Senator urges Obama to investigate college's BCS

WASHINGTON — Shortly after winning last year's presidential election, Barack Obama said he was going to "to throw my weight around a little bit" to nudge college football's Bowl Championship Series to move to a playoff system.

On Wednesday, Sen. Orrin Hatch took him up on that.

Hatch asked the president to launch a Justice Department investigation into the way the BCS — a complex system of computer rankings and polls that often draws criticism — crowns its national champion.

"Mr. President, as you have publicly stated on multiple occasions, the BCS system is in dire need of reform," Hatch, R-Utah, wrote in a 10-page letter, obtained by The Associated Press.

Hatch, who held a hearing on the BCS in July, told Obama that a "strong case" can be made that the BCS violates antitrust laws.

Under the BCS system, some conferences get automatic bids to participate in top-tier bowls while others don't, and the automatic bid conferences also get far more of the revenue. Hatch's home state school, the University of Utah, is from the Mountain West Conference, which does not get an automatic bid. The school qualified for a bid last season but was bypassed for the national championship despite going undefeated.

The system "has been designed to limit the number of teams from non-privileged conferences that will play in BCS games," he wrote.

Hatch said that the BCS arrangement likely violates the Sherman Antitrust Act, because, he argued, it constitutes a "contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce," quoting from the law.

He said that the system "artificially limits the number of nationally-relevant bowl games to five. The result is reduced access to revenues and visibility which creates disadvantages to schools in the non-privileged conferences." Hatch is the top Republican on the Senate Judiciary's subcommittee on antitrust, competition policy and consumer rights.

The senator said that the hundreds of millions generated by college football "are hardly trivial sums," given that many schools use such revenue to fund things like other athletic programs.

The White House declined to comment. The Justice Department and BCS officials had no immediate comment.

Hatch's letter comes a few days after the BCS released its first standings of the year. And on Monday, a group of college football fans launched the Playoff PAC, with the hope of electing more lawmakers who will pressure the BCS to switch to a playoff system. Several lawmakers have introduced bills this year aimed at forcing a playoff system, but none of the bills has moved.

An investigation right now would be as useful as a sliding screen door on Air Force One. The world does not have the Sooners to push around this year since Kevin Wilson is making them take a year off to regroup. So none of what they do can hurt the Sooners like Mack Brown suggested as BCS rules and NCAA football committee member last year. The irony about doing something about the perceived problem is that now more than ever it could harm Texas. It means that a school that outspends the Sooners by 3x1 would be lowered to an even playing field with a school like University of North Texas. Mack cannot possibly like that scenario.

What a crock.... what does "national governance" have with a stupid BCS system. Does congress have too little to do?

1. China is overtaking USA as the number 1 economy in the world.
2. USA Dollar is being questioned as NOT being the world's currency, thus our CPI will be pegged against some other currency (think hyper inflation?)
3. Commercial real estate is about to explode and cause another financial crisis.

wow, I guess congress would rather deal with something bigger, like a bcs poll strategy. I have just changed parties... Not a republican... NOT a democrat... I am now a libertarian... get government out of our lives!

Let's give the BCS a bailout too, at taxpayer's expense.

@ definedego: me too, neither party reflects my views anymore. They both stand for bigger government, they just use different methods to get there. I am now an independent who wants less government, less nanny state and fewer entitlements.

Add to that list that China is buying up a huge amount of US debt...What would happen if they chose to "call" part of that debt (require immediate payment)? The more they own the more they can affect our economy in this way.

And when they're through with that, let them investigate why anti-trust laws do not apply to NFL and MLB. And if they are successful there, why do churchs not pay property taxes? And if they still have some time, they could investigate why cereal boxes keep shrinking, but the price stays the same, or goes up. Good Luck Boys.

Grant an exception to the anti trust laws, as enjoyed by the NFL- so, even if it is a violation, no harm, no foul

another example of the need for term limits- even a decent guy like Hatch is drunk with power due to his longevity in Congress

I swear this guy, Obama, reminds me of a kid in a candy store. He just runs around in circles grabbing this candy, that candy, run run run. He never makes it to the cash register to buy the candy, just runs around.

Defined ego, I have been a registered Republican since I became of age to vote in 1972. But, I'm seriously thinking of switching to either Independent or Libertarian.

We have these idiot Dem politicians screwing everything up, after they constantly badmouthed the Repubs when President Bush was in office. The Republican politicians have become weak-kneed weenies.

I've just about had it with both parties on the federal level and now with the 2 candidates for Mayor trying to see who can play the dirtiest politics/ads. I'm ready to switch!

Mar, you change to Independent or Libertarian and you probably will never vote in a primary again. In the primary election, you can only vote within the party that you are registered with. And while I agree with many of the Libertarian ideals, they have been unable to get a candidate on the presidential ballot for the last 8-12 years. Stay registered as a Republican (or change to Demograt) then vote your head when you get to the polling booth.
