HB 1804 faces a new lawsuit

Read the lawsuit filed in Tulsa County District Court challenging the constitutionality of HB 1804.
A court action filed Thursday asks a Tulsa County judge to declare that a new state law dealing with illegal immigration violates the Oklahoma Constitution.
The plaintiff in the case is Michael C. Thomas, identified as a resident taxpayer of Tulsa County, who seeks "to prevent an alleged wrongful expenditure of public funds by the State of Oklahoma and Tulsa County" for enforcement of an unconstitutional statute, according to the lawsuit.
One defendant is Gov. Brad Henry, "who is charged with the responsibility of seeing that the laws of the state are faithfully and constitutionally executed, including the lawful expenditure of public funds," the court filing states.
The other defendant is the Tulsa County Board of Commissioners, the "elected public body obligated and responsible for the expenditure of public funds required in the enforcement of the extensive provisions incorporated" in House Bill 1804.
The document requests an injunction to prevent enforcement of provisions of HB 1804 until a court hearing is conducted.
Several key provisions of HB 1804 became law on Nov. 1.
The case is assigned to District Judge Jefferson Sellers. No hearing date is scheduled.
One attorney involved in the case is James C. Thomas, a law professor at the University of Tulsa and the father of plaintiff Michael Thomas.
James Thomas, who has filed cases previously on public interest issues, said he needed a taxpayer to be the plaintiff and that his son agreed to fill that role.
Regarding HB 1804, James Thomas said, "I feel very strongly against it."
James Frasier and Steve Hickman are also listed as attorneys for the plaintiff.
In the suit, "we basically ask for the law to be struck down," Hickman said.
The suit states that the challenges it raises to HB 1804 "are premised exclusively upon the Oklahoma Constitution, without any federal constitutional consideration."
The suit asserts that the immigration law is unconstitutional on its face "for the reason that in substance and effect it creates a Bureau of Immigration and allows for the appropriation and expenditure of public funds" in direct violation of the state constitution.
The new law also unconstitutionally delegates legislative authority to federal agencies and other public entities within the state without providing the necessary and adequate standards, the filing says.
HB 1804 "embraces multiple subjects" in direct violation of the constitutional requirement that every act of the Legislature shall "embrace but one subject," the action maintains.
James Thomas said that if a Tulsa County district judge "rules against us on the merits, we will definitely" appeal the matter to the state Supreme Court.
Last week, U.S. District Judge James Payne denied a motion asking him to reconsider his previous dismissal of a federal lawsuit that challenged the same state law.
Among other facets, the new law makes it illegal to knowingly transport illegal immigrants, creates state barriers to hiring illegal immigrants and requires proof of citizenship to receive certain government benefits.
James Thomas said Payne's ruling was based on the issue of whether the plaintiffs involved in that federal case had legal "standing" to challenge the new law -- and not on its constitutional merits.
Rep. Randy Terrill, R-Moore, author of HB 1804, was not reached by phone Thursday for possible comment on the Tulsa County lawsuit.
Last month, Terrill said that "it has been my position all along that House Bill 1804 would withstand any legal challenge brought against it."
When Payne issued a December order to dismiss the federal case, Terrill said, "This is a great day for the citizens of Oklahoma and the rule of law."

Finally, trial lawyers with a winning record have stepped into the fray. The Holy Scripture tells us to respect those who defend the weak. Like Pharoh, the hearts of some people have been hardened towards powerless people, and like Pharoh, they will suffer the wrath of God.

Count on the Illegals to continue raping and pillaging the public treasury. It costs the taxpayer lots of money to defend 1804, which clearly represents the will of the majority.1804 has not been declared unconstitutional,so enforcement should continue.When they say "it's not the money".....IT'S THE MONEY.Law enforcement should establish frequent traffic checkpoints to check for current and legal drivers licenses,current insurance verification,current and legal auto tags,and outstanding warrants.One area that needs lots of attention from law enforcement is apartment complexes parking lots.Check the autos that are backed in to hide the out of state,or expired,or stolen auto tags.This is a non-discriminatory method to make our roads and highways safer.

Perhaps legal citizens need to file suits.
Lack of immigration law enforcement is and has been harming legal citizens.
We DO have constitutional rights. Allowing those here illegally to continually violate countless laws, violates our rights.
Allowing people here illegally benefits and assistance at the expense of legal taxpayers, violates our rights.
Providing special services and education at the expense of the taxpaying legal citizens, violates our rights.
Turning a blind eye to employers who discriminate and hire illegal workers for lower wages, violates our rights.
People here illegally have the right to be treated humanely while being deported.
Those of us (the majority) who support HB 1804 and long existing federal immigration law, do not want to see them treated inhumanely, we just want them deported.
The law against employing illegal, undocumented or falsely documented workers is not new.
Job discrimination laws are not new.
Will it take the majority of legal US citizens filing huge class action lawsuits to ensure our rights?
Countless legal citizens have been harmed by the invastion of illegal aliens. It would not be difficult for them to prove their damages.

Rose, I like that. Maybe we do need to ban together and hire an attorney to defend us. The citizens. I do not have anything against races in America or any other country unless they try to do America harm. Illegal Aliens are not a race, they are a group of people from all over the world that want to do anything they want anywhere they want with no regard for procedures and laws. Other states are working on HB like HB1804 to control this situation in their state our Federal Government has long ignored. These lawsuits against the citizens of Oklahoma need to stop. I find this very offensive and unamerican for these bored attorneys that are obviously just trying to make a name for themselves to attack the citizens of Oklahoma and like Rose said what the majority wants.

Well said Oracle! I have a feeling there's not much going on in the way of enforcement even though the police and sheriff's personnel have been trained by the feds. Our mayor and her chief tried to proclaim Tulsa an official "sanctuary city", but fortunately they had to back off on that idea. I would guess that nothing much is being done by police and sheriff in the way of enforcement. Tulsa is probably an "unofficial" sanctuary city now. Hopefully the Tulsa World reporters will obtain and publish monthly statistics concerning immigration enforcement by police, sheriff, and ICE. Then the public will be able to determine whom to hold accountable for lack of enforcement. I doubt numbers will be forthcoming since the TW seems to be siding with the illegals, judging from the number of touchy-feely articles dealing with illegals and their supporters.

Talk about wrongful expenditure of public funds, what about all the people obtaining public assistance that do not qualify! What about the $80,000 glass cube for mayor KT. I could name a lot of wrongful expenditures but this isnt one of them. I believe the majority of citizens in Oklahoma will say this is one public fund that more than welcome in this state. Lets have a vote on this and end the lawsuit rampage. It is sickening to know their are traitors such as Michael Thomas among us. He obviously has way to much money and time on his hands. Maybe he should consider using his excess money and time to help the homeless americans. Donate his time and money to casinos or something other than this stupidity.

Wake up America. Put more punishment in this bill. We are being invaded. The excuse given is a better way of life. Well Osama was trying to better his way of life. It is time to take back our culture. Take Back our values, Take back our state. The punishment for this crime should be DEATH. Fire up old sparky and send a message to the rest of America and to the Illegal Immigration that we will not be invaded. We learn by our Indian forefathers that weak immigration will result in takeover. We learn this and will not let it happen again. Death to All Illegals is a justice punishment.

So I'm guessing that if Oklahoma had been a state during the Civil War it would have been a Confederate ....and yes, I would say that's a bad thing.
This is a legal question about the State's right to contradict Federal law. It is an important part of our system of laws to continue to examine this issue.
You go, Michael Thomas. Whether you win or not isn't as important as the process of doing it.

Anyone want to wager as to whether James C. Thomas did any of his work in preparing this lawsuit on the University of Tulsa's time. I think I will no longer donate to the University if they are going to have their employees using University time for their own private interests.

I read the lawsuit. the plaintiff states the "state is using public funds to enforse laws passed by the state of oklahoma"...
So...........if he wins the lawsuit I suppose I will no longer have to obey any State law since all of them were passed by the State House and Senate and all are enforce with taxpayers money????

To use the constitution to justify illegal activities should not be tolerated. I only wish there was a clause in HB1804 that criminalized encouraging illegal activities by citizens. By word of mouth or any other method. That would shut you people from encouraging criminals to break the law

1804 will pass with flying colors again..... I hope the Tulsa World gives us some background on the plaintiff and what his true motives are.. (Probably works for Harry Turncoates roofing)...

#16, I don't think you really know much about 1804 other than what you read in the papers.. Why don't you read it and get back to us on what part of it is unconstitutional. Using State funds to enforce Laws passed by the state has been legal since 1907...

Under the 14th Amendment, anyone who is within the borders of this country has the right to equal protection under the law. Dover suggested criminalizing people for speaking their opinions or protesting (I assume) by saying "By word of mouth or any other method". Double taxation is a situation in which two or more taxes may need to be paid for the same asset..." Bone up on these facts and let me know how I'm wrong in saying this bill is unconstitutional.
