Police say limited resources may hinder enforcement of new immigration law

OKLAHOMA CITY -- State law enforcement agencies say limited resources may prevent them from enforcing a new state law that targets illegal aliens.
"As far as I'm concerned, it's going to be business as usual," said Scott Jay, Beckham County sheriff. "I don't see where it's going to have any impact at all on local law enforcement."
The law requires local law enforcement officers to check the immigration status of anyone arrested for a felony or a DUI in a federal database known as the Status Verification System. Undocumented immigrants who are arrested for a crime must be jailed without bail and reported to federal agents.
"I'm already getting calls from citizens saying so-and-so is illegal and so-and-so is illegal," Jay said. "I think there is a misconception by a lot of citizens who think we are now going to go out, round up all the illegal immigrants and shoot them back down to Mexico. That's just not going to happen.
"We don't have the time, the facilities or the manpower."
In fiscal year 2007, U.S. Immigration and Customs Enforcement deported 7,400 illegal immigrants from its Dallas-area district, which includes Oklahoma. Of those deported, agency spokesman Carl Rusnok said 4,950 had been convicted of a crime.
"We already work very closely with local law enforcement agencies in Oklahoma," Rusnok said. "Will we get more calls for deportation because of this new law? Who knows? If so, we'll accommodate as we can...
"But, as always, we will prioritize our resources."
Roger Mills County Sheriff Joe Hay already thinks the new law creates a great dilemma for him.
"I've got a 28-bed jail with 22 prisoners already in there," Hay said. "Now I'm sworn to uphold the law, but where am I supposed to put them?"
In Enid, officers won't add immigration enforcement to their list of duties, said Capt. Dean Grassino.
"We're not rounding people up," Grassino said. "We'll cooperate. If they do an immigration enforcement action, we'll assist. But we're not going to send officers out to businesses to check workers' papers and stuff. That's stuff we're not going to do."

I would certainly hope that if a law breaker does not have proper identification that law enforcement would follow procedures to determine if the person is legal or illegal. And, if illegal, ship them back to their country of orgin.
...
I get the feel that some of these law enforcement agencies are gearing up to sock it to the tax payer in the form of "WE NEED MORE MONEY". I could smell this coming a mile off.

Yeah, local LEOs just might not want to be bothered with such a thing as upholding the law. No room? Take some lessons from Sheriff Joe Arpaio (Arizona) and his "tent city." He's got barbed wire fences surrounding tents housing 2000 prisoners and can expand for more. The compound is patrolled 24/7 by armed guards. Good job, Joe. We need more like him.

#2. When you suggest putting illegal immagrants in camps composed of "barbed wire fences surrounding tents housing 2000 prisoners and can expand for more. The compound is patrolled 24/7 by armed guards," I grow concerned. How quickly we forget the images of the concentration camps of Nazi Germany.

Maybe some of the money that these people are costing us taxpayers could possibly go to help the cops do their job. How about a bond issue Tulsa, the money you would have spent on riverside might be spent to get the city back from these suckers.

Invasion of America by Foreign Nationals and we haven't got Manpower?????? Jeez Louise! Use the National Gaurd!Or do we wait until this thing gets more Violent than it already is? Our Military needs to be come home to fight this Invasion.

#8 answer... Invaded nations do not deal in Law.. This is a Military situation, local Law Enforcement were never meant to Handle Invasion by Foreign Nationals.

I hope the sheriffs quoted herein to plan to obey the law and CHECK THE IMMIGRATION status of anyone they stop for DUI or a felony. That is what the law requires. I assume they will NOT be letting these people go free on the DUIs or felonies, so their whining about jail space doesn't make sense, they would be jailing these people regardless of status.

The law doesn't ask them to go out anywhere just to check status. So they don't need to be saying they won't do this, they won't do that, just to inform ignorants who don't know the law. I don't like their attitude that they think they can pick and choose which laws they plan to enforce! Let's say THAT is not gonna happen!!!

I am so horrified of what I read sometimes. There are illegal mexicans that were brought here by their parents when they were too young to even know what was going on. Now they have been raised in this country, taught how we were all taught, and live the way we live (and pay taxes, imagine). And now they fear for their lives as so many people talk about sending them back to somewhere they do not know anymore. I just wish there was another way to handle this. Somebody fill me in, is it only those who get arrested for DUIs and felonies that are being sent back? The love of my life is afraid to let me drive with him in the car for fear of my being taken to prison for "transporting an illegal alien". This just doesnt seem right.

#11, it is not right that you -- who are so involved -- do not know the law. What have you been doing the past several weeks???Educate yourself by reading the law, which is available on this website, and the past articles that summarize the law. Do yourself a favor and don't read all the TW articles on this law, though. They are yellow journalism designed to inflame and alarm.

Illegal is illegal. Doesn't matter what race you are. If you are breaking a law, you should suffer the consequences. If you don't like our laws, then maybe you should pay attention to what you have learned. Take that lesson back to your country and make a better life for yourself and your family. We fought for our rights and laws. You should do the same in your own country.

how can we be so critical of familys wanting a better life. if everyone wants to get legal about it, then that means everyone from another country should go home. i know many people who are not legal and its not just mexicans. and by the way these mexicans do get taxes held out of their checks but do not get a tax refund. some people can work the system and get taxes but most do not. what about the people that are citizens that take advantage of the welfare system. there goes taxes for lazy people. but no one whats to bitch about this. everyone wants to point fingers, we are in the so called bible belt of the world and we have these issues. what happen to helping people of the world. what we need to do is run out the child molesters, harden criminals, murders, rapists and so on and sent them to fight for them selves, but no we will keep using tax money for all theses idiots. we feed,clothe medical and provide a roof over their head for free for years and years. why so much anger for people wanting a better life. and no i am not with and illegal of any sort, just a concerned citizen. we need to put our priorites in the correct place.

Hey Ricardo, let's talk about New Jersey, shall we? An illegal alien from Peru, whose seriously vile criminal record, who had been molesting a 5 year old child repeatedly, after being caught, was released by a judge with only 5,000. bail, went out with fellow illegal alien gang-bangers, attacked, raped the two females, shot all four African American students, murdering three of them, execution style.
New Jersey politicians, on the take from La Raza and other Hispanic supremecist groups have attempted to silence discussion of the travesty that illegals have perpetuated there, won't be in office much longer.
Is that what you are threatening Oklahoman's with, Richardo? The American citizen will not fold and take your vile threats. We won't tolerate it. What you are seeing is proof of that, and it's not going away. So you and your illegal alien gangs better be prepared.

jc - we all want the freeloading to stop, not just the freeloading by illegals. and i don't know how you happen to know so many illegals, but they should all go home if they are not legal residents. the illegals use more services than they pay in taxes, that has been shown in a government study as late as 2002. i'm sure the cost of services they use --including public schools -- has only gone up since 2002. if you come from another country to profit by hard work, yet you cost that country more than you benefit it, well -- that's freeloading, in my book.

American citizens aren't lazy, but perhaps lazy minds like yourself, who want to destroy American wages for more profit for yourself aren't bright enough to figure that out.
This isn't about a "better life" for people, it's about undermining the rights and freedoms of American citizens, who are black, brown and white. American citizens who have done the jobs, paid the bills, whose sons and daughters are now fighting in Afghanistan and Iraq. Who fought in Vietnam, WW I & II.
Who worked hard for better wages and opportunities for themselves and their children. What the illegals are about, are being thugs for hire, by the US Chamber of Commerce to destroy even the minimum wage, workplace protections and even environmental protections. They aren't intelligent enough to realize that once this is achieved, they will be as stuck in the same situation they claim they sought to escape.
They aren't harder working, they demand lower wages, but then demand welfare to make up for those lower wages. The Bush administration and corporate elite demand that we nationalize the burden of illegal aliens, so they can privatize the profits. This causes our taxes to go higher, while there are less services, less health care, less education for our children.
You can't spin your way around your lies, get over it. We're done accepting this garbage.

I don't have any problems with hispanics who want to live the dream legally. There are organizations to help these folks become citizens. The majority don't pay taxes because employers pay them cash. They use fake names on documentation and change them about every year or two. These employers need to be held responsible as well with fines and if continued, jail time.

SO...It is unfortunate that their parents didn't care enough about the welfare of their children and brought them into a country where they would be illegal. I can feel sorry for these individuals but you can't ignore the laws. They also should return to the country of their birth and if they are angry at anyone, it should be their parents.
But, the good news is that they are still young enough to apply, wait, and come to the U.S. legally and be welcomed back some day.
Also, they may find out that they love the country of their origin and then resent their parents for taking them away for so many years. At least at that point, it would be their choice for the first time in their lives. And, if an American citizen has fallen in love with an illegal alien, as it seems you have, you could always go with that person and start a new life yourself. I'm sure there's room for you there with so many of them leaving the country. You see, it's not so sad after all!

Division Headquarters are in Mexican Border Towns.
Batalions are located in Large U.S. Cities.
Companies thru Squad level are located in various small U.S.Towns and Work Places.
These Groups are aided by various Marginally Legal Covert Groups.
A Rose is a Rose by any other Name it is still a Rose.
Bring Our Troops Home tp Fight this Passive Invasion of Foreign Nationals.

JC, your comment that "everyone who is from another country should go home" is completely ignorant...
Do you mean that anyone who isn't Native American should return to their ancestors' countries of origin? Assuming you are Hispanic, then I'm afraid that would include you, too... (Take a look back in history, and you'll see that many Mexicans and other Latin Americans have Spanish blood in them--not too different from 'Anglos' having British blood...).
The simple point is this: Most non-U.S. citizens in this country are here LEGALLY (that means they have the stamps in their passports). Some, however, made a wager that the benefit of being in the US offset the chance of being caught... It's a gamble -- and, when you make that choice, you should have the courage and responsibility to face the consequences... Such people are trespassers, and these are those whom the law targets (NOT those in the country legally).
Finally, you raise the point about child molestors, etc... who should be deported. Unfortunately, most Senators who supported the 'comprehensive immigraiton bill' (including Hilary Clinton and Barak Obama) thought such people should stay in the country. Take a look at the Cornyn amendment, and you will see who stood for whom...

As a follow-up to all of you concerned about the new law, I have a question that I would be most grateful if you could help me understand.
Given the underlying debate about 'illegal' immigrants (which I define as non-citizens who are in the country without express permission from the United States government), why is it that you seem to believe that the United States does not have the right to have (let alone enforce) a set of laws to determine who can come into the country, and in what capacity? Also, why is it wrong for the United States to have (and enforce) a strict immigration policy, when it is ok for Mexico to do it?
In particular, how can the Mexican government criticise American immigration policy when they themselves cause even more suffering for 'undocumented' migrants and their families (such as those from El Salvador, Guatamala, etc...)? Where are the protests for their rights in Mexico??

All this new Oklahoma state law does is to repeat and reinforce existing federal laws that have not been enforced by our spineless federal authorities. There ought to be another law which would mandate the payment of a cash reward to any U.S. citizen who makes a "citizen's arrest" of any illegal alien who is subsequently deported, with the deportation order specifying that the cash value of any and all assests seized from the illegal alien via "assest forfeiture" be paid to the person who apprehended the illegal alien once the cost of jailing, prosecuting and deporting the illegal alien has been deducted from the proceeds gained from the aforementioned "assest forfeiture". For those bleeding heart liberals and supporters of illegal aliens who may complain that this proposal constitutes declaring "open season" on illegal aliens by allowing American citizens to personally profit from apprehending them, I say: "Yes. It is a good idea which will benefit American citizens who act on behalf of the best interests of the USA by enforcing the rule of American law". Only criminals have anything to fear from the enforcement of our laws governing legal residence in this country. I personally love to read stories about how illegal aliens "live in fear" of being apprehended and deported. That's exactly how it should be. They need to be afraid, very afraid, so afraid that they go back to where they have a legal right to reside. It is called "self deportation" and it works like a lucky charm.

Woops, I meant to write "asset forfeiture" in my previous posting.
Don't think that this is some fanciful idea which can't be applied to illegal aliens, as it has already been successfully applied.
Do a search for "asset forfeiture" +definition at google to find information on this legal concept.
An excerpt from a relevant article follows: "A law that prevents criminal fugitives from contesting the civil forfeiture of their assets applies to people who have never been in the United States but know that entry into the country will lead to their arrest, the 2nd U.S. Circuit Court of Appeals has ruled.
Taking its first look at the fugitive disentitlement provision of the Civil Asset Forfeiture Reform Act of 2000, the circuit said the plain language of the statute makes it clear that disentitlement "extends beyond common-law fugitives" in Collazos v. United States, 02-6324.
Stella Collazos, a Colombian national, had been indicted in the United States for running a multimillion dollar money laundering operation from Cali that federal authorities say was used to hide and funnel drug sale proceeds.
A total of $1.1 million was seized by investigators in 1996 from an account in Collazos' name at Prudential Securities in New York.
From outside the country, Collazos sent an attorney to claim the seized money.
But Southern District Judge John E. Sprizzo ruled that Collazos had no claim on the money because she refused to enter the United States to face criminal charges. The ruling was based on the Civil Asset Forfeiture Act of 2000, 28 U.S.C. §2466."
