Guthrie coach accused of sex with students

GUTHRIE -- An assistant basketball coach has been released from the Logan County jail on $45,000 bail after his arrest on 11 counts alleging he had sexual relationships with his students.
James Sterling Gilbertson, 27, was taken into custody at his parents' home on Thursday, the same day prosecutors charged him after a two-week investigation by Guthrie police.
According to records, Gilbertson was an assistant girls' basketball coach and taught accounting and business math for the past three years at Guthrie High School. But district Superintendent Terry Simpson said in a statement Friday that Gilbertson is no longer employed by the district.
"...(I)t is the policy and practice of Guthrie Public Schools to do everything in our power to protect our students and their rights," Simpson said.
Police were called in when the mother of one of a 15-year-old girl received what she called an inappropriate text message she thought was intended for her daughter.
Three others claim Gilbertson had been sending them text messages and nude photographs. Two of them admitted having a sexual relationship with him, according to a court affidavit.
Gilbertson was charged with three counts of forcible oral sodomy, three counts of sexual battery and five counts of rape by instrumentation. None of the charges involve the 15-year-old who received the text message that started the investigation.
According to a court affidavit, Gilbertson had inappropriate contact with three female Guthrie High School students on four different occasions beginning in December.
At his arraignment on Friday, Associate District Judge Larry Brooks said Gilbertson couldn't take another teaching position or have contact with any of his three alleged victims.
Gilbertson also was ordered not to have any contact with a female under the age of 18 except for family members.

In no way am I agreeing with what he did, but some high school girls these days dress like prostitutes. Some even act like prostitutes. I can't believe some of the things that high school and even grade school girls wear these days. Do the parents know what their kids wear? If so, how can they be okay with it?
Of course, this still shouldn't have happened. The teacher should have known better.

If your 15 yr old daughter or sister were having sex w/her
basketball coach would you think it were ok? Tearchers, Coaches, Clergy, Scoutmasters, etc... should all be held to a higher standard or moral conduct BECAUSE they are entrusted w/our children not just because its also the LAW!!!

The coach should not get away with this. he did break the parents and public Trust. So many young girls today dress in away that they look older, and most of them know all about sex and some use it by teasing. and they start way to young. the way a lot of them dress and strut themselves and pretty well show it all. it is just too much for a lot of men to resist. I don`t know what, but some changes need to be made. and yes the coach needs to be punished. and not be able to work in another school or around girls any more.

Alright here is the deal--these girls are minors ---it doesn't matter HOW THEY DRESS or HOW THEY ACT- they are children and as a RESPONSIBLE ADULT the Coach should have practiced SELF CONTROL --no matter where he is --as a coach or just as an average citizen. I can't believe anyone would say girls "strut themselves and pretty well show it all" and that "it is just too much for a lot of men to resist" I can't believe that we are making excuses for the lack of SELF CONTROL--pathetic!

This is happening more often then not with teachers. Uniforms should be required in schools and maybe teachers aides should be in every classroom. Soon teachers will be associated with child molesters just like the catholic priests are.

Ok folks, I am a teacher, and heres the deal. There is no excuse for sexual contact between a student and a teacher...period. Teachers are supposed to teach, but also be examples of how functional adults act, and when kids see this kind of behavior from adults, it lessens the impact of that example, from any adult. So for the sake of the children, act like adults, and teach by example.

I found this under Oklahoma law regarding age of consent:
§21-1040.13a. Facilitating, encouraging, offering or soliciting sexual conduct or engaging in sexual communication with a minor or person believed to be a minor.
A. It is unlawful for any person to facilitate, encourage, offer or solicit sexual conduct with a minor, or other individual the person believes to be a minor, by use of any technology, or to engage in any communication for sexual or prurient interest with any minor, or other individual the person believes to be a minor, by use of any technology. For purposes of this subsection, “by use of any technology” means the use of any telephone or cell phone, computer disk (CD), digital video disk (DVD), recording or sound device, CD-ROM, VHS, computer, computer network or system, Internet or World Wide Web address including any blog site or personal web address, e-mail address, Internet Protocol address (IP), text messaging or paging device, any video, audio, photographic or camera device of any computer, computer network or system, cell phone, any other electrical, electronic, computer or mechanical device, or any other device capable of any transmission of any written or text message, audio or sound message, photographic, video, movie, digital or computer-generated image, or any other communication of any kind by use of an electronic device.
§21-1111. Rape defined.
1. Where the victim is under sixteen (16) years of age;
8. Where the victim is at least sixteen (16) years of age and is less than twenty (20) years of age and is a student, or under the legal custody or supervision of any public or private elementary or secondary school, junior high or high school, or public vocational school, and engages in sexual intercourse with a person who is eighteen (18) years of age or older and is an employee of the same school system.

This jerk is a predator.
I have to commend district Superintendent Terry Simpson for doing the right thing and calling the police in the interest of protecting the students.
A lot of school districts would have done nothing but ask someone like this to quietly leave, allowing him to go to another district and find new victims.
Good job, Superintendent Simpson. Really good job!

I agree tfromtulsa. A lot of school districts would not have wanted to mess with this situation. Especially when he's a "good ole boy". Educator's are supposed to be held to a higher moral and ethical standard. Educators to be are taught that in college. It would be nice if all young ladies dressed like nice young ladies, but the fact of the matter is that shouldn't ever matter what they dress like; it's up to the adults to act like responsible and not like dogs.

I am also a teacher/coach (and a Catholic!). There is absolutely no reason an adult should ever even begin to get into an inappropriate relationship with a minor. Common sense should prevail. However, as in all facets of life, there are those who have alterior motives. Most teachers (and Priests) are not "child molesters," as is alluded to. Most of us do what we do because we want to make a difference. I went from a six figure income and (willingly) became a teacher for this very reason. Please do not throw out ridiculous comments based on what your narrow view percieves is the norm.

I am from Guthrie, I am a teacher at the school, and these girls were very nice, well respected girls. It was a shock to everyone outside of the district but it was obvious he selected his victims carefully. They didn't dress trashy and they were all good students. So far, over 20 girls have been interviewed by the police. The age of consent is 16, unless you are a teacher. Then it is 20 pertaining to students. Those within the district, working at the HS, turned this guy in several times for the texting and inappropriateness and the principal did not take action. He should have though, and I'm sure that is going to come out soon.
The HS principal knew about the texts a LONG time ago and did nothing. The teachers have complained about this immature, incompetent teacher for a while, but when his mama works for the superintendent.....well, we can only speculate as to why he didn't get fired sooner! Oh wait, he didn't get fired, he was allowed to resign.
I am not sure if the super knew about this, but he didn't fire Gilberson when he found out, he allowed him to resign. He knew about this a couple of weeks before school ever let out, the principal knew about the text's at the beginning of the year, and possibly had incidents as early as last year and did nothing. I'm not sure who is to blame, but something should have been done a long time ago.
For the idiots on this blog who are blaming the girls, you should know better! Who didn't have a crush on a high school teacher? I know I did and they wouldn't give me or any other "crusher" the time of day. That is how it is supposed to be. By the way, several girls reported the texting, stating it made them uncomfortable, wanted to change classes even b/c he was their teacher. NOTHING was done then!
This isn't the first time someone at GHS was allowed to resign after allegations were brought up. The other guy, former athletic director, Calvert, went on to molest more girls and I believe the sicko married one from Deer Creek? At that time, Simpson was ass. super. as director of personnel. Now he is super and is making the same mistake twice. This guy should have been fired, not allowed to "resign".

What is wrong with some of you who are saying its the teens fault!! Karma is going to get you! The teacher is an A D U L T! THAT WORD MEANS HE / SHE IS MATURE! MATURE MEANS THEY ARE WISER, KNOW RIGHT FROM WRONG!!
The teens are just kids learning right from wrong. This teacher should be sentenced to prison for every count!! My goodness I do see why the world is becoming what it is.

The school board needs to fire the entire high school administration for dereliction of duty. They abandoned these young ladies, and left them in the hands of a sexual predator, a pedophile. He preyed on high school girls under the guise of being a high school coach. In addition, other teachers and school administrators knew about his provocative text messages to these young ladies, but failed to act. The staff of Guthrie High School failed these young ladies and allowed a sexual predator to prey on these girls. In Oklahoma, the age of consent is sixteen; however, if you are in a position of authority, it's considered second degree rape.

seems like some coaches "hugs" are a little too cozy. and some hugs last a little longer for some than others. i'm not any more comfortable with girls having certain "female" (if you can call them that) coaches either.

Annie, Baby Boomer & Nickel Dime, sounds like you are all also child predators or have some kind of physcological problem to think that these girls are to blame. You should all be ashamed of yourselves. We ALL hope that you will never be on any jury that pertains with children & sexual predators. You obviously do NOT have children of your own. Thank God you don't with your mind frame. If he can't control his horrible evil ways towards innocent children, that is his problem, not the girls. It does NOT matter what KIDS wear these days, that has no bearing on how an adult should behave around CHILDREN! And by the way ANNIE, it doesn't take a rocket scientist to know that it is RAPE and they should "Cry RAPE", because that is exactly what it is! This disgusting animal must be your boyfriend or something for you to be supporting his horrific actions and defending him.

gee, sounds a lot like our school admin. how many complaints to them about alcoholic teachers, verbally abusive coaches, lying teachers, teachers who mess with grades because they know they can and challenge the student to have to get it right.
admin just ass umes that the teacher is always right - until too late.

I understand Bluejays comment for firing versus resignation.
I think I also understand what the administration has to consider. Perhaps the administration has to take into consideration the risk of an allegation being disproved later. Firing an employee for charges later disproven puts them at risk for legal action.
Resignation frees the administration from this risk.

WHATEVER HAPPENED TO INNOCENT UNTIL PROVEN GUILTY? Unless you know this individual and have worked with him for years as I have, please keep your uninformed accusations to yourself. These are bogus charges and you will have egg on your face after this is settled.
This whole issue is a result of kicking God out of public schools so that these females, who have no conscience, care nothing about ruining a good man's life.
