John Swails: He says he sued ORU because he wanted “people to be held accountable for their actions.”

He’s coming back to ORU after settling a suit against it.

John Swails is not looking for a “hero’s parade” when he returns to employment at Oral Roberts University on Monday, but he thinks the many ORU community members who encouraged him during his lawsuit against the school will welcome him back.

Swails’ portion of the case was settled at the end of a long day of mediation Thursday, and ORU offered him the new job of director of the Center for Israel and Middle East Studies, he said.

The other two former professors — Tim Brooker and Paulita Brooker — who sued along with Swails have not asked for their jobs back and are continuing with the suit.

The lawsuit, filed Oct. 2, brought to light allegations that ORU money had been misspent and that former President Richard Roberts promoted a “culture of fear” on campus, as Provost Mark Lewandowski said in November.

Richard Roberts denied wrongdoing and said in November he did not intend to perpetuate any such culture.

Roberts resigned as president Nov. 23 but remains CEO of Oral Roberts Ministries.

Four regents have resigned from ORU’s governing board in recent weeks. The board has taken on a more active role at ORU since

the lawsuit was filed, and it is considering offers of help from the family that founded the Hobby Lobby craft-store chain and from Regent University, founded by Christian broadcasting pioneer Pat Robertson. It has also begun searching for a new president.

The day the professors filed the lawsuit, Swails said, he did not anticipate the changes that were to come.

“The situation has been so shifting and amorphous, I didn’t really know how to hope,” Swails said. His new job “is better than I foresaw.”

Also, “I believe that the university is on a new course, so that in itself is worth something.”

Later, he said, “I felt like it was time” for Roberts to resign.

He said he did not intend the lawsuit as an attack or a crusade. Instead, he wanted “people to be held accountable for their actions” and “to have the facts,” both pertaining to his claim that he was wrongfully fired.

Swails declined to discuss the details of his settlement.

John Tucker, an attorney for ORU and other defendants, said those terms are confidential but, along with ORU, thanked former Oklahoma Supreme Court Justice Daniel Boudreau for making mediation work on Thursday.

ORU board Chairman George Pearsons said Friday, according to an ORU press release, “We are pleased that this matter has been resolved and would like to welcome Dr. Swails back to the university family.”

Swails worked at ORU more than 14 years before losing his job Aug. 28, according to his lawsuit.

A Middle East expert, he formerly was professor and head of ORU’s history, humanities and government department.

His new job will be an expansion of his old job, he said. He will develop connections between ORU and Israeli universities and make pathways for U.S. Christian students to travel to Israel.

This semester, he will teach classes on the Islamic Middle East and the Rise of Modern Israel, according to him and ORU’s press release.

Swails said he is relieved to be “resuming my life of obscurity,” and is eager to return to researching and writing. He spent Friday morning calling colleagues and friends, including those in Israel.

In the past few months, he received hundreds of supportive phone calls and e-mails but only one critical piece of correspondence, which was anonymous, he said.

Returning to ORU, “I think I’m going to be well-received,” Swails said. “Some might not feel so strongly, but that’s not my problem.”

He probably feels that he is called to be there. As an ORU alum I never felt like I wanted to work or be a part of ORU when I left. When you feel called to something you are willing to wade through a lot of madness because the positive results are worth it. He obviously loves teaching and being with the students. Hearing him speak about Middle East issues on the radio makes me think this is a dream job, especially with being able to connect with people in Israel.

For a time I had relationship with a teacher at ORU after going on a missions trip with his family in 1986. He is still teaching there today even though he would make a lot more money at other schools. He loves his job.

best of luck to Dr. Swails with his new position.

i thought all along he had the better case for reinstatement. in academia you just can't treat a tenured professor like that. in fact, in an interview Dr. Vance said that how Dr. Swails was treated was the last straw that compelled the tenured professors to finally speak up.

with his love of Israel, it does sound like a dream position for him. let's just hope the history department will stay away from being directly involved in politics and focus on educating the students from now on.

Yes and the great thing is now he knows that if the school doesnt do every little thing just the way he likes, he always has the lawsuit card he can go to. Its like that easy button on the commericals. Hey John, don't like what is being served in the lunch line? oh, well, you can always sue the school and get lots of nasty publicity in the paper. Too bad you dont get invited to many meetings any more John and when people are around you, they are suspiciously quiet. Maybe its because they are worried that if they say anything to disturb your peace of mind, boom, get the lawyers in here and sue somebody, no, check the, sue EVERYBODY!

I predict that Swails will be so paranoid when some are not that comfortable around him (not trusting him), that he will decide he's being mistreated because of his whistleblower claim, & he will sue the school again! It wasn't so much that he filed for unlawful termination. It was the attorney he used, that had no ethics, & put that list of unproven allegations/rumors (?) out to the public & the MEDIA. Swails taking part in that caused untold financial loss to ORU. The staff, professors, & students are now suffering because of that deed. I just don't really feel that Swails has that many friends at ORU anymore. At least "real" friends. They just don't really trust him, because he misrepresented the school in such a shabby fashion. Other than that, I hope things work out for not only him, but the rest of the school.

Swails wisely jumped at the first opportunity to seperate himself from the circus sideshow. Romor has is that Richardson is livid. He did not get enough out of Swails settlement to pay last friday nights liquor bill.

Well, this reinstatement and this connection with John Hagee just underscores the need for ORU to close. He will be working to bring on Armageddon (a political cause if there ever was one) and he'll make expensive trips to Israel, paid by the school, and he'll try to convert Jews and tell Palestinian Christians to go to hell (oh, sorry, forgot, they're already there). And so he did do right by himself, because as Machiavelli says, the lawsuit isn't going to change anything. Swails is right back in the cesspool of the RR-controlled cult that will now throw money at him like it does at RR. Swails may have won a victory for tenure, but he made sure he got his own piece of the ORU/donor pie.

#10 Unnamed. It takes a whole lot of courage for a single individual to take on an corporation, religious or otherwise. My exact remarks were "Swails did right by himself and others." ORU did wrong by firing Swails along with Brooker. I'm still not sure that the way all three were handled is a good witness for a so-called Christian University, one that is owned by a ministry and not free-standing, but the treatment of Swails was the worst.

ORU has the money and clout compared to Swails that they could surely prevail in the lawsuit if they had a good case. They did not. They settled.

The appearance of Mart Green makes further sacrifice on Swails' part useless. IF $70 million (well $62 million more) doesn't work to change the powers that be, why should one man fall on his sword?

This article makes it sound like Swails got a "promotion," (expansion of his former duties), but is Swails a Department Head? And what's going to happen to the Government Department? Will the ORU students still work on political campaigns? What about the student and accountant lawsuits?

Gail-- you are right on about the parents who send their kids to ORU. I have always wondered about the % of students who actually come from local or even state high schools. Of course, minus the VCC kids---it is given they are going to have to go to ORU. And ORU has a big home schooled recruitment push. It has always been my impression that there are lots of students who come from around the country after seeing RR and LR on tv and their parents being impressed by letting the Roberts become the Collegiate Mama and Papa to their sheltered little offspring.

Mach- IMO, they will not take Green's money. They are feeling too "cocky" now to think clearly (like they ever did, duh!).

Does anyone know what enrollment numbers look like? Most schools disclose this but ORU is obviously not a typical school.

The more I hear and see, I think the only way ORU can survive only by being bought out, renamed and with a whole new cast of administration people. The students, faculty and staff deserve better than what this lot of hoot-nannies can provide.
