Bixby city manager suspended
He had charged that its City Council was breaking a state law and its city charter.

BIXBY — City Manager Micky Webb was suspended with pay Wednesday by the City Council after he accused the council last week of violating the city charter and the state's open meeting law.

The council voted 5-0 for the suspension during a special meeting Wednesday morning but declined to give any reason.

Webb's attorney, Christopher Camp, provided a letter to the Tulsa World that Camp said may have precipitated the decision. In the letter, sent April 30 to the councilors and Tulsa County District Attorney Tim Harris, Webb accused the council of ordering him during an April 27 executive session to fire several employees, which he said violates the city charter.

Webb also believes that the council violated the state's Open Meeting Act because none of the alleged requests was listed on the meeting notice or agenda.

"It was improper for them to ask him to do that, and then the way it was carried out violated the act," Camp said.

"The timing of the suspension is suspect, coming just days after the letter."

Employees whom Webb alleges he was directed to dismiss include City Clerk Cheryl Sasser and Assistant City Manager Mike Webster.

Sasser was scheduled for a pre-disciplinary hearing April 30, Webb's letter notes.

Webb wrote that he was not considering Sasser for dismissal because "any alleged misconduct does not rise to an offense warranting immediate termination" and because of her exemplary service record.

City Attorney Phil Frazier would not comment on the reason for Webb's suspension, calling it a personnel matter.

He said he did not know when further action would be taken. "I'm sure there are other matters to look at before moving ahead with the process," he said.

Mayor Ray Bowen and Councilors Steve Sutton and Steve Todoroff, declined to comment on the suspension or the accusations, referring all inquiries to Frazier.

"The city attorney needs to handle any questions related to legal issues for the city," Sutton said.

Harris said the District Attorney's Office plans no investigation at present but added that it would send a letter to the city councilors, calling their attention to the allegations and the pertinent laws.

In a letter following the April 27 executive session, Frazier warned the council about protocol for executive sessions and attached a copy of the state's Open Meeting Act.

Frazier wrote that he had been "somewhat lax in letting the conversation in executive session go beyond the (designated) subject matter. I ask your understanding and patience as I become more concerned about wandering from the agenda items."

Frazier said Wednesday, however, that it is his policy to send advisory letters about the rules to the council every time new councilors come on board.

Sutton and Councilor John Easton were elected in April, and their first council meeting was April 27.

The city charter states: "Neither the council, the mayor, nor any of its other members may direct or request the appointment of any person to, or his removal from, office or employment by the city manager."

The council discussed the suspension in executive session before returning to regular session to vote. City Treasurer Becky Byers was appointed the acting city manager.

Webb, who did not return calls Wednesday, has been the city manager for 16 years.

Camp said Webb's contract with the city was renewed in March and would be effective through June 30, 2010. Under the agreement, the city may only terminate Webb "for good cause shown," Camp said.

1 good city manager, 5 councilmen that do not know how to conduct meetings and what can go on in an executive session, and 1 mayor thats not a good rep. of the city....nice and honest guys really do finish last. Thats Bixby's loss if they run him off, and also he will be paid out his full contract, really might be a blessing in disguise for Mickey. Hang in there man, you are in the right.

Jenks needs to follow suit. The Jenks city manager in my opinion is in need of the knowledge that the people of jenks are the reason for his salary. He could not make it in the private sector for sure.

MR. im4osu and Moses...unless you have lived in Bixby within the past 20 years, then you need to stay out of our politics. First of all mickey (and no that is not a typo..I only capitalize people who deserve it) has never done right by the citizens of this town. He has constantly misconstrued the truth for his own benefit. He has lied, boldface, to the citizenery of Bixby since the day they hired him back. He has run amok with the consent of the good ole' boy network that used to run this town, and now that we have people in there that are not part of the establishment of this city,let the ouster of the network begin.
As someone who has had more than my fair share of dealings with mick and the good ole boys, I am thrilled that he is finally going. This city has had unprecedented growth and nothing to show for it. Our roads are a mess, we have flooding issues that surpass anyone's imagination, a fire chief that is unable to do his job( who was hired by the boys) because he is beholding to them, rampant traffic issues and to top it all of, the loss of a target superstore that should have gone in at 121st and Memorial instead of 101st and Memorial. My Mommy always said "good riddance to bad rubbish"which is appropos for the mick.

wifemompara.....ok that is fair. But just remember, you can't make comments about the going ons in the City of Tulsa. It seems some of the people in the small towns around Tulsa are quick to make negative comments about Tulsa. My feeling is for you small town (small minded) people stay in your own little towns since you don't like Tulsa.

maybe all same towns have the same problems..but this one really hits home..ya'll have no idea what hubby and i have gone thru with this city for the past year..i just want people to know that unless you have lived here don't jump to conclusions that will in the end bite you in the butt. You can and should not always believe what you read in the paper..the city has yet to make a response because of the legal implications, so let's wait for the city's side before you jump on the mick bandwagon..

wifemompara,I have no dog in this fight but most posters here are very familiar with public corruption and the good ole boys network.Every town seems to have one.AnativeTulsan is right its all our business we dont want make the mistake of letting some one in our city gov circle if it needs to be stoped.We have already had wool pulled over eyes so many times its hard to refocus.

agreed . we all need to keep a much closer eye on our elected officials. Just make sure that you are active in your city and not just financially. Attend meetings of your council and school board. Get involved with your homeowners' organization. Don't just talk the talk.

concernedpapa...webb is part of the good ole boy network. if you had read the article webb has been with the city for 16 years and is appointed there fore part of the network. the new council memgers who were elected in april are not of the network and are trying to clean up city hall.

For some cleaning up city hall is a nice way of saying do it my way or the hiway. I read the article and stand by my post. If the city of Bixby is trying to evade the open meeting clause they should be stopped regardless if you voted for them or not. If you want to remove the city manager do it. Don't wait until he reports an improper act and then susspend him. If you read the article then you must have read the quote from the city charter. Him being there for 16 years only enforces what preacher Jim on the show Taxi said about Tony, the corrupt union rep for the drivers. " Nothing takes the place of experience."

The city manager serves at the desecration of the city council. They hire them and they can fire them. Webb has a contract that needs to be bought out, are they [city council] prepared to do that? If not just don't renew his contract in 2010.

This is about due process of law, whether it regards following proper procedure as to the "Open Meeting" laws, disciplining employees or terminating their contracts. Councils have to observe due process just like everyone else, regardless of their motives. Phil Frazier is a smart guy, hard to believe he would let them get away with this stuff unless they did it when he wasn't at the meeting.

I've lived in Bixby for almost 20 years and I agree 100% with wifemompara. Good riddence to the "good ole boy" system that has been in place in Bixby for a very long time. There has been corruption in the city, with the city manager, city clerk, etc.....Do the research, you can find the trash that happens in the city of bixby.

The only thing more ridiculous than the Bixby School Board is the City of Bixby's government.

How can these moron's consistently run off businesses? The story I heard is that the City of Bixby demanded 6 months of sales tax up front from Target to complete the infastructure necessary to support the store.

I do know for a fact that Wal-Mart left Bixby after the flood of '86 when Bixby used Wal-Mart's parking lot to stage flood debris/waste. The heavy equipment used destroyed the concrete, and Bixby refused to compensate Wal-Mart for the damages. Wal-Mart explained to Bixby that if they did not make things right that Wal-Mart would never be back. Sure enough Wally World built a store as close to Bixby as they possibly could without being within the city limits. Now the sales taxes being paid by Bixby residents are going to Tulsa.

The management of the City of Bixby has screwed this town for years to come, they have pushed Wal-Mart and Target out of town. Keep up the good work you dimwits, at least we'll always have the sod farms and if you bankrupt one of those you can become the fire chief.

glad to see others from our town speaking up...only those who actually have lived here for many years know how deep the corruption in this town runs (let's not forget the councilmen whose daughter worked for the city and was caught misappropiating funds)...that is why we voted out the two city councilmen. Let it be known that the others who have been on the council for way too long, their time is coming. The town has been run by a few very old and wealthy families, but hopefully with the new blood this town has seen in the past ten years we can get a sweeping change. The council for many years has let this city fall into disarray, with major traffic issues and roads that are down right dangerous,and allowed uncontrolled growth which has caused new and more devastating flooding which caused the federal government to step in and force the city to do something about the severe repetative losses our citizens have had to endure, yet they waste my tax dollars fighting the City of Tulsa over drainage issues instead of cleaning and repairing their own backyards.

I say "fire them all" and good for the City Council. Bixby employees are the least responsive group of city workers in history. Small town employees doing small town work in a city that is no longer a small town. A new City Manager is a great start.
