Web site operator told to ID users

McALESTER — The Pittsburg County District Attorney's Office has subpoenaed the operator of the "McAlester Watercooler" Web site, demanding that he identify 35 people who post comments under fictional names.
The document demands that Harold King provide the site posters' names, addresses and Social Security numbers to police by 9 a.m. Saturday as part of a criminal investigation.
McAlester Police Capt. Don Hass said the investigation concerns "criminal libel" complaints. Many of the posters have been critical of former state Sen. Gene Stipe, D-McAlester, who was sentenced in January 2004 to five years of probation for perjury and campaign funding violations; his brother, the recently deceased Francis Stipe; and local elected officials, including District Attorney Jim Bob Miller.
Hass said that once police turn over the information to Miller, the case likely will be referred to Oklahoma Attorney General Drew Edmondson so that another district attorney can be assigned.
"I think he's the victim on that — the DA," Hass said.
Miller said by telephone Wednesday that he thinks some statements posted on the Web site about him and others are libelous.
Libel usually is a civil matter rather than criminal, but Oklahoma law allows for punishment of criminal libel by a year in jail and a $1,000 fine.
Prosecuting online libel, however, is a relatively new frontier.
Gene Stipe accused King of criminal libel a few years ago, but the case was never prosecuted.
Stipe's business associate Steven Covington filed a libel lawsuit against King last year, but it was dismissed after McIntosh County Associate District Judge James Pratt ruled that irreparable injury to Covington's loan business had not been proven.
King said he will file an objection to the subpoena.
"There are several possible grounds — ranging (from) Bill of Rights issues to procedural ones," he said. "The problem that really concerns me is what they might try next."
King said he has been trying to get the district attorney and "most of the Pittsburg County judges" prosecuted for alleged corruption. Commentary on his Web site concerns local politics and the federal government's investigation and prosecutions of political corruption, kickbacks to legislators, and state funds that were illegally funneled to businesses controlled by Gene Stipe.
"I guess this is what happens when corruption is allowed to fester for decades," King said in an e-mail. "Such a clean-up problem will never be 'nice-n-tidy' — which of course is what everyone prefers."
Some of the comments on the site have been about Miller's teenage son, who was arrested in July on a misdemeanor complaint of possession of prescription medication without a valid prescription.
In a related matter, Miller said that because of another investigation he couldn't comment on whether he will file assault charges against Wayne Stipe, Gene Stipe's nephew.
King filed a police report Saturday after Wayne Stipe allegedly hit him in the mouth outside a grocery store, records show.
Wayne Stipe said: "This man has been trying to pick a fight with me for the last three years. He was finally successful. He picked a fight with me, and I defended myself. I felt like I was about to be attacked by the crazy man."
Asked whether King physically assaulted him, Wayne Stipe said King "verbally assaulted" him.
King said: "I don't know how you pick a fight when you say, 'No, I don't want to talk to you. Go away.' He hit. I didn't."
King sought a protective order against Wayne Stipe on Monday, but Special Judge Bill Layden would not grant the request.
"The funny thing is that me and Francis (Stipe) got along," King said. "It was a game to Francis. Personality-wise, I liked Francis."

Obviously the Pittsburg County DA has never heard of the Streisand Effect - when you try to suppress something (such as aerial photos of Barbra Streisand's house), it only draws more attention to it.
Criminal libel? I've never heard of that before, and I think it's nothing but a ridiculous attempt by the DA, Jim Bob Miller, to intimidate his critics. Read the posts of The Real Cherokee Vote and tell me how well that's working!

Cherokee Vote- I suspect your list got zapped because you are wrong in the statement you are making. I am on this list and I was not fined one penny as you claim. I was never a good old boy either. I am listed because I was the treasurer of the campaign, which I ran by the books, which is why they concocted all these schemes outside the campaign. Its easy to cut and paste, but you should try to educate yourself on the facts before making these broadbrush statements.
I have done as much as anyone in Oklahoma ever has to face Stipe and the cartel head on and actually uncovered most of these illegal activities and reported them to the authorities.
I have paid dearly for that and I don't appreciated someone continuing to lie about my role in all this.

Maybe Capt. Donnie is just too stupid to understand he's opening a can of worms he won't be able to shutdown. If he really wants a real investigation in Pittburgh Co. just keep going cappy, who knows what the feds will fine when they come calling, and they will.
The smart thing (did I say that) would be for cappy et al to shut up, fine real jobs and hope this all blows over. But, their egos, and the fact that they MAY have something to hide, just won't let them stop.
Lastly, good to know Cappy and cronies have all the crime in Mac cleaned up that this is all they have to worry about. Cappy and friends are what helped make McAlester what it is today.

This is BS and what happened to our right to free speech? Lawmakers and District Attorneys are taking away more and more of our rights in this country and we better stop this from happening before our children and grandchildren live under Marshall law. As for the liable for making comments well I say get over it after all my sixteen year old ricky is on a public registry as a predator for life due to CONSENSUAL sex. Yet the government is immune and are not telling parents and families how these laws can snag your own child into this life of hell. Everytime some sanctimonious hypocrite hears "sex offense", they automatically equate it with "child molester". Don't let them live near churches! (Never mind the child abuse going on in the sacristy or church office.) Don't let them live near schools! Don't let them live near playgrounds! Hell, DON'T LET THEM LIVE! What these ignorant morons don't want to believe is it can very easily happen to them. If you go behind a tree on Turkey Mountain to urinate, some homophobic bicycle cop can arrest you for indecent exposure and soliciting sex. And yes, it happens all the time. Even if the charge is thrown out (which they never are. Would our valiant police officers lie?), the CHARGE is published in the paper, and there are a lot of idiots who don't understand the difference between a charge and conviction. So now, for having been caught in the woods with no convenient toilet, you're on a "sex offender" list for life. Even if you go in a toilet in a public park, there are cops who will claim you solicited sex from them. No witnesses, mind you, but the cop is always believed. I'm sorry about what happened to Ricky. It's happened to friends of mine. Until these right-wing, ignorant, fundamentalist pseudo-Christians get their collective heads out of their rectums. it will continue to happen. I'll definitely sign your petition.

Yes, Don Hass resigned amidst claims that he hindered the Ryan Luke investigation. The DA resigned along with dozens of other city, county, and state workers. The McAlester Police immediately hired Hass as a police officer. At that time, chief George Scott was an investigator. Then he made deputy chief and now chief of police. George has tried to stay neutral in all of this but I feel he will eventually have to join the fray. Stipe and Hass are still good buds and are in this stuff like best brothers forever. Dale Covington resigned in disgrace and lives in Edmond. Dale and Hass were fishing buddies along with Randy Green. I'm sure they cooked up a lot of their misdeeds while pulling bass out of Eufaula. I really wonder when someone is finally going to write a huge expose about all of this along with untold events. I know I have at least two dozen good juicy anecdotes and stories I have heard through the ages about Stipe, Albert, Mass, Bass, Nigh, Boren, Covington, Means, Tannehill, and the good ole Ward boys. Yes, the Ward boys. Anyone ever know old Mr. Ward and his Fina at Washington and "A" street? Better yet in McALester dramatic circles is the Allford boys. Oh we miss you W.E. Remember his ugly mug on early road maps? His sons pissed a way the company but W.E. was one of a kind!

Oh MY GOD, my head is swimming after reading the comments. Please go back to 101 and start from the beginning. I have NO idea what everyone is talking about except there is some deep, corruption in McAlester and someone "up" there wants names from a web site to find out who has been blogging against the cities finest.
