Quadriplegic student battles state university over right to live in dorm

ADA — A Tupelo quadriplegic is wrangling with East Central University officials over whether he can live in the campus dorms.
Joshua Jackson, 35, an East Central University junior, was notified Oct. 21 he could not live in the dorms unless he hires an assistant to stay overnight. He must move out by Dec. 12 if he doesn’t have one. Campus officials say the decision is a matter of safety. Jackson says the $11,000 a year it would cost to pay for an assistant is not within his means.
School officials are worried about Jackson living in the dorms because he cannot move from his bed to his wheelchair without help. Jackson now has an assistant who helps him get in bed at night and out in the morning. There is not an aide in his room overnight if he needs to suddenly leave the room. The caregiver also helps with some daily chores.
Jackson broke his neck in 1999 after a car crash outside of Tishomingo. He spent 100 days in the hospital. Since then he has lived with family and on his own.

We have a lose-lose situation. A few of the students that qualify for work study could work as an assistant. The money is part of the financial aid package and so would cost the university nothing and would cost the student in question nothing. And now we have a win-win situation.

Good idea, focuses. The only thing I could think of was nursing student class credit. Your idea makes tons of sense. Hope someone considers it.

The student's Resident Advisor in his dorm should be placed with the overnight responsibility if he needs to get out of bed in the event of an emergency. Problem solved....

Only 11k a year for that kind of job? You can't live off of that. It better be a part time student job for that kind of money.

his situation is unfortunate and i admire his ambition, but I agree with B'ville...most students wouldn't want someone old enough to be their father living in their dorm.

It is not reasonable to expect the state to accomidate this person. It will cost quite a bit of money to modify a room for him, like $6,000 or $7,000 dollars. The liability insurance the dorm would have to carry would almost certainly go up 10 times if they could get it at all. I am handicapped myself and have some idea of what would have to be done.

The full story says that he was not honest with ECU about his accommodation needs. They are saying that they are fully aware of A.D.A. laws but there is an expectancy on the part of the person requesting the accommodations to be honest about the needs at hand. They say that he simply requested a wheel chair accessible room and did not state in his dorm application that he needed assistance to get into and out of bed. When the university found out that he would not be able to self evacuate in the event of a fire, that is when they told him he would have to go. If he were with the Chickasaw tribe this would not be a problem. They pay for everything related to a member's education needs. I think in this situation the school may be legally exposed if they do kick him out. They could set up a volunteer system where if he were in his room then someone who lives in the dorm would take responsibility for him. That is asking a lot in a busy world.

I wouldn't WANT to live in a dorm at 35 or any other age. Seems he would want more privacy but if he wishes to live there, I hope they find a solution.

Ok, I am going to say it! Maybe he is just a dam pervert. Get real. Who in the world at 35 wants to live in a dorm? Maybe he is just bitter and wants to bring attention to himself. He has lived on his own and with family, he can do it again.

Agreed, Rick, everyone here who thinks this man ought to be able to live in the dorm ought to cough up their own money to pay for it. There are an unlimited amount of unfulfilled needs and wants in the world, but not unlimited resources. Nobody seems to find a problem with forcing other people to give up their money by using the government as their muscle. It's easier than working for what you want or donating your own.

While I do admire his willingness to try and do something with is life, he should know his limitations. I agree with those who see the realistic part here, that he shouldn't expect for the college to fund this for him. There comes a point in ADA accommodations when you're playing the system to see how much of an inconvenience you're imposing on others. Just because life is hard for you doesn't mean you need to see how much harder you can be on others. I've got a visual disability, but I don't go around demanding accommodations. I've had to miss out on getting some good jobs for it (due to occasionally having to travel within the city). I didn't demand they allow me to not do as much work due to the time needed to get around on public transit, or pair me up with someone who can do the driving, or allow me to supply my own driver (even waiving liability for them). No, I understand the limitations and don't demand that they rearrange their own life to support it outside of what is reasonable. - There are those who only put themselves in situations they can't handle just so they can scream ADA compliance and make problems for others. Although his intentions are unclear, one sure has to wonder if this is at least part of his motivation.
