Man sentenced to nine years as accessory in Tulsa killing

A second man has been sentenced to prison for being an accessory to a Tulsa murder nearly two years ago.

Miguel Angel "Spider" Lopez, 24, pleaded guilty Monday to an accessory charge in connection with the Dec. 31, 2010, fatal shooting of Donnie Clint Fitzpatrick, 26.

Fitzpatrick was shot multiple times in the detached garage of a residence in the 1200 block of South Braden Avenue, police reported.

His body was found two weeks later, on Jan. 14, 2011, on a creek bank in the 5800 block of East 15th Street, police reported.

In September, Joseph Richard "Joker" Hermosillo, 26, pleaded guilty to first-degree murder and was sentenced to a life prison term that requires him to serve more than 38 years in custody before becoming eligible for parole.

He received a concurrent four-year term upon pleading guilty to the unlawful removal of a dead body.

In accordance with a plea deal, a Tulsa County judge sentenced Lopez to nine years in prison on Monday for being an accessory to Hermosillo.

According to the affidavit, Lopez participated in disposal of the body by taking it to the creek bank.

Adding one year to Lopez's total sentence, District Judge Kurt Glassco upgraded a deferred sentence - which Lopez received in 2010 for distribution of methamphetamine - into a conviction and a 10-year prison term that runs concurrently with the nine-year accessory sentence.

Jose "Dreamer" Robledo, 41, pleaded guilty and was sentenced Nov. 26 to 10 years in prison for being an accessory by burning evidence of the murder, a court record shows.

A Tulsa police detective's affidavit says that when Hermosillo was interviewed in January 2011, he denied having participated in the murder but said the reason for it was that Fitzpatrick "had failed to show proper respect" for a Mexican gang.

Hermosillo was the only person charged with murder in the case.
