Defense attorneys for Underwood argue against death penalty

NORMAN -- Relatives of convicted killer Kevin Underwood described him as a shy, socially awkward child during testimony Tuesday as his defense attorneys tried to spare him from the death penalty.
Underwood, 28, was convicted Friday of first-degree murder for the killing of 10-year-old Jamie Rose Bolin in a plot fueled by cannibalistic fantasies.
Gayle Coburn, Underwood's aunt from Emporia, Kan., testified that his social awkwardness began at an early age. She described a picture of Underwood as a toddler reaching his arms out toward the camera.
"Probably by the time Kevin became about 2 years old he did not respond to hugs like other children," Coburn said. "It was like that picture. He was always reaching out wanting to play but not able to take the next step."
Coburn also described unusual behavior Underwood exhibited as a child including making odd noises and exaggerated blinking.
As Underwood grew older, Coburn said he once confided in her he was depressed, isolated and feeling very alone.
She said she encouraged him to seek medical help.
A Purcell doctor also testified that he treated Underwood for depression and prescribed him the antidepressants Zoloft and Lexapro.
Previous testimony indicated Underwood began taking Lexapro for a second time just months before the girl's killing.
Another of Underwood's aunts, Valerie Sanders, testified that she worked with Underwood at an Oklahoma City grocery store. She said Underwood exhibited mood swings in the months leading up to the girl's death.
Coburn also testified that Underwood shared with her macabre, dark humor.
"I remember telling him at one point, 'Kevin, you need to quit looking at that stuff because it's just gross.'"
Prosecutors have said Underwood's fantasies involving killing and torturing and killing a victim were fueled by disturbing Internet images of pornography, autopsy photos and cannibalism.
The penalty phase of Underwood's trial began Monday.
Jurors could sentence Underwood to death by injection or give him a life sentence with or without the possibility of parole.
The girl was killed on April 12, 2006.
Underwood said he lured her into his apartment with a pet rat, hit her with a cutting board and smothered her. Her body was later found in a plastic tub in his apartment with her head nearly cut off.
Although Underwood said a cannibalism fantasy fueled his actions, no evidence has been presented that any actual cannibalism took place.
The case was moved from Purcell, where the crime occurred, to neighboring Cleveland County because of the intense publicity surrounding the case.

Well of course he shouldn't have the death penalty. That would be to easy. He needs to be tortured the same way this little girl was. There is no excuse for what he did. And for them to try and say that he suffers from depression and has social issues..... That is BS.

Lots of people suffer from depression and they don't go out and kill someone to eat them. What ever the diagnosis for this man, he either needs to die or what ever happens to him when he gets in prison by other inmates!!

I still maintain a rope has two ends. One end for this creep, and the other for his whining loop-hole attorney. Solves TWO problems for society regarding current court room justice.

gb - the attorney has a legal obligation to provide the best defense possible to this monster so that the inevitable death sentence can't be reversed on appeal.
It's called dotting your i's and crossing your t's.

to #7: attorneys might have a legal obligation, but for some reason the baddies always appeal later because the attorney didn't represent them "correctly",, or hold their hand quite right. OR an i wasn't dotted, or a T wasn't crossed,,, which is a loop-hole crock!

I say life without parole (in the genral population in prison). The Death penalty is the wasy way out for this creep.
Let the BIG boys take care of him. Even hard criminals "do not" like men that hurt little girls.

Yes, prison justice could be very satisfying. Let him get gang raped & shanked, he deserves less than that. He deserves to be torn limb from limb & have HIS head cut off.

General population placement in prison could help him get past his "shy, socially awkward" feelings.
His "making odd noises and exaggerated blinking" is sure to get the attention of every rapist.
I think they'll be helping him to "take the next step."

I hope the jury will do the right thing. To say that he should be put into the general population—whether in society or in a prison—is a mistake. He could do the same thing again, before the people or inmates "take care of him just fine." He is sick, but he did make a choice when he could have told his doctors about the fantasies.
The thing that has come to me is that however evil he is, he is still one of God's children. I have no wish to see him treated gently, but I know that God is just as sad over him as God was over other terrible sinners like Timothy McVeigh. I believe he should be in a prison for the criminally insane. That would be the just, honorable thing to do. We have to be careful that we do not become as bad as he is in order to punish him. That is one of the great dangers in a case like this.

Where is the compassion that is supposed to abound from the good Christian citizans of Oklahoma. Most of the previous posts are more blood thursty than the killer himself. Yes, it is a heinous crime and justice should be given by the criminal justice system, but you people need to take a good long look at yourselves. Would a lynch mob be more to your liking?

Actually, I do see a reason for him to live.
By studying people like him, it makes it easier for cops to identify certain behavioral patterns that could save the lives of the next kid.
I hate that the brought the internet in on this though. He could have just as easily been fueled by anatomy books in the library or even the Bodies exibit, in which he could have seen a corpse in person. In either event, he chose to look at that stuff and chose to kill that child.

i have read these post and i feel that alot of people are lashing out! my question is how many of these people that are lashing out were abused as children? i was and i have a strong feeling on this matter and believe that he should be put in the general population in prison he is no different then any of the men that are there so why should he get special treatment? the man killed a little girl who is an innocent person she was the victim here not this crazed man with fantisies. further more why should we be spending extra tax dollars to house him in a personal cell because he is socially akward? just because of this does not mean that has to socialize with the other inmates!!!! he can stay to him self without talking if he so wishes but he should have the same treatment as any toher criminal!!!!!!

Yo dp, your call for good christian citizens sounds a lot like the pius few who wish to judge other believers instead of reading their Bible and getting the facts themselves.

There you go, God ordained capital punishment. He should DIE.

It seems that the victim is always forgotten in what does the criminal deserve. I think maybe the family should be consulted along with the others who have to make this decision. It seems like the family has no part in this decision.
The young 10 year old girl should be remembered!!!!and her family.
I have not seen or heard of rehabiltation of people like this and if they could be rehabilitated for what????

Sean, why don't you write something about the little girl. She was only 10 years old. She had her whole life ahead of her. Her parents loved her and are heart sick because of such horrible death. Her beautiful little life was snuffed out because of this poor man's childhood!!!!!! What about the victim Sean?

I think that the sick bastard needs to know what it feels like to be torture, just like he did to that young child. Ten years old, how could she do something that would make him want to do something like that? I think that they should let him die very slowly.....forget the death sentence! As they are torturing him, they need to explain to him what they are doing to him and how they are going to do it and why they are doing it. People like that don't diserve the death sentence....they diserve to suffer!
