Unborn baby killed in one-car rollover
The mother and a 3-year-old were ejected from the vehicle after a tire blew out.

A Tulsa woman who was seven months pregnant was critically injured, and her unborn child was killed, in a one-vehicle accident Friday on the Turner Turnpike.
Danielle Wells, 21, was transported to the OU Medical Center with head, trunk and internal injuries.
Her unborn child was pronounced dead at the hospital, the Oklahoma Highway Patrol reported.
The accident occurred about 5:40 p.m. in Lincoln County when a tire blew out on a 1996 Mazda MPV driven by James Howard McMillon III, 24, of Tulsa.
McMillon, who was not injured, overcorrected and left the roadway.
The vehicle rolled three times, ejecting Wells and 3-year-old Prince Antoney McMillon, who was treated and released.
Only the driver was wearing a seat belt, and the child's car seat was not secured, the OHP reported.

I always hurt when I read stories like this happening. Tragic accidents happen all of the time and I could not imagine what this woman and her family are going through. I am so sorry to hear about her loss and hope that she will recover siftly.

renay22, I think willi is making a reference to the mother whose baby drowned in the bath tub last week when she stepped away for a moment. They charged her with 2nd degree manslaughter.

Ranay22, their rational was she failed to do what a reasonable and rational person would do to protect a child. It could be they might bring similar charges in this case. In that she failed to use a seat belt. Though the child was unborn, Oklahoma law has established that a person can be charged with the murder of an unborn child past the first trimester of gestation. So well see what happens.

I have heard of pregnant women claiming how very uncomfortable it is to wear a seatbelt while pregnant. I wouldn't know, never been there. Either way, I feel for the mother. and T.B'Ville is right, They are lucky the 3 year old survived. Still a little fuzzy on why the car seat was not secured.

Ranay22..because the mother has a responsibility to care for the fetus. It is just as negligent to use cocaine and cause the fetus to die, as it is to not wear a seatbelt. And, because she did not wear a seatbelt, the fetus was critically injured. That is probably negligent homicide. They are lucky the older child, whose seat was not secured, is OK. That's my view. When the grieving is over, there will be an investigation, I think.

Charges should be filed. This is at best child endagerment for not having the car seat scured and at worst negligent homicide for the killing of the unborn baby due to not wearing the seat belt.

peelumba - at seven months of pregnancy it is a CHILD not a fetus. Babies born at seven months do survive and live. When a woman is pregnant, she is pregnant with a baby.

Ah Ha! see the mentality of today. There are those who want to file charges. Do you think they are thinking in terms of revenue or responsibility? Me thinks we are living in a police state today due to some of the comments. A tire blew out so we go to tire manufacture for causing that accident. About seat belts, I have had to observe a person dying because of a seat belt.

The driver made three errors, each of which could get him a traffic ticket: (1) driving with bad tires - unsafe car; (2) overcorrecting after a tire blow out -reckless driving; (3) not requiring all occupants of car to wear a seat belt - violation of State law.
An unborn baby can be aborted so it is not a legal being that can be murdered. The driver cannot be charged with the death of an unborn child due to a motor vehicle accident.
