State Rep. John Trebilcock, R-Broken Arrow, was arrested early Saturday in Tulsa on municipal complaints of driving under the influence and not using headlights.
The 33-year-old lawyer was arrested at 2:31 a.m. Saturday near Second Street and Greenwood Avenue, according to an arrest report.
The arresting officer's report said, "When I made contact with the driver, John Trebilcock, I noticed a strong smell associated with an alcoholic beverage, slurred speech and bloodshot eyes."
Trebilcock refused a breath analyzer test, saying that he didn't trust the test's validity, according to the report.
He was booked into the Tulsa Jail and released about 8:45 a.m. Saturday after posting $570 bond.
The report said that in a field sobriety test, Trebilcock could not watch the tip of a pen move without turning his head, but he was able to stand on one leg and count aloud.
Trebilcock did not return telephone calls Sunday afternoon seeking comment about his arrest.
He was driving east on Second Street in a black 2006 Toyota 4Runner that did not have its headlights on when he was pulled over, police said.
The arresting officer asked Trebilcock how much he'd had to drink.
Trebilcock answered that he had "two drinks with dinner," the report said.
"When I told Mr. Trebilcock that I smelled a strong odor of alcohol coming from him, he replied that he had just kissed a girl that had been drinking and that is why he smelled like he had been drinking," the arresting officer wrote in the report.
Trebilcock was first elected to the Oklahoma House in 2002.
He is the author of a 2005 law that requires people who are convicted of a second charge of driving under the influence to install ignition interlocking alcohol-detection devices in their automobiles before they can get their driver's licenses back.
Court records show that this is his first charge.
Trebilcock is a former high school history teacher. He received a bachelor's degree in English from Oklahoma State University in 1996 and a law degree from the University of Tulsa in 2001.
