Edmondson doubts immigration law will be overturned

OKLAHOMA CITY -- Oklahoma Attorney General Drew Edmondson said he doubts the state's controversial new immigration law will be overturned, but he added the measure has caused state government some problems.
"If there are any positive aspects of 1804, we are not going to see them in the short term -- that's if we ever see them. We are seeing many negative impacts immediately," Edmondson told the Governor's Advisory Council on Latin American and Hispanic Affairs on Monday.
"It was my obligation to defend this. I only have to argue the legality of it. I'm very grateful I do not have to argue the morality of it."
Two months ago, some state legislators requested a legal opinion on the law from Edmondson. Their request included 24 questions regarding the measure.
One related to the possibility of legal citizens being detained because law enforcement officers assumed them to be illegal immigrants. Another dealt more directly with possible racial profiling.
Edmondson told the group he would not answer any of those questions with a legal opinion. He said all questions would be answered at the conclusion of a lawsuit challenging the law's constitutionality.
"We are sometimes called to defend the state. On some occasions, we enter into those defenses with a great deal of enthusiasm," Edmondson said. "In some cases, we enter into those defenses because we are required. In this case, we are defending the law because we are obligated."
The law denies driver's licenses and public services to illegal immigrants and criminalizes transporting, concealing and harboring illegal immigrants from detection or in reckless disregard of citizenship status.
The law's author, Rep. Randy Terrill, R-Moore, is contemplating another proposal that would seek to seize the property of those prosecuted under the statute if their property was used in commission of the crime.
Other provisions would call for an audit of the public education system to follow money spent on educating illegal immigrant children, as well as denying birth certificates to children born in this country to illegal immigrant parents.
"I still believe this is a federal obligation, not a state obligation," Edmondson said. "Hopefully, the Legislature will craft something that will modify it rather than having a 'Son of HB 1804.' I think the solution is back at the Legislature."
Two speakers at the meeting broke down in tears while speaking about how it has affected their community.
"It is not a secret that the apples, peaches, potatoes and cotton are either processed or harvested by Hispanics," advisory council member Nancy Galvan said.
Galvan said Hispanic labor has done much to bolster the state economy, and Hispanic people have tried hard to contribute positively to the Oklahoma culture.

It is clear that the people of Oklahoma support 1804. With that in mind it certainly appears that the office of Attorney General is ripe for a new candidate. Considering his comments it is hard to imagine that the present A.G. will vigorously defend the bill. It sounds like he is giving it lip service and hoping for an adverse ruling. He fails the people who elected him in going down that path. His criticism of the bill was ill advised and outside his purview.

I hope the law is NOT overturned. I am so tired of watching illegals use welfare! What really gets to me is the fact that illegals can get medical and dental care and legal citizens who can't afford insurance cannot get the same care. I am one of those people who can't get medical and dental care. I have a heart problem that causes me a great deal of pain and numbness, but I don't go to the ER or doctor because I can't afford it. Look at the ER's before this law went into effect; they were full of people that were not Americans. Legal ones - you stay - you deserve it. The rest need to go home and stay there.

Hello, although the Mexicans are the most visible, Why stop there ,the gangs, crips, and bloods,are leading causes of violent crimes, as well as the mexican mafia .and as to welfare abuse, the Religious cults, condoning multiple young wives , all are on welfare, as are the teenage unwed., and just the plain trashy people, seem to about all over the place asking for handouts, of one kind or another.,if it walks like a duck, and looks like a duck, it probably is a duck.thats what Im talking about.

Tes I hope also the law is NOT overturned. I feel the children of illegals suffer because they are made by thier parents to do all the translating from Spanish to English and back again. They lack the support of parents who do not understand the language so thus they get no help with thier education in order to become legals. I do however feel that if they have been here and have no criminal record it should be made quicker to get them the legal status. I live out north of Admiral and mostly hispanic speaking people reside here and I worry every day whether driving will become a problem. No insurance, no drivers liscense and the such

I am tired of paying for illegals and their offspring. It is time for citizens to help citizens that need help. It is just the right thing to do. As far as being here already..... I totally disagree with rewarding someone who knew they were doing something illegal in the first place. I believe the ones waiting in Mexico and have done things by the book should be expedited as quickly as possible. The border jumpers need to be punished and not even allowed to apply for 10 years. This country has thrived just fine before this mass invasion and Im am very grateful HB1804 is in place. Hopefully the border jumpers will go elsewhere. I am tired of them sucking off oklahoma. Lowering the value of homes and trashing out tulsa

How is it not moral to treat criminals like criminals? if you don't have anything to hide you shouldn't mind being stopped. I guess the drunks think it is racial profiling to have road blocks to check to see if you are drunk driving.

Political dynasties, state and national, are not healthy for our republic. Have to give Edmondson credit - he makes no secret of whose side he is on in this battle and apparently feels he has no moral duty to the LEGAL citizens of this state who pushed for the passage of HB 1304. Wonder what he would do should he ever (God Forbid) be elected as governor.

This will be a huge campaign issue in 2008. Governor Henry will never sign a "son of 1804" into law so be sure you watch how YOUR Senator and Representative vote on this issue. Call their offices and find out where they stand on this issue. Don't let them straddle the fence!

I agree with all the posters who said we need to keep our elected officials accountable. Accountable to us, the legal citizens of this state and nation.
Solving the problem in Oklahoma (if that is even possible), will not solve the issue for the nation.
We need to start electing people who give a hoot about the qualilty of life for the majority of Americans. It's tough to find candidates who have not sold out, but we need to ask the real questions and expect real answers.
They are paid by our hard work. Those of us who are not wealthy foot the bill for most of this nations expenditures.
If we have an elected official who feels it's morally wrong to enforce the law and protect the interests of legal citizens, perhaps we've made a mistake.

# 1 - Janet - Well said, I agree that we should all watch Edmondson & how this plays out. It's very obvious that he would rather not have to deal with this at all. The old ""Fed-problem" dodge --very wimp-like .As this proceeds and he & his staff succeed in defending the law, we should all contact his office to express our thanks and encouragement. Maybe he will realize that the majority of Oklahomans WANT this law in place.

The majority of Oklahomans DON'T want this law in place. That's what all the hubbub is about. Even Edmondson disagrees with the legislation. I hope it's overturned by a judge quickly before Terrill gets the chance to strip all of our Constitutional rights. That bozo Terrill has overestimated his power here - the Federal Govt can handle this.

OH, and why should I be taxed twice to pay for immigration control? The money we give to the Feds every year should cover it. We shouldn't be asked to pay for it at a State level, too.

Andrew - Are you kidding me? That's why over a dozen states are replicating this law as we speak. The Feds don't have the knad's to address this in the least while the states' are bearing the brunt of all the fallout. I'm sick of people telling me I have to keep paying for freeloaders !

Andrew, you much run in tree hugging, save the whale, crybaby liberal circles if you think the People of Oklahoma don't support this law. Only six law makers voted against it and I suspect it will come up as a campaign issue and those six lawmakers will be voted out for treason to the people of this great state..

Which States, exactly? Did you read the story? I can guarantee that any law makers considering this type of legislation read it:

And what do you care what the Feds spend your tax money on? You won't get a rebate once the immigrants are gone. You will still be putting out 25-39% just like the rest of us. You will still be paying high insurance rates. The only real difference is you will have driven the Oklahoma farmers out of business and driven up the cost of construction. That will raise your taxes, too.

The main issue in this debate is whether we maintain rule-of-law, or whether anarchy reigns whereby everyone does whatever is right in their own eyes. Oklahoma has chosen to enforce Tax Laws and Labor Laws, those violating these laws evidently are illegal aliens and supporters of illegal aliens.
The MORAL issue for citizens, our Attorney General and our Governor is simply whether THEY are willing to house, feed, clothe, educate a family of 6 for 50 years + an additional 8-10 family members. NOT whether WE taxpayers should do it. If it is such a moral issue, let THEM and some of our Legislators who want illegals cared for, simply do it on THEIR dollar, not ours.

Andrew, I live in the rural community where a lot of farming is going on. Farming is not done by illegals. It's done by machinery here in Oklahoma.. Most illegals in Oklahoma are congregated in Tulsa and OKC, WHERE NO FARMING IS DONE (BUT A LOT OF DRUG TRAFFICING, MURDER AND WELFARE FRAUD IS)... and don't even get me talking about the "economic impact" of Seaboard, illegals, lies and the destruction of Guymon Oklahoma..

# 27 Boo Hoo, If your a Farmer, then you know all about welfare. Why should my tax dollars support you and your life style. If you are a failure at Farmming, then get a job, not a goverment handout.
