ORU seeks dismissal of suit

The defendants rebut claims made by two ex-professors.
Oral Roberts University and other defendants in a lawsuit filed by former professors addressed the professors' legal claims point by point in a court filing Friday and asked the court to dismiss each claim and the entire lawsuit.
pu,UFslams ORU, Oral Roberts Ministries, the Oral Roberts Evangelistic Association and ORU administrators Wendy Shirk and Jeff Ogle responded to the latest version of Tim and Paulita Brooker's lawsuit.
The Brookers, who are married, claim that they wrongfully lost their jobs and more. Professor John Swails originally was part of the lawsuit, but he settled his portion of the case last month and was rehired by ORU.
The defendants' response to each of the plaintiffs' claims follows:
Wrongful
discharge
:
Tim Brooker does not
meet the legal requirements to sue for wrongfully losing his job, ORU and the other defendants allege. Brooker claims that his working conditions became "intolerable" because ORU made him into a scapegoat for ORU's allegedly violating federal tax law by helping with a Tulsa mayoral campaign.
The defendants allege that Brooker's supposed wrongful discharge must be tied to an Oklahoma law or policy.
Brooker claims in his lawsuit that he was wrongfully forced to quit because he helped hand over to ORU regents a report that alleged wrongdoing by former ORU President Richard Roberts and his family. ORU and the defendants responded Friday that the alleged wrongdoing does not violate Oklahoma public policy.
"Unhappiness with an employer's management style and decisions is not a valid concern relative to public policy," the defendants say.
They cite a legal case to support their contention that Brooker doesn't have a valid whistleblower claim.
They also claim that ORU's and others' alleged wrongdoing does not constitute "a direct threat to the health and interests of the general public," which they say would be legally required for Brooker to claim wrongful discharge.
To claim wrongful or "constructive" discharge, the Brookers also would have needed to establish that they were at-will employees, meaning ORU could have fired them for any reason, the defendants claim. Instead, the Brookers say in their suit that they worked under written and oral contracts.
Paulita Brooker claims that she lost her job because an other professor reported sexual harassment against yet another professor and because her husband, Tim Brooker, had handed over the report of alleged wrongdoing. Those allegations don't meet the legal requirements for claiming to have been wrongfully fired, the defendants contend.

Also, the Brookers never say how ORU and the defendants violated their contracts, so they can't claim that their contracts were breached, the defendants maintain.
Negligence

The Brookers can't make a legal claim that ORU, Oral Roberts Ministries and the Oral Roberts Evangelistic Association failed to supervise Shirk and Ogle properly because the Brookers are not party to that matter and they haven't named injuries they suffered because of the alleged negligence, the court filing says.
Civil

The Brookers can't claim that the defendants conspired to discharge and defame them because the Brookers don't back up their claim that the defendants were taking illegal actions, the defendants say. Tim Brooker resigned, and Paulita Brooker's contract wasn't renewed, neither of which is illegal, the defendants' filing says.

The defendants contend that their own alleged misconduct -- which they deny -- if true, would not be outrageous enough for the Brookers to claim to have suffered resulting emotional distress.
Fraud

The defendants maintain that the Brookers weren't specific enough in alleging that ORU, the evangelist association, the ministries and Ogle gave them false information, nor did they say how ORU and the other defendants benefited from the alleged fraud.
Interference

:
The defendants allege that only someone who is not part of a contract can break the interference law. The Brookers also don't give specifics about how this law allegedly was broken, the defendants claim.
Libel/slander/defamation
:
Maligning statements allegedly made by the defendants occurred in summer 2006, based on the Brookers' lawsuit, the defendants say, so this legal claim was made too long after the incidents are alleged to have occurred. Also, the defendants contend, the Brookers don't state the what "false or defamatory statement" allegedly made against them was.

the Brookers are up the creek with no paddle. while the other professor involved intention was in the right place theirs was out for gain & vengence & it will not work. they should be sued for libel .there wolves in lambs clothling & I believe the tide will eventually turn against them & the truth will be revealed. I know what they will do next to make some money.its write a book .wait & see .it will be.only in Amercia folks only in America

This response seems to be saying that although ORU's conduct may have been shameful and wrong (dare I say un-Christian?), it wasn't illegal.

It is still a matter of what the court says, but they have a long row to hoe to prove the allegations as true.
It wouldn't surprise me that Tim and his wife would be ordered to pay ORU's attorney fees.

If this case is dismissed I would like to see a counter-suite for Libel/slander/ defamation filed against them. I'm not a lawyer but if Richardson's work is as sloppy as it looks there should be some recourse against him also, more than just disbarement. JMO

Finally they have made some kind of response. I was wondering if they were going to hid there heads in the sand. Also someone has used there heads, not said anything and just let the lawyers do all of the talking which should have been done in the first place. Thank you TW for doing this Article I have been wondering what ORU's response would be and when.

This is just a petition. Of course they ask for th sun, moon and stars.
ORU / RR defenders might want to wait and see how the judge rules before becoming too ecstatic.
Oh, go ahead. Rejoice, break open the champagne. Dance in the streets. You need a little lift.
Your man is out and a new day is in at ORU--- to be renamed in due course.

Brooker resigned & his wife's contract was not renewed. Most judges around the country, throw this situation out of court right up front, because the Brookers don't have a leg to stand on. Contracts not renewed, & resignations don't count as wrongful termination and are not illegal.

#5 M.S. No fan of R.R. myself. Having his ability to practice law taken away, no big deal. You make asumptions that you can't back up. I do like the waterboarding idea though, LOL.
I was thinking more along the lines of monetary, this is where he would feel it the most.

The claim is based on the idea that ORM is a "trade name" only, and thus cannot be named as a plaintiff. How interesting.

I knew that Richardson's work was sloppy, but this rebuttal of 59 pages shows in detail, that sloppy is too mild of a word for it. He doesn't even realize it may be time to check in somewhere.
Only an idea, of course, but that's what it looks like. It will be interesting to see when the Brookers sue Richardson for his careless work on their behalf, & Richardson sues the Brookers for his legal fees.

I worked for a high-profile ministry and the things that went on behind the scenes! Those who were placed in key positions of power protected and promoted The Big Guy at all costs and made sure his hands and reputation were kept clean from the dirty work they did on his behalf. None of the lower staff drones were allowed contact with him lest they let slip any tidbits of troubled conscience that might blow the lid off his fantasy. That way if ever publicly or privately confronted he could deny all knowledge of the unethical and ungodly manipulations done for him. The world was told it was all for the glory of Jesus but in reality it was all for the glory of The Big Guy. Many of us stayed thinking we could influence change from the inside but left when we found we could not. It is very difficult to prove to those outside what was common knowledge to those inside. It takes staff members in key positions of power willing to out things. Look how many years it took for some of those key people in ORU to get fed up enough to talk. I hope and pray some in the ministry I was part of will one day do the same.

I personally think this entire response by the lawyers for ORU and Roberts is a waste of paper. They claim it's not contrary to public policy to violate federal tax laws and engage in coverup of sexual harrassment. And even if they did these things, which they claim they didn't, they wouldn't be bad enough for anyone to be distressed over. If Richardson can't pulverize this miserable excuse for a legal brief, he's not even worthy of the vilification reserved for great attorneys who win judgements others don't like.
If Oklahoma judges fall for this load of word-that-rhymes-with-granola, then I'll laugh at every Okie joke I ever heard for the rest of my Italian-American life.

In reading the ORU's responses to the plaintiffs' claims it all comes back like I was there again, as I was in the 80's as a faculty member. We were told publically by OR that we were not very good as faculty, the culture of fear was there, salaries were very low, and there was the unwritten rule that we had better keep our mouths shut as it was known that they could, and would, fire anyone at anytime. Now someone calls them on it and they are back peddling with the story that "... we were operating within the law at all times." There is more to being a good employer than that. I personally hope that the suit goes forward.
