SALLISAW – An altercation between two brothers ended in homicide Tuesday, Sequoyah County law enforcement said.

Deputies found Scott Fueston, 37, with a gunshot wound to the upper torso at a residence 5 miles east of Sallisaw just after 5 p.m., said Sheriff Ron Lockhart.

Fueston’s adult nieces called police as Fueston’s brother locked himself in the home’s garage in an attempt to avoid Fueston’s attempts to fight him, Lockhart said. While one of the women was on the phone with emergency dispatchers, an audible gunshot ran out.

The men had apparently been fighting throughout the day and had only recently moved into the home with a third brother, Lockhart said.

Fueston, who had been shot with a high-caliber rifle, was found lying the garage. Medics treated and transported Fueston to Sequoyah Memorial Hospital, where he was pronounced dead an hour later.

Investigators believe Fueston’s brother shot Fueston in self-defense but have submitted the specifics of the case to the Sequoyah County District Attorney’s Office for further examination.
