House passes abortion measure

OKLAHOMA CITY -- Abortion providers would be more susceptible to civil lawsuits, including wrongful death claims, under legislation passed Thursday by the Oklahoma House of Representatives.

House Bill 2561 by Rep. Paul Wesselhoft, R-Oklahoma City, would allow wrongful death suits against providers and in some cases third parties involved in referring pregnant women to providers if it is determined the abortion was performed without full compliance of all laws governing the procedure.

The bill, which passed 76-10 with 13 members not voting, includes reference to the controversial ultrasound provision that has been stayed by a court injunction. An amendment to remove that reference and another to eliminate third-party liability were stopped by a procedural maneuver.
