A former high school English teacher accused of killing his wife will be arraigned on Nov. 17, a judge ruled Monday.

John Robert Kastner is charged with first-degree murder in the June 25 shooting death of his wife, Lori Kastner, a former Oklahoma Supreme Court attorney.

Kastner appeared in district court Monday morning wearing a red jail uniform and shackles on his hands and legs.

He initially was scheduled to be arraigned Monday, but additional time was granted for Kastner's defense attorney to review a transcript from his preliminary hearing held last month, First Assistant District Attorney Doug Drummond said.

Drummond also said a jury trial date most likely will be set at Kastner's November arraignment.

Last month, Tulsa County Special Judge Cliff Smith determined there was enough evidence for Kastner to be tried on a first-degree murder charge after the preliminary hearing.

Kastner initially told police an intruder broke into their home and used the couple's gun to shoot his wife twice in the head and that he was shot in the hand during a struggle for the weapon.

Police say the story fell apart under investigation.

A telephone message left Monday with Kastner's attorney was not immediately returned. For months, Kastner told family and friends that he was a member of the Israeli Special Forces and

that he had access to millions of dollars due to a charitable corporation associated with the Israeli military, according to a police affidavit.

He had told his family that they were leaving for a trip to Israel via a private plane on the day of his wife's murder, but investigators said they determined no such corporation existed and that no flight was scheduled.

Even though the rest of the family obtained passports for the trip, Kastner had no valid passport, and the one he did have expired in 1995, Richard Higbie, an agent with the State Department's Bureau of Diplomatic Security, testified at the preliminary hearing.

The hearing also featured testimony from the Kastners' 19-year-old adopted daughter, Sally, who recalled that John called her into his bedroom several days before the shooting, saying he wanted to show her something.

She saw him take a gun out of a black case and believed the weapon to be loaded. "He said it was a .22, it goes on your ankle, that's about it," Sally Kastner testified.

She said he told her he bought the gun "for safety" when the family was to leave on a trip to Israel.

A police affidavit asserts that about "a month prior to the murder of victim Lori Kastner the accused came under intense financial pressure as a result of the false financial promises he made to family members, friends and co-workers."
