVERY LAST ONE OF THESE FOLKS WHO IS HERE ILLEGALLY. If you don't like that, then you can go with them.

Katie - you saying I'm wrong doesn't make it so. I posted the case law that clearly takes my position. You responded by saying "nuh uh". That isn't what we call a cogent legal argument. Illegal aliens have limited rights under our constitution. You said, "They are here illegally and the constitution doesn't support that." Of course they don't have a right to be here in our country, but they still have limited consitutional rights, such as the right to counsel, the right to be free from unlawful search and seizure, the right not to self incriminate....and so on. The fact that you are a law abiding citizen doesn't make you a legal scholar. That is why we have law schools, which you obviously didn't attend.

#116...Cheap labor? Your obviously ignorant. Cheap = corporate welfare. Example: pay $6.50 per hour cash only becomes more like $20.50 with benefits. You know who pays the difference? (go get a mirror, you the taxpayer does) When companies hire "cheap labor" they transfer their obligation to provide benefits to the taxpayers or commonly called "corporate subsidy". Further, have you noticed a cheaper price in your housing? how about landscape? how about factory orders? restaurants savings coming your way also? Fact: consumer doens't get the "savings" , companies make more money. Fact: companies are making money, they simply want to make more money at expense of sovreignty of this nation. Suggest you read more....

Bravo to the Legislature and the Governor for taking a stand. After recently moving here from California, it is refreshing to see this state actually attempt to deal with this difficult problem. To those who don't like this law, challenge it in court. Even better...LEAVE and go somewhere where you would be happier.

I am here to give my opinion on this issue. It is true that Hispanics are for the most part hard workers with strong family values. I have worked with and lived in the same neighborhoods that they have settled in and revived. However, I do have to agree with the fact that an illegal alien is not a U.S. citizen and not protected by the U.S. constitution. My point being I have no problem working or being neighbors with Hispanics, if they are legal citizens, paying taxes and following our laws.

Illegal’s are in this state because US Companies keep hiring them. The US is already in a recession, the US Dollar is losing ground against the Canadian Dollar, the EURO, the Chinese Yuan and the Japanese Yen. Its all about supply and demand, there will always be illegal’s if US companies keep hiring them. I hope you all get ready to start paying high prices for the services that where done before by Hispanics and now are going to be done by white or african-americans, that will never work as HARD as an Hispanic and are going to request to be paid much more.

If these stupid remarks made by Rivera and Orta to not trust Police cause what I believe it will, they need to be arrested. Mark my words, more pursuits, more violence against police, more police involved shootings. These guys are inciting riots. The law is the law, deal with it.

I agree with #93. They are looking for a free hand out. Now I am all for them coming here, becoming a legal citzen, paying taxes, working. But when they take away from our oun people then it time to go the "honeymoon is over!" Now maybe my non hispanic husband can find a job.

all touting the bill 1804 for ITSELF. The fact that "you"/some of "you" are just RUDE

when you are in a HOST country is a "side" issue. We really don't want you here at all.

Or your rudeness. Hope you don't need a ride one night after "work". It's illegal to "transport" "you" now.
