Ex-professor has history with lawsuits

A former Oral Roberts University professor who is suing the university has been plaintiff and defendant in at least half a dozen lawsuits and has been investigated in a stock scheme in Arkansas, records show.

Since 2000, Tim Brooker has filed at least four state and federal lawsuits against various officials in Arkansas and other states. Brooker also has been a defendant in at least two civil lawsuits during that time, records show.

All of the lawsuits were thrown out and none resulted in judgments, records show.

Brooker is one of three former professors suing Oral Roberts University, Richard Roberts and other defendants. The suit claims Brooker was forced to resign and his wife, Paulita, and Professor John Swails were wrongfully fired.

The suit claims the actions came after Tim Brooker and Swails gave the university's regents a document containing various allegations involving Roberts and his wife. The suit also claims Roberts ordered Brooker and students in Brooker's government class to work for Randi Miller's campaign for mayor of Tulsa.

The lawsuit is the latest in a series of suits Brooker has filed or been named as a defendant in, records show.

Sheriff dispute: Former Benton County, Ark., Sheriff Andy Lee, who served seven terms in office before retiring in 2002, was a frequent target of Brooker's lawsuits and claims, records show.

Lee said when he first met Brooker, Brooker was advocating parole of a convicted rapist to Benton County, Ark. Lee said he declined to support the request, which angered Brooker.

The man, Wayne DuMond, had been convicted of raping a teenage girl who was a distant relative of Bill Clinton. DuMond's case had become a national news story in the early 1990s when Clinton, then governor, intervened to halt DuMond's parole, according to news accounts.

Brooker, who hosted a conservative talk radio show at the time, said he used his show to call for DuMond's release.

''I just felt like he'd been mistreated,'' Brooker said during an interview last week.

DuMond was released in 1999 to Missouri, where he killed a woman the next year. DuMond died in prison two years ago.

Lee said the lawsuit against ORU by Brooker ''sounds like standard operating procedure to me.''

''They are good at creating images of what they allege is going on. They are very good at getting up to the line and not crossing it. . . . I think he's a very brilliant-minded person.''

But Brooker said the lawsuits were ''the only tool at the time to get the truth out.'' He said he had information about widespread corruption in Lee's office.

In 2000, Brooker sued Lee and nine other defendants in federal court in Arkansas, alleging the sheriff had violated the federal organized crime act known as RICO. Besides his radio show, Brooker was also an adjunct professor at John Brown University, a private Christian university in Siloam Springs, Ark., where he still lives.

Lee said he was cleared in all of the investigations and the lawsuits were all thrown out.

''You name it, every campaign season something came to the surface and was talked about on Tim Brooker's radio program,'' Lee said.

''They said I was stealing helicopter parts, selling helicopter parts; they said I had a cargo 180 aircraft parked behind the jail. They caused I forget how many state and federal investigations and they applied for two grand jury investigations.''

Jim Bolt: Brooker often filed his lawsuits with a business partner, Jim Bolt, the editor of an Arkansas online magazine. Records show Bolt has three previous convictions in Oklahoma and Arkansas and has served time in federal prison.

Brooker said he was aware of Bolt's criminal history but believed ''that he was really a changed man.''

In 2001, while employed by ORU, Brooker was named CEO of Golf Entertainment Inc., a publicly traded company. In a news release at the time, Brooker said the Georgia-based company had been inactive but had recently signed a deal with Genesis Trust of Bentonville, Ark. Golf Entertainment moved its offices to Springdale, Ark.

Brooker said then that Golf Entertainment planned to acquire broadcast television assets and operate television stations in Spanish language markets. Bolt was listed as chief operating officer and vice president of the company.

Brooker said he agreed to head the company but didn't really understand the details. He said Bolt asked him to head the company because Bolt, a convicted criminal, was prevented from doing so due to SEC regulations.

''I didn't realize he was going to use a publicly traded company. He asked me, 'Are you willing to do this?' and I said tentatively yes."

One year later, Golf Entertainment filed a federal suit under the RICO Act against 19 defendants, including the operators of an Internet Web site that provided investment advice. In a news release, Brooker was quoted as saying that his company was pursuing organized ''bashing'' of its stock on Internet chat rooms and message boards.

The Web site's operators countersued, naming Brooker and other defendants as part of a ''sham operation'' involving Golf Entertainment. The federal suit states that Golf Entertainment issued ''misleading news releases'' in an effort to inflate its stock, which the company planned to sell to the public.

Brooker said he did not write the news releases quoting him.

''Bolt wrote those things. . . . He was writing press releases that put words in my mouth.''

That month, in August 2002, U.S. Sen. Tim Hutchinson, R-Ark., asked the U.S. Justice Department to investigate Golf Entertainment for alleged manipulation of stock and defrauding investors, according to the Arkansas Democrat Gazette.

On Aug. 22, 2002, Brooker resigned as CEO of Golf Entertainment, citing a ''contractual conflict of interest'' with his job at Oral Roberts University, according to the Arkansas Business Journal. The resignation came after reporters for the Journal contacted ORU about Brooker while investigating his role in Golf Entertainment.

Brooker said by that time, he wasn't involved in running the company, though he was still listed as its CEO. He said ORU asked him to formally resign from Golf Entertainment and he agreed to do so.

Two months later, the Arkansas Securities Department issued a cease and desist order against Brooker, Bolt, Golf Entertainment and other related defendants, records show. The order states that the stock transfer and sales by Golf Entertainment and Genesis were in violation of Arkansas law.

"I had no idea," Brooker said of Golf Entertainment's operations. "I let them put my name on things and that was my big mistake. I didn't understand the stock laws."

In one SEC filing, the company states that Brooker holds dual doctorates in public sector administration and psychotherapy and is a "recognized expert in the field of performance based budgeting."

In 2003, Brooker filed a libel suit against the Northwest Arkansas Business Journal following a lengthy investigation by the newspaper into Golf Entertainment’s operations. The lawsuit was dismissed by a judge.

Oral Roberts University: Gary Richardson, the attorney who filed suit against ORU, said officials there were aware of Brooker’s lawsuits and dealings with Golf Entertainment and continued to employ him.

“Dr. Brooker was hired with his history being what it was and they continued to hire him,” Richardson said.

City Councilor Rick Westcott coordinated ORU’s government program and helped interview Brooker in 2001. He said the decision to hire Brooker was ultimately up to Swails.

Westcott said Brooker’s role in Golf Entertainment never came up during the interview process.

“Tim struck me as someone very knowledgeable about campaigns and citizen involvement in the political process,” Westcott said.

Given - Dr. Brooker has a history of filing lawsuits. The court system will consider only the facts of the ORU lawsuit - is this a valid lawsuit or not ? And, is ORU liable for damages for wrongful termination?

The point of the story is that this is a pattern with the plaintiff here. If you look at the other suits he has filed there were many false claims in them that were all thrown out. It doesn't mean that there's not a lot of shenanigans at ORU. The students at ORU need to demand transparency from this university. They should be willing to release in-depth financial information if they have nothing to hide. If nothing else, this lawsuit may end up bringing the truth out about that.

Good Grief! Why has it taken so long for this story to be in the news? People on the forum have been talking about it for a while. I'm not sure if I agree that a lawsuit is the only way to bring attention to corruption in a sheriff's office, a Christian University, etc., but the part where Brooker wanted a convicted rapist to have parole, who then killed a woman upon his release, yikes, this is a whole new twist to an already ugly story. Are there no good guys in this incredible tale?

So now the dirt is flying in every direction. Fair enough.

Anything to detract attention from the rising tide of wrong-doing surfacing about the Roberts and ORU.

So Booker has a checkered past.

So does the”convicted sexual deviant” – who exposed himself to a 15 y.o. boy --- to whom ORU and Richard gave unrestricted access and official status as a student “mentor.”

In case the logbook is lost or declared “ultra super top secret,” perhaps someone could check FLIGHT AWARE, which documents all private flights. When, where, and who was on board?

If you’ve got a gaggle of teen-agers going to the Bahamas – that’s big-buck reimubursement due --- or a big IRS tax bill. Take your pick, Richard.

-- Use your own money and don’t get free loans from ORU – If, they’re paid back, which there is reason to doubt.

AND WHAT ABOUT THOSE CLOTHES?

Clothes seem to be an imperial, royal family prerogative -- and weakness.

The deal seems to be you can buy anything, wear it once on TV, then srtick it in your 2,000 square foot closet as yours. Period. Tax-free. No fuss, no muss

Oral got into serious IRS trouble over that very issue many years ago. He even went on TV and urged Christians to pay their taxes. He was really worried when I I met him in Southern Calif about that time. He later went on TV and said, in effect, “don’t do as I do. Do as I say.” It was a kind of penance.

He wiggled off the hook, then. The atmosphere is different in these days of shocking abuse by people in power.

Now, they’re at it again. In spades!

Corporate heads are in prison now for treating corporate assets as their personal piggy-bank and perks ----without fair-value re-imbursement. How much more so when it’s the tax-free donations of people who sacrifice.

Foget the moral implications. It’s against the law. Even senators have to re-imburse for the use of private jets.

POST-FACTO SCRAMBLING GOING ON?

The word I hear – and I have a relartive working at ORU – is that there is a lot of

after-the-fact re-imbursement, record-cleaning and covering of tracks going on, now that it’s out in the open.

I hasten to add that’s just heresay, but given the Roberts’ family pattern of using donors money as their personal piggy-bank, I tend to believe it.

And, by the way, this is most likely the practice of many of these tv evangelists. Imagine the tax money due to the American people if they were all checked.

It might cut the US budget deficit

So, no wonder they want to divert attention to Booker..

And that’s what this is -- - A DIVERSION OF ATTENTION.

Booker’s past issues do not speak to the narrow issues of the civil suit.

BUT THEY SURE ARE A GOOD EXCUSE TO DIVERT ATTENTION FROM ONE’S OWN WRONG-DOINGS.

None of this can make it into court. But now with TW reporting it on the front page, it will affect potential jurors if it reaches a jury trial. There is no way jurors can block out their memory of picking up todays paper and reading this story. Even the judge will have already read this story with his coffee and strudel. If not, he will wind up talking about it during lunch with area attorneys. These guys know everything.

Carl- if one lives by the sword, one likely may die by sword. You have been yelling in comment after comment for people to take their proofs to the TW. Don't assume only those aligned with your crusade have done so. At least today's article, along with the companion one on debt, show TW will follow this wherever it goes. One can certainly see a possible pattern with Dr. Brooker. Perhaps it is he, and not Dr. Swails (the only one of the three with a shred of a wrongful termination claim- the others are defacto) who is pulling Richardson's strings. And, given the plethora of internal and now esternal investigations begun, it would be no wonder all financial records are being gathered, examined and re-packaged to satisfy all anticipated requests. And why should the University turn anything over to the TW when the 990 information is readily available. The World's other article references review of at least 14 years worth of those documents through 2006. Since ORU is on a fiscal year running July 1 to June 30th (the norm in educational circles) fiscal year 2006-2007 may not even be complete yet. It could, in fact, be a breach of fiduciary duty for ORU officials to release such information to a newspaper.

hmmm...well this story only confirms that the Roberts' are a bunch of charlatans in the first place. They hired this guy and now they are providing the slanderous material as a smoke screen to diluge people into thinking they are so innocent...give me a break...

I'm sorry, but I'm not buying this completely. The timing of this story breaking is too suspicious--first Richard does the media circuit, then ORU attorneys file for a "gag order" for the PLAINTIFFS? Then they try to get the courts to force mediation, then they try to say the plaintiff's attorney has a conflict of interest, THEN this story breaks...riiight. Let's do a hatchet job on one of the plaintiffs and try to tear his credibility to shreds. Let's point the finger in the other direction--any direction, so long as it's away from Richard, Lindsey, and ORU. I have a hard time believing this story wasn't a back-door handshake with ORU.

I'm not saying Booker doesn't have blemishes in his past; he probably does. Neither do I just accept that all the lawsuit allegations are true. What I am saying is that when I see the defendants' tactics here, I do NOT see this as the way innocent people should act. When a Christian is falsely accused, there is a Biblical way of dealing with it, and that is basically to let your clean record speak for itself. That's not what I see happening here. All I see is repeated attempts to just make this go away.

My gut says that Mr Brooker is a self promoting person who feels that he's unappreciated and undervalued by many. You sense a smell of self righteousness and "I'm a victim" from him. That aside the real issue is did he get "fired" for turning over documents to the BOR that were embarrassing to Pres Roberts? Did he steal those documents and try to blackmail or extort something from the University? What is the truth or are they both true? I pray God heals this and uses it to accomplish a strengthening of ORU and the Kingdom of God.

Dtaylor-Yes, it probably was SC. I'm not sure why she would come on here to try to defend her lies. My first quess is that it really scares her that there are individuals on the thread that are close to this and take the time to share the truth. Secondly, I think she is a person deperate for attention and control in all areas of life. Her "outing" herself last night on the other thread confirms that, in my opinion. She likes attention. She likes feeling like she can control some of this. I think it really is a thrill for her that she is the reason this mess got started in the first place (the report).
