Senate OKs bill allowing health-care reform suit

OKLAHOMA CITY — A measure allowing the Legislature to sue the federal government over recently enacted health-care reform is headed to Gov. Brad Henry's desk.
The Oklahoma Senate on Tuesday approved House Joint Resolution 1054, which is designed to allow citizens to opt out of federal health-care reform.
"It would prevent the federal government from forcing any Oklahoman to participate in any health-care system," said Sen. Randy Brogdon, R-Owasso, who is running for governor. "It would also prohibit the federal government from dictating how doctors choose to care for their patients.
"Finally, the measure authorizes the leaders of the Legislature to hire outside counsel to represent Oklahoma in a lawsuit to prevent 'Obamacare' from being forced on our state."
Oklahoma Attorney General Drew Edmondson, a Democrat who is running for governor, reviewed the federal law and said a lawsuit would likely fail and would waste resources.
Brogdon, a Senate author of the bill, said the Goldwater Institute has offered to represent the state at no cost.
Rep. Mike Ritze, R-Broken Arrow, is a House author of the bill.
Sen. Richard Lerblance, D-Hartshorne, said federal law is the supreme law of the land and supersedes state law.
He said the state recently passed lawsuit reform to deal with frivolous lawsuits but that there is no evidence it has reduced the cost of health care or resulted in health insurance for more Oklahomans.
"Mark my words: People will be out on a limb to pay to prosecute this frivolous lawsuit," Lerblance said.
Sen. Judy Eason McIntyre, D-Tulsa, called the measure a "very, very, bad, bad bill."
"It does nothing but to incite the people," she said.
She said lawmakers have the opportunity to do something other than "use this hot-button issue to garner political support."
Brogdon said federal health-care reform creates socialized medicine and destroys the free market. He said he is trying to protect the state's sovereignty.
The measure passed by a vote of 25-17.

Once again our morons in OKC feel the need to waste more money we don't have.

Surprise! And, the "reform" amounted to Oklahoma taxpayers picking up the tab for malpractice awards in excess of the "cap". Oklahoma physicians now only need maintain $400,000 in malpractice coverage (versus the previous $1 million ... still haven't heard from anyone that his/her charge for an office visit was reduced). Oklahoma taxpayers are subsidizing the difference! The insurers of Oklahoma didn't lose a cent! But, that's what the Okie yahoos wanted!

Seymore1965...Do you know what this healthcare bill is going to do to Senior Citizens?????? I am seventy-seven years old and have been told by two of my Doctors that they are considering either retiring or changing fields!!! There is already a shortage of family physicians and they are adding thirty million more people to healthcare??? My Dr said he would have to call a mediating board (approved by the Obama administration) to get an approval to treat me in the manner he deams necessary. I heard Obama, myself, say that some of us would probably have to take pain pills instead of having hip surgery or whatever treatment I needed. They (Obama administration) are taking fify billion dollars out of the medicare system in order to set up another
Medicaid type account...there will be nothing left to treat to senior citizens!!! I agree we need healthcare reform...why don't they correct the flaws in our current system instead of starting from scratch??? Eighty percent of the American people are satisfied with their insurance they have now!!!!
Have a heart for the ones of us who will suffer the most!!! The Obama administration has put the senior citizens on the "death" list and most of us have no other means of paying for our illnesses. DO YOU CARE SEYMORE1965?

However, it does seem to contradict the recent abortion legislation, that the Senator supported...that would prevent a doctor from advising his client.....

Razor1911...My Doctor told me he had been to a meeting with a large group of Doctors and they were all told that their decision of how to treat their patients will have to be ruled on by the government mediating board and their decision could be in favor of the treatment wanted by the Doctor or the board may rule differently. So...the government board has the last word.

I think they ought to pay the costs of their lawsuits themselves. I don't want them wasting my money on their stupidity. They obviously need to take the office of Oklahoma Attorney General off the ballots and do away with the office. After all, when you have so many know-it -alls in the legislature, you don't need legal counsel. Just hire the Goldwater Institute to represent them. But make no mistake, the people of OK will pay for their legal representation. These kind of groups never do anything out of the kindness of their hearts. I think I'll ask the U.S. Attorney-General's office to protect my rights if OK. tries to keep me from participating in the federal health-care system.

Let me think....hmm tea party, I'll bet your doctor is a Republican. I'll bet he is one who hates socialized medicine so much that he has written protest letters against the looming Medicare payment cuts.
Oklahoma legislators, reducing Oklahoma one lame lawsuit at a time. Please veto this crude of a bill, Governor!

Skeptic...Wrong, wrong, wrong! My doctor and I are both independents...we both left the democratic party. I was a registered and voting democrat for about fifty years and suddenly I could no longer recognize the Democrat party...so, I am now a registered Independent.

Tea Party, apparently you don't recognize that your insurance company decides on what treatments you can and can't have NOW -- based on what is most profitable for them. An independent non-profit mediating board, if there really is such a thing, would undoubtedly render better decisions for patients.
