Ex-Cowboy accused of rape twice in 5 months

STILLWATER — Jamal Mosley, who quit the OSU football team after being accused of raping a female student in August, had been accused of raping another student in March, the Tulsa World has learned.
A rape examination was performed and evidence was collected in that earlier allegation, but the case was closed when the victim decided not to cooperate in the investigation.
"At this time the victim is not sure if she wants to press charges because she does not want the suspect to lose his scholarship," states the Oklahoma State University Police Department report, dated March 12, that was obtained by the Tulsa World.
The report says the woman went into Mosley's room at Bost Hall late on the night of March 6 and waited for his arrival.
When he arrived, she thought he was drunk because of his behavior and loudness, which she said was the opposite of his "normal shy self."
The woman told campus police that she told Mosley "no" and tried to push him off when he initiated physical contact, according to the report.
She said he pinned her hands above her head and broke her zipper when he pulled off her jeans before forcing intercourse on her, the document says.
She told police that she went home but returned to Mosley's room after he sent her a text message about 12:30 a.m. March 7, asking her to come back and discuss the situation. She said she left when he again initiated sexual contact, according to the police report.
She told police that the two later
exchanged text messages:
"That's so messed up how you just took advantage of me and you have no idea," the report says she wrote to Mosley.
Mosley replied that he was sorry. Two days later, he texted again, saying, "Do what you have to do," the police report says.
A source close to the Cowboys football program indicated that Mosley and the woman dated for two months after the alleged rape.
OSU spokesman Gary Shutt said he is not sure if evidence collected in the closed case was kept on file or destroyed.
Shutt said police are still investigating the rape that is alleged to have happened in August.
A relative of the woman in that case said most of the rumors going around on radio and Internet forums are completely false.
It is Tulsa World policy not to identify alleged victims of sexual assault or their relatives.
"The talking heads have been vicious, and it's unfortunate. We're talking about a lady whose life is already traumatized, and they're just feeding the fire for ratings," said the victim's relative, who serves on the board of governors for the OSU Foundation.
The relative said one of the biggest rumors is the notion that Mosley, a starting tight end, did nothing wrong and was railroaded out of town in a political deal.
"She knew him. I don't know if she was dating him or not, but to me that doesn't matter," he said. "You can't rape your girlfriend."
The relative said he believes that Mosley's actions — two alleged rapes and a marijuana charge — during his time at OSU should be "enough to kick you off any team."
OSU football coach Mike Gundy announced earlier this week that Mosley, a sophomore starter, had left the team for personal reasons.
The victim's relative said his family member is white but that the woman who told police Mosley raped her in March is black, "so they can't pull the race card on it."
The victim's relative said the incident is a "lose-lose situation" for everyone.
"We as a family have left it in the hands of the DA," he said.
Gundy was not available for comment Friday, a university spokesman said. Gundy deferred all questions to Shutt.
Shutt said campus police have no formal policy on notifying the coaching staff when one of its players is a suspect in an alleged crime.
"They're not obligated to," he said. "With the incident in March, the coaches were not told about it because the reporting party did not want to pursue it, so the case was closed. The police did not contact the coaches about this incident once it was closed."
When Mosley and his teammate Dexter Pratt were being investigated in June on an allegation that they had marijuana in their apartment, police called coach Dale Patterson in an effort to locate the players for questioning, records show.
"I contacted Coach Patterson of OSU football to inform him what I found in Pratt's and Mosley's residence," the officer said in the report.
According to the report, police were dispatched to an "unoccupied room."
A residential assistant told the officer no one was living in the apartment, but the officer wasn't convinced after seeing a television that had been left on and marijuana residue on a coffee table, according to the officer's report.
The RA then told police that the two football players lived there, according to the officer's report.
Mosley and Pratt blamed a woman from Oklahoma City for bringing the marijuana to their residence and said their use was "experimental."
Records do not indicate the woman was charged. Marijuana possession charges were filed against Mosley and Pratt in July.

Girlfriends can be raped, but I'm not so sure that's what happened here. If the facts of the case are as stated I doubt the DA would file charges. SHE did not file charges. She went back to his room the same night. They dated for 2 months afterwards. What jury would convict with that info?

So when this kid is at Tennessee next year, will the Tulsa World keep posting articles about him?
This is the fourth one this week.
You guys should hire a private investigator and have him tailed for the next couple years...then dedicate a blog to daily updates.

Outrageous, you're a bit of a dunce. Can a coach foresee how a kid will turn out two years later or even after they land on campus?
And pray tell does your school, the one you cheer for, have angels playing for its sports teams and prophets for coaches?

I appreciate the Tulsa World for pursuing this matter further. I feel like I allowed too much possibility in things I posted earlier that Mr. Mosley might have been set up. Given all that's happened, it's clearly best that he not be a member of the OSU football team even though he was obviously a gifted athlete. It's too bad. OSU has given some people second chances in sports ... sometimes it has worked notably well, sometimes not. The coaching staff doesn't seem to want this young man around now, so if they could have clearly foreseen all this beforehand, I'm sure they wouldn't have taken him in the first place. And, it's worth asking, would we be less forgiving of the coaching staff if they went out and recruited a bunch of people who were all predicatably perfect angels and also predictably unable to play competitive football at the FBS BCS league level ? No. But, some things are worse than others. Nebraska saw fit to let a guy who had physically beaten up at least one girl play a big role in a National Championship game for them, which they won. In large part because of him. Completely shameful. But, a lot of people in Nebraska didn't seem to care. It seems like I heard something about some Miss Nebraska who did care and said she was told to keep quiet about it. As for OSU, at least this poor young man who got himself into these problems isn't still around. If he avoids maybe getting put on trial over this or worse, hopefully he'll stop getting into this kind of issue with girls in his life. And, hopefully his case will be a warning to other guys that yeah people really appreciate athletes who compete for their schools, they really really do, but there are still things you can do to screw that up. If all the athletes screwed things up like that ... well, maybe then people wouldn't have to worry anymore about the price of season tickets or what some coaches get paid ...

She went back to his room the same night? Is she mentally defective. Who could possible convict him of rape? Why would she do this and expect compassion from anyone? What was he supposed to think she was after? They were both drunk. Her family probably found out what happened and she claimed this to make herself not look like she was at fault for any of it. IMO she got what she was after.

Time initial contact was made was not published however if the subsequent act was performed less than fours after the original erection and a Doctor was not called then there may be a case due to a Viagra violation.

OUTRAGEOUS! "You can't rape your girlfriend." I taught my kids that "no means no." Always. I went to OSU, paying full tuition. My boys went to OSU, paying full tuition. My tax dollars go to OSU, ostensibly supporting not only the board, but also scholarships. Am I actually paying for a board that condones Domestic Violence? Am I actually supporting a state institution of higher learning which puts the football team above the law? If even one member of the OSU Foundation's Board of Governors doesn't understand that no means no, that rape is a crime of violence, that a man CAN rape his girlfriend (as well as his wife), neither the safety of of women nor respect for the law is guaranteed at OSU!
