Spousal assault case against officer tossed

A domestic assault and battery case against a Tulsa police officer has been dismissed.

The three-count misdemeanor charge against Officer Ronald E. Montgomery was dismissed after prosecutors were presented with an affidavit stating that the accuser no longer wanted to pursue a prosecution, First Assistant District Attorney Doug Drummond said Tuesday.

Montgomery, 31, was charged Aug. 10 with domestic assault and battery in the presence of a minor, pointing a handgun at his wife and interfering with an emergency telephone call.

The counts involved allegations that he assaulted his wife, Stacy Montgomery, at their home in Bixby in July.

Ronald Montgomery said the argument had been only verbal and that he had not touched his wife, a Bixby police affidavit states.

After the allegations surfaced, Montgomery was placed on leave without pay, a Tulsa Police Department spokesman said in August.

While the case was pending, he has been assigned to restrictive duty. With Monday's dismissal, Montgomery will return to full duty as a patrol officer, and an internal review will take place, a department spokesman said.

Divorce proceedings between the Montgomerys have been initiated in Tulsa County District Court, records show.

I guess she doesn't want him to lose his job since he will be paying child support and possible alimony. I hope we don't hear more about this cop in the future if he truly has this kind of anger problem.

The thin grey line was more prominent in the 80's. Tulsas finest hired Tulsas finest to commit the crossbow murder. Conspired with a fellow officer to murder his estranged wife. Brotherhood at it's finest.
Oh yea about the thin grey line again. Tulsas finest eventually snitched on tulsas finest in that event. Aahhhhh brotherhood.

He may not have touched her but I bet after he found that he couldn't point his baton and get a desirable effect that he did point his gun (weapon) in an effort to get a response. Not a good example for children. I bet she changes her tune after he gets clear of the home.
Anybody need any good sod fertilizer???

Doesn't this state pursue domestic assault/battery charges regardless of the victim's wishes? That's the way that most states handle it since the victim is usually intimidated into dropping the charges with more violence (or a threat of violence). Wouldn't pointing a gun at a person be a felony? He should have been in jail not just on administrative leave...

I guess they don't, Iam wondering why, a police officer maybe? I don't want to say anything bad about the police but with high stress jobs, this can happen. Maybe no physical abuse happened, but geez, a gun in your face, thats enough for me to drop on the spot and wonder about the next time....see you later. I don't wish anyone to loose their job, only if they do have problems they must be treated, no shame there, it could save his life. Yes, both men and women lie, most children don't, abuse of anykind by anyone is so very scary, walking on egg shells is so hard. I hope they all can work things out. If they could only take it all back.

Statistics state that a woman will attempt to leave an abuser 7 times before they are finally done. She was more than likely "gently" persuaded to drop the charges and retract her allegations. The next story we are going to hear is that she was killed with the same firearm that he brandished in front of the kids. I hope that she gets some help, not only for herself but because of the responsibility she has for the children.

I think this chick lied to get back at her husband, and when it came right down to it, she didn't want to purger herself. Glad these charges were dropped so this guy can get back to work and on with his life...

It depends on how the charges were filed, if it was the county, city or state vs the officer then the wife has no say. If it was the wife vs the husband, then she can drop it.

Criminal charges are never filed as one person against another. They are always filed as the State VS the alleged suspect. However, if the alleged victim indicates they no longer wish to cooperate in the case, ie: not testify, etc..., and the State has no other evidence, then the DA's office often times has no alternative than to drop the charges.

Also, in this state, pointing a firearm at someone is Feloniously Pointing a Firearm With Intent To Do Bodily Harm. There's also a misdemeanor version that reads exactly the same. I find that sort of odd since I'm not clear on what exactly is the difference between the two.

The so called leaders of this city need to get control of these renegade city employees who reportedly abuse their spouses, sell drugs out of the city vehicles, shoot up the town, and do as they please with no accountability. It's getting better, so keep emailing city hall. These guys are certainly not running the city as they believe, they just employees.
