Judge issues a gag order

Those involved in the Oral Roberts University lawsuit are forbidden to discuss the case.
The attorneys and parties involved in the Oral Roberts University lawsuit no longer can talk about the case outside of court.
In the case’s first court hearing on Friday, Tulsa County District Judge Rebecca Brett Nightingale granted a gag order, saying she was concerned about everyone’s ability to get a fair trial, considering the public comments made so far by the parties and attorneys.
Three former professors sued ORU, now- former President Richard Roberts and others on Oct. 2, claiming they had wrongfully lost their jobs for acting as whistleblowers. In the following months, developments in the lawsuit and at ORU occurred nearly daily.
On Thursday night, following court-granted mediation, one of the professors, John Swails, settled his portion of the case and accepted an offer from ORU to work for the school again, teaching classes and leading the new Center for Israel and Middle East Studies, Swails said. The other professors, Tim Brooker and Paulita Brooker, are continuing with the lawsuit.
Nightingale said highly publicized lawsuits sometimes are moved out of town for trial, but the ORU
lawsuit would not be a good candidate because the lawsuit has been covered by media nationwide.
She weighed the constitutional rights to a fair trial and freedom of speech and said, “The court takes both of these rights quite seriously.”
She quoted Gentile v. State Bar of Nevada in limiting statements outside the courtroom that would be “substantially likely to have a materially prejudicial effect” on the right to a fair trial.
John Tucker, an attorney for ORU and defendants not including Roberts, had argued for the case to be “confined to this courtroom” and not “tried in the newspaper.”
Gary Richardson, an attorney for the former professors, argued, “I think it’s really a frightening thing to set a precedent of (limiting) any kind of freedom of speech.” He said he was not concerned that his clients would not get a fair trial.
“It’s a real rare thing in a civil case to give . . . a gag order,” Richardson said.
William R. Grimm, a Tulsa lawyer and the 2006 Oklahoma Bar Association president, said gag orders occur in perhaps less than 5 percent of cases, usually in high-profile cases that could significantly impact a community. Prior restraint helps “keep the playing field level” for all parties, he said.
“The public has a right to know about litigation, and our court system is very open,” Grimm said.
Court hearings remain open to the public in the ORU case.
Richardson asked Nightingale about the possibility of ORU founder Oral Roberts, who is not a party in the lawsuit, making public statements about the case when no one involved could respond.
In a campus chapel service in October, Oral Roberts told students, “The devil is not going to steal ORU,” but Richardson summarized Roberts’ speech as characterizing the professors as thieves being used by Satan. Tucker replied that the professors could sue Roberts for defamation. Nightingale said that if Roberts made public statements, Richardson could ask the court to handle the situation.
Also during the hearing, Nightingale gave the Brookers a deadline of Jan. 25 to file a new version of their lawsuit. After that, Nightingale will address various issues, including requests for documents, that the attorneys have raised, she said.
Nightingale announced that ORU and the other defendants had dropped their request to disqualify Richardson as the professors’ attorney.
At one point during the hearing, Nightingale reminded all of the attorneys to direct their statements to her, implying they were not to bash one another, as they had briefly done, for the benefit of the media present. None of the plaintiffs or defendants came to the hearing, only their attorneys.

This certainly gives advantage to ORU. Oral, Richard and the rest of the tele-preachers can say whatever they want, whenever they want. Now, the public won't be able to hear anything from the other side of the case.

I'm a local ORU alum. I have known people over the years that have either had direct contact with or have worked at ORU the past 30 years since I first hit the campus in 1977. I'm glad that things are trying to be resolved.
I am not one that thinks that they will be able to hide what happened. With what is happening with other preachers that are being forced to explain what they are doing AND those whose sins have been exposed for the world to see lately, I'm convinced that any wrongdoing at ORU and other institutions will be exposed by God. It is evident to me that this is cleaning up time for the body of Christ. Any attempts of hiding sin will not work in this day. Somehow things will be exposed. I'm convinced of that.
I hate that the dirty laundry has to be aired for the world to see but I'm convinced that the Lord has given all of us time to deal with our sin or at least acknowledge that we need His help to walk free. The problem comes when we justify our sin and when being exposed try to hide our stuff instead of coming clean. Again any sin that has been justified and not repented of will be exposed for the world to see. I'm making sure my heart is right with the Lord. My stuff will NOT be in the street. It would behoove those Christians in the public eye to really take a look at the exposures of other ministries and make sure they have repented and turned from sin or at least are asking the Lord for help to walk free.

This just gives cover for more secrecy.
The Missiing Eight Million:
They clammed up when TW asked about the missing eight million for the Student Center.
There is no Student Center.
The eight million is gone.
Where is it?
They clammed up over spending the endowment to pay for the Roberts' imperial life-style, so lavish it would make a Saudi sheik blush.
--- 3 milliion for Oral's Beverly Hills mansion, 2 million in renovations
-- and #250,000 golf club membership fee.
They clammed up over RR making ORU his personal piggy bank.
They clammed up over the bylaws, which STILL give RR defacto control over ORU and the BOR.
They've clammed up over the staff of complicit enablers who wrote the checks that burned through the endowment and looked the other way when RR broke into the piggy bank.
They're RR's key "boys and girls" are still there, controlling the finances.
And the BOR will clam up when they dump Mart Green's offer so Richard can keep control behind the scenes.
ORU will always be a Roberts owned and run operation.
There isn't a ghost of a chance that will ever change
Students and their families should think twice before tying their futures to this train wreck.
The name ORU already smells to high heaven in much of America.
And the truth has barely come out.

#3, PCGfriend: Would you send your child to ORU? Can anyone justify sending their son or daughter to ORU when there are so many untarnished, reputable colleges available? Nothing has changed at ORU and nothing will. The Robertses will still control almost every aspect of every-day life there. Who would want their impressionable young adult to be inflluenced by the likes of Richard, Lindsay, or Oral? Just asking.

Finally, an informative article that didn't just rehash redundantly, old news. Sounds like Richardson's upset about the gag order. It shouldn't make any difference to him. Only to people who like to keep defacating in the public streets. (Another phrase for hanging out one's dirty laundry.) So, now it's down to just the Brookers'. If they file yet another version of their lawsuit by January 25th, it pads Richardson's bill yet again. The Brookers' legal bill must ba astronomical by now. Wait until Richardson sues them for his fees like he's done to his clients in the past (note court filings on ORU TW page). Or, he could bill them 1/3 of the "take".....But they'd have to win something first, & that may not happen.

This story has not been covered "over the nation" anywhere near like it has been covered in Tulsa, so it's a win for the plaintiffs that the case stays in Tulsa, because gag order or no, others, like us, can discuss the case and what's been going on at ORU and with the leaders.
And each day, most likely, what happened in court, which is open to the public, will be reported here in Tulsa World, and people who know things can report them, and the reporters can investigate, etc.
This sounds like as good as it gets.
Ahhhhh....... Jack Nicholson as Richard Roberts. He'll need some rejuvenating cream, and it should NOT be a comedy, but Nicholson is also a great dramatic actor, sometimes we forget!

It’s amazing how a single case of possible corruption can sway people to believe a certain way and begin a process of zoning in on a symptom of a much larger problem. The media plays to the emotion of people by focusing on a single case of potential corruption. As serious people (who everyone claims to be) step back and look at the broader problem of corruption and the misleading in the church as a whole. We have over 4,000 clergy who have been found guilty of molesting little children, the head of the evangelical association caught in homosexual activity and purchase of illegal drugs, a minister killing board members after being exposed of sexual sin, a minister beating his wife, and many more I could share. Surely serious people who claim they love the Kingdom and God, could view the broader perspective and get a little more indignant over the greater ignorance and offense of the clergy as a whole. I think there has been a much broader ‘Gag’ order issued across the church that hides their own sin and refuses honesty and exposure.
I challenge you to step back at a broader level and view the real issues. If we are all serious let’s prioritize the tens of thousands of issues where children are molested, families ruined, and church members chased away. This goes well beyond a few professors losing their jobs and two evangelists accused of living lavished lives. Last year brought far greater exposures of the church than ORU, and I believe this year will bring 100s of more exposures that are of far greater detriment to the Kingdom. Will you be a part of those, or are you selecting a single injustice to harp over?
I invite you to review an upcoming book that will be released called ‘What in Heaven and Hell is Happening,’ at focusonheaven dot com. If justice is what you really want in the Kingdom, then I suggest you step up and equally take the broader issues as serious as you are taking this one item of ORU.

Suzanne, QUIT trying to sound like you know what's going on with Trish! YOU DON'T EVEN KNOW THE WOMAN, much less what's going on with her! YOU ARE SPREADING GOSSIP 3rd, 4th, 5th, & 6th HAND, put out by people that barely know her themselves! You don't get anything straight. On top of that, 2 weeks severance or vacation pay is very common in most businesses. Are you saying that the Roberts should PAY a lot more to their RELATIVES when they lay people off due to the separation of ORU/OREA? REMEMBER that money comes from OFFERINGS.
First you complained about the Roberts having any family members living in the compound.....Now you cry foul because she moved out! Which is it, Suzanne? You can't have it both ways! Why should she be still living in the compound when you say others shouldn't? There is a lot of unfortunate fallout as a result of separating ORU/OREA that people don't like. A lot of job sharing between the 2 entities that neither ORU/OREA can afford now on only one or the other. Sign me, tired of your double & tripletalk.

#12 Unnamed. "Impartial" jury selection means "voir dire," which is French for "to see to say." Sure, each attorney gets a certain number of strikes of potential jurors, each state/jurisdiction/judge may be a little different, some judges allow juror strikes for no reason at all, some require a valid reason.
The juror pool in Tulsa will be much more knowledgeable about ORU/Oral Roberts/Richard Robersts/Lindsay Roberts/professors/employees/fundraising/City of Faith/OREA etc. that in most other parts of the country, perhaps not compared to other parts of Oklahoma.
It's a certain victory for the plaintiffs that the judge did not change the venue of the trial.
What's my age got to do with it? I did not study law, but I do have several degrees in technical/business areas, some very close to law, and, most importantly, I am a "Law and Order" junkie, currently and from way back, so I know what I'm talking about.
Dear Unnamed, here "Machiavelli #11," Why don't you use a "handle" like the rest of us, instead of naming each post by whom you are addressing?
Here's a suggestion: Marah. For explanation, check out the Book of Ruth in the Bible. You clearly are a pro-Roberts person, you should know something about the Bible.

I've been reading and following all this. I was an employee of the City of Faith in the 80's, Can any of you tell me where Harry Salem is in all of this? Lindsey and Harry were so close. And is Stephanie Cantees still employed. How hurt she must be over her daughter. And Lindseys mother, watching all her family be torn apart by Lindsey and Richard. Does anyone have any in put on this? Everone knows Lindsey runs Richard. I just want them to face the courts systems.
