Appeals court rules federal inmate mugs not open

DENVER -- An appeals court ruled Wednesday against the Tulsa World in its effort to obtain mug shots from the U.S. Marshals Service under the federal
Freedom of Information Act.
The 10th U.S. Circuit Court of Appeals affirmed last year's decision of U.S. District Judge Terence Kern in Tulsa that federal mug shots are exempt from public disclosure under the act.
The Denver-based court ruled Wednesday's 3-0 in favor of the marshals
service in a 15-page decision.
The World sued the Marshals Service in 2009 because the agency denied
the newspaper's FOIA request for mug shots of six people who were indicted
by federal grand juries in Tulsa and booked into jail by marshals.
