Pittsburg Co. DA will not seek re-election

OKLAHOMA CITY -- Pittsburg County District Attorney Jim Bob Miller has entered a deferred prosecution agreement and will not seek re-election, Attorney General Drew Edmondson's office announced Thursday.

Edmondson's office runs the state's multicounty grand jury, which was investigating allegations that Miller caused a subpoena to be issued when he did not have the authority to do so.

The subpoena was sent to Harold King, who operates a blog, said Charlie Price, a spokesman for Edmondson's office. The blog had been critical of Miller, Price said.

"He was wanting information from the blog," Price said. "It is our opinion that he did not have the authority to issue that subpoena." King's blog is called the McAlester Watercooler.



King, 60, was not in favor of Miller being able to finish his term. "He needs to leave office immediately," King said. "Anything else is a political cover up."

To settle the state's concerns, Miller entered a deferred prosecution agreement on the misdemeanor charge of "common barratry," according to Edmondson's office.

Common barratry involves groundless judicial proceedings.

The agreement requires Miller to waive the statute of limitations for the alleged crimes so the state can pursue the allegations should he violate the agreement. In addition, the agreement requires Miller to recuse his office from any investigation where he or his staff are the alleged victim, according to Edmondson's office.

Miller could not immediately
be reached for comment.
